CITY OF CUPERTINO 10300 Torre Avenue, Cupertino, California 95014 (408) 777-3308 To: Mayor and City Council Members Chairperson and Planning Commissioners From: Aarti Shrivastava, Director of Community Development Date: August 12, 2009 Subject: Director's Minor Modification, DIR-2009-19 to make changes to an existing Architectural and Site Approval (ASA-2004-04), to enclose 883 square feet of an existing 1,331 square foot outdoor patio, add a new bar, add associated mechanical equipment on the roof, and modify the parking lot and outdoor area to comply with accessibility requirements, at Alexander's Steakhouse located at 10330 N. Wolfe Road. Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports her decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION: In 2004, the Design Review Committee approved an Architectural and Site Approval application (ASA-2004-04), allowing exterior and interior changes for Alexander's Steakhouse located at 10330 N. Wolfe Road. The main purpose of this modification request is to enclose the outdoor patio area. However, associated improvements need to be made to make the site comply with the accessibility requirements. The applicant is requesting approval to do the following: • Enclose a portion of the existing outdoor patio area, • Add associated mechanical equipment • Add a new bar in the newly enclosed area • Add an ADA ramp in the outdoor area and • Modify the parking lot to comply with accessibility requirements This enclosed area will be Setback approximately 10 feet from the curb at the east ramp onto Wolfe Road from the Mall and not visible from any public streets, Use the existing foundation and thus, have no impact on the trees in the vicinity, Clad with a stone veneer. This veneer will be continued along an existing low wall at the perimeter of the outdoor area. The parking lot will be • Modified by taking out an existing planter to restripe that area for an ADA accessible stall. The existing ADA accessible stalls shall be restriped for the new standards in the Building Code. DIR-2009-19 August 12, 2009 Page 2 A new ADA ramp will be added to the outdoor area to allow for ADA access to.the new enclosed area The rooftop equipment will be housed behind an existing roof screen and will not be visible from the public domain. A('TTI~N~ The Director of Community Development deems the modification minor and approves the change as described in the plan set dated March 26, 2008 with the following conditions: 1. The expired building permit, 04050063, shall be reopened and work shall be completed to the satisfaction of the Building Official prior final occupancy. 2. No trenching around the existing trees has been approved. Prior to any trenching, the City's consulting arborist review is required. 3. No heavy equipment, including Bobcats, are not allowed between the trees on the east side of the property and outdoor patio exterior wall. The approval is effective August 12, 2009.
