A N ORDINANCE OF THE CITY OF CUPE]~TINO AMENDING SECTION 1 OF ORDIN-
ANCE N0, 2 BY CLASSIFYING A CERT~~IN PORTION OF THE CITY OF CUPER-
TINO AS A M-1-H DISTRICT,
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS
FOLLOWS:
WHEREAS, on August 14, 1959, an application was filed by
Charles Rifredi for the rezoning of property to an M-1-H District;
and
WHEREAS, upon due notice and after two public hearings the
Planning Commission recommended t;o the City Council that the class-
ification be granted; and
WHEREAS, the property to be rezoned has recently been annexed
to the City; and
WHEREAS, a map of the subject property is attached hereto as
Exhibit "A" as a proposed amendment to the Master Zoning Map of the
City of Cupertino;
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section I. That the following described property, be and
hereby is zoned M-1-H classification and that Exhibit "A" attached
hereto is made part of the Master• Zoning Map of the City of Cupertino:
All that certain real property situate in the City of Cuper-
tino, County of Santa Clara, State of California, described as
follows:
Beginning at a point in the center line of Stevens Creek Road,
at the Southwesterly corner of that certain parcel of land described
in the Deed from Fiuri 0, Gagliasso et al, to Charles Rifredi et
ux, dated August 25, 1941 and recorded on August 28, 1941 in Book
1051 of O,R. at page 531, Records of Santa Clara County, Calif,,
and from which point of beginning, an iron pipe set 8 inches below
the surface of the ground and in the Northerly line of Stevens
Creek Road bears North 0° 04~ east 30,00 feet; thence leaving said
center line and running at right ~.ngles along the Westerly line of
the land so described in the Deed to Rifredi North 0° 011-' East
175.00 feet to an iron pipe set 8 inches below the surface of the
ground at the Northwest corner of land so described in the Deed
to Rifredi; thence at right angles along the Northerly line there-
of, and along the Northerly line ~~f land described in the Deed from
Fiuri 0, Gagliasso et al to Charles Rifredi et ux dated January
5, 1931 and recorded on January 8, 1931 in Book 5~+6 O.R. page
429, South 89° 56~ East 125.00 feet to the Westerly line of the
1.336 acre tract of land described in the Deed from Sarah J. Hall
to Benjamin Franklin Cloud, dated February 15, 1913 and recorded
on February 15, 1913, in Book 391 of Deeds, at page 585; thence at
right angles along the Westerly l:~ne of said 1.336 acre tract of
land North Oo 04- East ~-05.00 fee~~ to the Northernmost corner of
said 1,336 acre tract of land, in the South westerly line of the
Southern Pacific Railroad Company~s Right of Way; thence along
said right of way North 19° 08~ WE:st 278.00 feet; thence continuing
along the Southwesterly line of s~~.id right of way, on a curve to
the left with a radius of 3779.7 :'eet, through a central angle of
5° 12~ 06" for a distance of 343,:L4 feet; thence leavin said
Southwesterly line and running Solzth 60 04~ West 1161.0 feet to a
point in the center line of Stevens Creek Road, said last mentioned
being at the point of intersection of the center line of Stevens
Creek Road South 89° 56- East 93.32 feet to the place of beginning
containing approximately 3,94 acrE~s, and being a part of the North-
west quarter of Section 14, Township 7 South Range 2 West, M,D,B,
& M. Santa Clara County, California. Surveyed November 16, 1945,
by McMillan & McMillan, civil Eng'_neers and Surveyors, San Jose,
California
TOGETHER with an easement for the purpose of ingress and egress
and public utilities over a strip of land 35.00 feet in width the
Easterly line of which is described as follows:
BEGINNING at a point in the center line of Stevens Creek Road
at the Southwesterly corner of the above described 3.94 acre tract
of land, and running thenc~ along the westerly line of said 3.94
acre tract of land North 0 04t East 1161.04 feet to a point in the
Southwesterly line of the Southern Pacific Railroad Right of Way.
RESERVING therefrom an easement for the purpose of ingress
and egress and public utilities over a strip of land 35.00 feet in
width the Westerly line of which is described as follows:
BEGINNING at a point in the center line of Stevens Creek
Road, at the Southwesterly corner of the above described 3.94 acre
tract of land, and running thence along the Westerly line of said
3.94 acre tract of land North 0° 04~ East 1161.04 feet to a
point in the Southwesterly line of the Southern Pacific Railroad
Right of Way.
Section II. This Ordinance shall take effect and be in force
thirty 30 days after its passage, and before the expiration of
fifteen (15) days from and after its passage, this Ordinance shall
be publish ed once with the names of the members voting for or against
the same in the Cupertino Courier, a newspa per published in said
County of Santa Clara.
Introduced at a regular meeting of the City Council of the
City of Cupertino on the 5th day of October, 1959. Passed and
adopted at a regular meeting of the City Council of the City of
Cupertino on the 23rd day of October, 1959, by the following vote:
