AN ORDINANCE OF THE CITY OF CUPER'.~INO AMENDING ORDINANCE N0, 107
OF THE CITY, PROVIDING FOR AN INCJ~EASE OF WATER RATES AND CHARGES
FOR WA`1'ER FURNISHED BY THE WATER ~3YSTEM OF THE CITY, AND DECLARING
THE URGENCY THEREOF,
THE CITY COUNCIL OF THE CITY OF CZJPERTINO DOES ORDAIN AS FOLLOWS:
Section 1: Amendment
Section 1: 1: Sub-paragraph .L of Section 3 of Ordinance No. 107,
entitled General Metered Service;," is hereby deleted and in its place
is inserted the following:
1. General Metered Service
a. Applicability
Applicable in all metered water service for domestic service,
commercial service and industrial service.
b. Rates
(i) Monthly Minimum Charge
For 5/8 x 3/~- inch meter ~ 2.75
For 1" meter ~+, 80
For 1-1/2 inch meter 6,00
For 2 inch meter 9.60
For 3 inch meter 18.00
Each "Monthly Minimum Ch~~rge" will entitle the customer to the
quantity of water which that minir7um monthly charge will purchase at
the monthly quantity rates set forth below:
(ii) Quantity Rates

Next 1500 cu. ft, per 100 cu, ft. ,38
Next 3000 cu, ft, per 100 cu. ft. ,3~+

Section 1:2: Sub-paragraph Vii. of Section 3 of Ordinance No. 107,
entitled Irrigation Service" is Yiereby deleted and in its place is in-
serted the following:
5, Irrigation Service
a. Applicability
Applicable only to service for untreated water produced and de-
livered by gravity flow for agriclzltural use only.
b, Rates
(i) For a flow up to 500 gallons per minute, the charge is
$3.00 per hour,
(ii) For a flow exceeding 500 gallons per minute and not ex-
ceeding 800 gallons per minute, tYie charge is $3.50 per hour.
(iii) For a flow exceeding 800 gallons per minute, the charge
per hour will be esta'plished by s~~ecial agreement between the City and
the consumer.
Section 2: Resolution Method for Future Adjustment of Water Rates
Section 2:1: The City Counc__1 shall hereafter make any adjustment
in water rates set forth in this ordinance by resolution adopted pursu-
ant to Section 36936.1 of the GovE;rnment Code of the State of California.
Such resolution shall be published in the same manner as ordinances are
required to be published.
Section 3: Severability Clause
Section 3: 1: Should this ordinance be held inoperative as an urgen-
cy ordinance, it shall thereupon take effect upon thirty (30) days from
its enactment as a non-emergency measure. Should any other provision
thereof be held unlawful, the remaining provisions shall remain in
full force and effect.
Section ~-: Urgency Clause
Section ~:1: This ordinance is enacted as an urgency measure pursu-
ant to Section 36937(b) of the Government Code of the State of California.
The facts constituting such urgency are as follows:
The principal and interest fund that must be maintained as required
in City of Cupertino Revenue Bond Issue Resolution No. 203 is overdrawn,
thereby creating a deficit. The City Council of the City of Cupertino
has been notified by counsel for 'pond holders that unless rates and
charges are increased immediately to protect the bond holders' invest-
ment, the bond holders will initiate proceedings at law to enjoin the
City Council to comply with bond covenants set forth in Resolution No.
203. Immediate enactment of this ordinance is necessary to comply with
such demand and to protect the City's financial credit standing.
Section 5: Publication Clause
The City Clerk be and hereby is authorized and directed to cause a
certified copy of this ordinance to be published within fifteen (15)
days after its enactment in the Cupertino Courier, a newspaper of gen-
eral circulation in the City.

the City of Cupertino, this 18th day of June, 1962, by the following
