AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1 OF ORDINANCE
N0. 2 BY RECLASSIFYING A CERTAIN PORTION OF THE CITY OF' CUPERTINO
FROM AN R-1:B-2 and a C-1-H DISTRICT TO AN R-3-H AND R-2-H DISTRICT.
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WHEREAS, on March 11, 1959, an application was filed by John T.
Racanelli and James Duvaras, Jr. for the rezoning of property from
an R-1:B-2 and a C-1-H District to an R-3-H and an R-2-H District;
and
WHEREAS, upon due notice and after two public hearings the
Planning Commission recommended to the City Council that the reclass-
ification be granted; and
WHEREAS, the property to be rezoned is presently in an R-1:B-2
and a C-1-H District; and
WHEREAS, a map of the subject property is attached hereto as
Exhibit "A" as a proposed amendment to the Master Zoning Map of the
City of Cupertino;
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the following described property, 'pe and here-
by is zoned to R-3-H and R-2-H classification and that Exhibit "A"
attached hereto is made part of the Master Zoning Map of the City of
Cupertino:
All that certain real property situate in the City of Cupertino,
County of Santa Clara, State of California, described as follows:
BEGINNING at a point in the Northerly line of that certain 19.59
acre tract of land described in the Deed from San Jose Abstract &
Title Insurance Co., a corporation to Michael De Palma, et ux, dated
January 21, 1846, recorded January 22, 1846 in Book 1318 Official
Records, page 170, Santa Clara County Records, distant thereon South
8g° 46' West 310.14 feet from the Northeasterly corner thereof in
the center line of Saratoga-Sunnyvale Road; thence from said point
of beginning South 0° 10' East an~~. parallel with said center line of
Saratoga-Sunnyvale Road 643.87 fe°t to a point on the Sow herly line
of said 19.59 acre tract; thence nlest along said last named line
170 feet, more or less, to the Southeasterly corner of that certain
tract of land described in the De~°d from W. H. Field III, et al, to
Harry W. Chow, et ux, dated March 8, 1957, recorded March 29, 1957,
in Book 3762 Official Records, pa;~e 26, Santa Clara County Records'
thence North along the Easterly lane of land so described in the
Deed to said Chow 643.17 feet to the Northeasterly corner thereof in
said Northerly line of the 10,59 ;acre tract; thence North 8g° 4 6'
East along said last named line 1~8.2g feet to the point of beginning.
TOGETHER WITH and as appurten~~nt to and for the benefit of the above
described tract of land, a non-ex~~lusive easement for the purpose
of ingress and egress and for the installation and maintenance of
public utilities over a strip of .Land, 20.00 feet in width, the
Northerly line of which is more p<~.rticularly described as follows:
Beginning at a point in the center line of the Saratoga-Sunnyvale
Road at the Northeasterly corner ~~f that certain 19.59 acre tract of
land described in the Deed from S<~.n Jose Abstract & Title Insurance
Co., a corporation to Michael De Palma and Rose De Paama, his wife,
joint tenants, dated January 21, Lg46, recorded January 22, 1846,
in Book 1318 Official Records, at page 170, Santa Clara County
Records; thence from said point of beginning South 8g° 46' West
along the Northerly line of said Lg.59 acre tract 310.14 feet to the
Northeasterly corner of that cert;~.in 15.00 acre tract of land des-
cribed in the Deed from Michael D~~ Palma, et ux to W. H. Field III,
et al, dated December 2g, 1955 an~~. recorded December 30, 1955 in
Book 3375 Official Records, page 362, Santa Clara County Records, as
granted in the Deed from John Tronis, et ux to W. H. Field III and
John Rodrigues, Jr., dated October 2, 1956, recorded October 4,
1956 in Book 3622 Official Records, page 551, Santa Clara County
Records.
Section 2. This Ordinance shall take effect and be in force
thirty 30 days after its passage, and before the expiration of
fifteen (15) days from and after its passage, this Ordinance shall
be published once with the names of the members voting for or
against the same in the Cupertino Courier, a newspaper published in
said County of Santa Clara.
Introduced at a regular meeting of the City Council of the City
of Cupertino on the 2nd day of November, 1959. Passed and adopted
at a regular meeting of the City Council of the City of Cupertino on
the 8th day of December, 1959 by the following vote:
AYES: Councilmen: Lazaneo, Nathanson, Pelosi, Saich, Wilson
