Subject: Director's Minor Modification, DIR-2009-18 to make changes to an existing Use
Permit (U-2006-14) to modify the parking lot arrangement, parking lot tree location,
and the location and configuration of stairs and the trash enclosure.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports her decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION:
In 2007, Planning Commission approved a use permit, U-2006-14, allowing the construction of
three residential units, office space on the first floor and basement and associated parking at
10056 Orange Avenue. The applicant, Terry Brown, is requesting approval to:
• Modify the parking lot arrangement and tree planting,
• Rearrange the basement court stairs and
• Relocate the trash enclosure
The main purpose of modification request is to comply with the Building Code. In order to
achieve this:
• The ADA Handicap stall has been increased in width by 3 feet.
• The landscape island at the end of the parking stalls has been reduced in width.
• Diamond planters have been proposed in the parking lot in order to accommodate
shade maple trees which were originally proposed in the landscape island.
• Stairs to the basement courtyard have been re-oriented. Originally there were two
flights of stairs, now there is one.
• The trash enclosure area has been relocated to the right of the stairs.
ACTION:
The Director of Community Development deems the modification minor and approves the
change as described in the plan set dated March 26, 2008.
The approval is effective August 10, 2009. The fourteen calendar day appeal period expires on
August 24, 2009.
