The City of Cupertino ("City") will accept sealed bids for It52019 CONTRAC- TUAL STREET SWEEPING SERVICES ("Project"), Project No. 2019-101, by or before Tuesday, Oc- tober 1, 2019, at 2:00 p.m., at the City Clerk's Office, located at 10300 Torre Avenue, Cupertino California 95014 at which time the bids will be publicly opened in the City Hall lobby and read aloud. The City may, acting in its sole discretion, reject any and all bids, and may waive any im- material deviation from the bid requirements to the full extent permitted by law. 2. Project Information. 2.1 Location and Description. The Project is located city wide and is described as follows: the Work to be done consists of street sweeping of all City streets in accordance to this Con- tract documents. 2.2 Time for Completion. This project is for annual street sweeping, the term of this con- tract shall be five (5) years from the start date of the contract. The City shall retain the option to extend the term of the contract for an additional one (1) to five (5) years, for a possible total of ten years. 3. License and Registration Requirements. 3.1 License. This Project requires a valid California contractor's license for the following classificatlon(s): Not required. 3.2 DIR Registration. This section is not applicable due to the Contractor not being re- quired to pay prevailing wages, therefor no DIR registration is required for this project City may not accept aBid Proposal from or enter into the Contract with a bidder, without proof that the bidder is registered with the California Department of Industrial Relations ("DIR") to per- form public work pursuant to Labor Cade section 1725.5, subject to limited legal exceptions. 4. Contract Documents. The plans, specifications, bid forms and contract documents for the Project, and any addenda thereto ("Contract Documents") are available in electronic form only and may be downloaded from City's webslte under "Open Bids" at: hops://apps.cupertino. 1r ) bidmanagement/Index.asp trade journal. x and may also be available from a local or regional plan room or S. Bid Security. The Bid Proposal must be accompanied by bid security of ten percent of the maximum bid amount, in the form of a cashier's or certified check made payable to City, or a bid bond executed by a surety licensed to do business in the State of California on the Bid Bond form included with the Contract Documents. The bid security must guarantee that within ten days after City issues the Notice of Award, the successful bidder will execute the Contract and submit the performance bond and insurance certificates and endorsements and any other submittals as required by the Contract Documents and specified in the Notice of Award. 6. Prevailing Wage Requirements. This section is not applicable due to the Contractor not be- ing required to pay prevailing wages. 6.1 General. Pursuant to California Labor Code Section 1720 et seq., this Project is subject to the prevailing wage requirements applicable to the locality in which the Work is to be per - forme each craft classification or type of worker needed to perform the Work, including employer payments for health and welfare, pension, vacation, apprenticeship and similar pur- poses. 6.2 Rates. These prevailing rates are on file with the City and available online at http:// www.djr.ca.gov/DLSR. Each Contractor and Subcontractor must pay no less than the specified rates to all workers employed to work on the Project. The schedule of per diem wages is based upon a working day of eight hours. The rate for holiday and overtime work must be at least time and one-half. 6.3 Compliance. The Contract will be subject to compliance monitoring and enforcement by the DIR, under Labor Code section 1771.4. 7. Performance Bonds. The successful bidder will be required to provide a performance bond, for the penal sum of four (4) months total contract value of the Contractor's Bid as accepted, as further specified in the Contract Documents. B, Substitution of Securities. Substitution of appropriate securities in lieu of retention amounts from progress payments is permitted under Public Contract Code section 22300. 9. Subcontractor Limit The prime contractor is required to self -perform at least 100% of the Work on the Project, as further specified in the Instructions to Bidders. 10. Bidders' Conference. A bidders' conference will be held on August 20, 2019 at 9:00 a.m., at 10555 Mary Avenue, Cupertino, CA for the purpose of acquainting all prospective bidders with the Contract Documents and the Worksite. The bidders' conference is not mandatory. 11. Instructions to Bidders. All bidders should carefully review the Instructions to Bidders for more detailed information before submitting a Bid Proposal. The definitions provided in Article 1 of the General Conditions apply to all of the Contract Documents, as defined therein, including this Notice Inviting Bids.
