OF THE ARCHITECTURAL AND SITE APPROVAL COMMITTEE
OF THE CITY OF CUPERTINO REQUESTING CITY COUNCIL
GUIDELINES FOR INTERPRETATION OF COPY CONTENT
STANDARDS AS SPECIFIED IN SECTION 7.03, SIGN
ORDINANCE 746.
Background of Committee's Request:
At the City Council meeting of September 19, 1977, Application HC -51,410.2
requesting an industrial building wall sign was approved, reversing a denial
recommendation offered by the ASAC. Recall that this sign included the
firm name and a listing of its principal, internal divisions. The
Committee applied Section 7.03 of the Ordinance and found that the copy was
beyond the minimum necessary to identify the business location.
It was the Committee's opinion that the list of services was superfluous
in this instance.
A. The additional copy was targeted for a very specific and
limited number of persons, not the general public. Those
persons could locate the business by one name and street
address alone.
B. Committee agrees that additional copy is a helpful service,
not advertising; crucial question is necessity of that extra
copy given Sign Ordinance's intent to simply external message.
At its October 6, 1977 meeting, the applicants for Spinnin' Wheels
Skatepark requested a ground sign listing the Skatepark name and services
available therein. Their action to list the services as ancillary copy
resulted from your Council's decision in the G.P.I. matter. After
considerable debate, the Committee agreed to the proposal, finding that
the ancillary copy is a service to the public at large which may decide
to frequent the establishment based on the additional information.
The Committee is uncertain as to procedure in future decisions on this
topic; the concerns are: a) Precedent - How should future applicants
wishing to list their services on sign faces be advised? b) Degree -
At what point does ancillary copy cease to function as identity and
begin to function as advertising?
