Ordinance 099ORDINANCE; N0. 99 AN ORDAIA NCE OF THE CITY OF CUPEF~TINO AMENDING SECTION 1 OF ORDINANCE N0. 2 BY RECLASSIFYING A CERTAIN PORTION OF THE CITY OF CUPERTINO FROM AN R-l:B-2 DIS'T'RICT TO AN R-1 DISTRICT. THE CITY COUNCIL OF THE CITS' OF CUPERTINO DOES ORDAIN AS FOLLOWS: WHEREAS, on June 5, 1959, are application was filed by M. J. King Construction Company, for the rezoning of property from an R-l:B-2 District to an R-l District, arr3. WHEREAS, upon due notice and. after two public hearings the Planning Commission recommended to the City Council that the reclassification be granted, and WHEREAS, the property to be rezoned is presently in an R-l:B-2 District, and WHEREAS, a map of the subject property is attached hereto as Exhibit "A" as a proposed amer..dment to the Master Zoning Map of the City of Cupertino; NOW, THEREFORE, BE IT ORDAI)\iED AS FOLLOWS: Section I. That the following described property be, and hereby is zoned R-1 classificaticn and that Exhib it "A" attached hereto is made part of the Master Zoning Map of the City of Cupertino All that certain real property situate in the City of Cupertino, County of Santa Clara, State of California, described as follows: Beginning at a point on the Northeasterly line of Bollinger Road (40 feet wide) at the Southv~~esterly corner of that certain parcel of land conveyed by Paul Presley, et ux, to Wilbur 0. Jones, et ux, by Deed dated March 16, 148, recorded March 23, 19.8 in Book 1584 of Official Records, page 528, Santa Clara County Records; thence Northerly along the Westerly line of said lands conveyed to Jones N. 0° 23' E. 3C~-.Ol feet to the Northeasterly corner of that certain parcel of land described in the Deed from Gilbert S. Hoover, et ux, to James H. Paulic, et ux, dated April 2~, 1950, recorded May 1, 1950 in Book 1970 of Official Records, page 190, Santa Clara County Records and the TRUE POINT OF BEGINNING of the herein described parcel of land; thence from said true point of beginning and continuing along said Westerly line N. Oo 231 E. 555 feet more or less to a point in the southerly line of that certain 20 acre tract described in the Deed from J. C, Murphy, et ux, to Tacoma Butts, dated October 15, 1901, recorded in Book 249 of Deeds, page 112, Santa Clara County Records, thence westerly along the Southerly line of said 20 acre tract N. 89° 371 W. 717 feet more or less to a point distant 310.00 feet measured at right angles from the Easterly line of that certain strip of land 20.00 feet wide as described in the Deed from F. A. Bachman, et ux, to the State of California, by deed recorded January 19, 192, in Book lo6g of Official Records, page x+86, Santa Clara County Records• thence Southerly along a line parallel to said Easterly line S. Ob 201 Tti. 590 feet more or less to the intersection thereof with the said Northeasterly line of Bollinger Road; thence along said Northeasterly line S. 69° 401 E. x+90 feet more or less to the Southeasterly corner of that certain parcel of land conveyed by J. M. Butts, to H. C. Butts, as recorded in Volumn 515 of Deeds, page 367, Santa Clara County Records; thence along the Easterly line of said lands conveyed to Butts N. 0° 25' E. 260 feet more or less to a point distant 500.00 feet measured at right angles from the aforesaid Southerly line of that certain 20 acre tract conveyed to Tamura Butts; thence Southerly along a line 195 feet more or less to the Northwesterly corner of the aforesaid parcel of land conveyed to Paulic, et ux; thence along the Northerly line of the lands so conveyed to Paulic S. 8g° 37~ E. 75.00 feet to the true point of beginning. Section II. This Ordinance shall take effect and be in force thirty 30) days after its passage, and before the expira- tion of fifteen (15) days from and after its passage, this Ordinance shall be published once with the names of the members voting for or against the same in the Cupertino Courier, a news- paper published in said County of SantaClara. Introduced at a regular meeting of the City Council of the City of Cupertino on the 17th day of August, 1959.
