ROLL CALL Members present: Irvine, Ripplinger, Sallan and Chairman Claudy Members absent: Bond Staff present: Senior Planning Technician Caughey Chairman Claudy announced that no public hearing would be initiated after 11:00 p.m. and that the Committee would adjourn at midnight. INFORMAL REVIEW OF PLANNED DEVELOPMENT USE PERMIT APPLICATION: None APPROVAL OF MINUTES: Minutes of Regular Meeting of May 19, 1977 not available Minutes of Regular Meeting of June 9, 1977: Page 2, paragraph 7 should read: "...sign was within square footage ordinance limits, but pointed out the intent of the ordinance was also to provide...." Page 3, paragraph 4, last line, replace the word "this" with "the proposed". Page 4, third paragraph from the bottom, first line should read: "Delineation between the wording of the shopping center and.....". Motion carried, 4-0 POSTPONEMENTS: None WRITTEN COZLti1UNICATIONS: None ORAL COMMUNICATIONS: None PUBLIC HEARINGS: 1. Application HC -51,011.1 - Woolworth Construction Company, Inc. requesting approval of site for the construction of two retail buildings located at the northwest quadrant of the intersection of Blaney Avenue and Stevens Creek Boule- vard. Continued from ASAC meeting of June 9, 1977. Mr. Ronald A. Woolworth, P. 0. Box 1399, Los Gatos, said the owner of the adjoining property, Fireside Thrift, had approved plans as proposed. The parking would be facing out. Concern had been voiced about how to police the parking. Mr. Woolworth said signs would be mounted. Mr. Woolworth said he had talked with Mr. Siron, owner of adjacent residence,about type of tree to be planted on northern boundary. Mr. Siron was to talk to other residents and appear at tonight's meeting. Mr. Woolworth reported Mr. Siron had noted the trash in this area had been picked up at 5:00 a.m. He had called the Los Altos Garbage Company but his call had not been returned. The consensus arrived at was to leave the trash enclosure as proposed. MINUTES OF THE JUNE 23, 1977 H -CONTROL MEETING Member Sallan pointed out the trash enclosure should not be visible from the street. She felt there should be landscaping on the trash enclosure wall. The trash collector at the 7-11 Store was discussed. Mr. Woolworth answered Chairman Claudy that reciprocal easements had been agreed to by Fireside Thrift. Staff member Caughey pointed out the driveway would have to be moved over into the Woolworth property about 6 ft. He also indicated where a 13 ft. aisle would be required to be 14 ft. Mr. Woolworth again agreed to plant whatever variety of tree was wanted along the northern boundary. The hearing was opened to public comments. There were none. Member Ripplinger moved to close Public Hearings, seconded by Member Sallan. Motion carried, 4-0 Member Ripplinger moved to approve Application HC -51,011.1 site plan as modified with the following conditions: (1) That the curb cuts be made to the accepted standard approved by staff. (2) The east base of the block wall of the trash enclosure be landscaped. (3) That the northerly planting area tree selection is to be to the mutual agreement of residents and applicant verified by staff approval. (4) The internal parking area will be maintained to the specific criteria of Parking Details, sheet 29/51, City of Cupertino, Standard Details. Seconded by Member Ir,rine. Motion carried, 4-0 Chairman Claudy advised this application would be heard by the City Council on July 5, 1977. Application HC -51,333.8 - Barnhart Construction Company requesting approval of site, architecture, landscaping and grading for construction of an office building located at the northeast corner of Valley Green Drive and Beardon Drive. Staff member Caughey displayed the site plan and elevations of the proposed buildings. Mr. David C. Thimgan, 3016 Scott Blvd., Santa Clara, answered Member Ripplinger there is approximately 200+ feet between this building and the Sobrato-Berg building. Mr. Thimgan answered Member Irvine that the one way traffic would obviate need for the stop sign. In answer to Member Ripplinger, Mr. Thimgan said there was an exist- ing planter area at north end of building not indicated on the site plan. He pointed out this was Sobrato-Berg property. He felt what was there and what they would be adding would be adequate. Moving the building to the south would not be satisfactory as they are already about one foot from setback line as it was and more land- scaping would be lost at the front of the building. The feasibility of moving the building to the south was discussed. Member Irvine said he thought this was a good solution to a difficult piece of property. Chairman Claudy agreed. Mr. Thimgan advised that Sobrato-Berg had not been interested in having a reciprocal driveway between the properties. Mr. Thimgan answered Member Sallan he would talk with Sobrato-Berg about adding taller plantings to the existing planter area. Staff member Caughey referred to guidelines, noting a meandering walk would conform with surrounding industrial area. Mr. Thimgan said they felt the landscaping would be more of an impact on the building than the meandering sidewalk. There is an existing 10 ft. sidewalk. They are planning to reduce it to 5 ft. and add landscap- ing. Member Irvine pointed out a meandering sidewalk would be difficult to incorporate because of the curved line of the property. Member Ripplinger expressed concern about chopping out half of the sidewalk before the landscaping could be done. MINUTES OF THE JUNE 23, 1977 H -CONTROL MEETING Member Sallan noted what was being proposed was not a meandering sidewalk and it should be clarified whether it would meet the intent of the guidelines. Chairman Claudy pointed to the existing Ski Any Mtn. sidewalk and said he felt a meandering sidewalk in such a short distance would be out of place. After discussion, it was agreed that because of the shape of the lot and the existing sidewalk, the proposed sidewalk would be construed to meet criteria of guidelines. It was pointed out another requirement of the guidelines was to have mounding and shrubbery along auxiliary streets. Mr. Thimgan said he did not think there was room enough for mounding. He agreed to add shrubs. Mr. Caughey indicated there should be three varieties of trees along Valley Green Drive and only two were proposed. Mr. Thimgan agreed to add another type of deciduous tree. The hearing was opened to public comment. There were none. Member Sallan moved to close Public Hearings, seconded by Member Irvine. Motion carried, 4-0 Mr. Thimgan described lighting. He said there was no sign being requested at this time. Member Sallan moved to approve Application HC -51,333.8 to the City Council, subject to standard H -Control conditions and enclosures A and B with the further conditions: (1) That the northerly property line, owned by Sobrato-Berg, be planted with a tall variety of plant subject to the applicant's landscape architect and City Engineer's approval, and agreement with adjoining property owner that this is an acceptable approach. (2) To add deciduous tree plantings to the Valley Green Drive frontage to meet the criteria of the Design Guidelines for North De Anza Boulevard. The type and number to be worked out by the applicant and City staff, subject to the approval of the City staff. Seconded by Member Irvine. Motion carried, 4-0 HC -196 Page 5 Public Hearing closed HC -51,333.8 approved w/ conditions HC -196 Page 6 HC -51,42 3.1 San Carlos Homes and Development Company MINUTES OF THE JUNE 23, 1977 H -CONTROL MEETING Chairman Claudy advised this application would now be heard by the City Council at its July 5, 1977 meeting. At 8:08 p.m. a recess was called with the meeting reconvening at 8:17 p.m. 3. Application HC -51,423.1 - San Carlos Homes and Development Company (Alcalde Knolls) requesting approval of grading for a single-family residential subdivision located opposite the intersection of Lockwood Drive and Voss Avenue. Chairman Claudy advised this committee would be reviewing only grading and fencing of this application. Any other aspect is out of the control of this committee. He referred to a specific condition imposed by Planning Commission. Staff member Caughey explained exhibits showing fence lines, grades and three earthwork options. Mr. Jack T. Chamberlain, 1620-C El Camino, San Carlos, answered Chairman Claudy that a large Oak tree was on Lot 43. He further described fencing intent. The pond area was discussed. Mr. Chamberlain said they were working to find a public agency who would accept liability for the pond area. If so, they would put in a fence of chain link around the area and San Carlos Homes would contribute to the installation of the fence. Ms. Nancy Hertert, 22830 San Juan, Cupertino, who has been working to find someone who will accept the liability, said there was a great deal of interest in the pond area but a great deal of reluctance to accept the liability. Mr. Chamberlain said if no one would accept liability for it, the pond area would be drained and the additional land divided among the adjacent 13ts. Mr. Bill Clark, 424 Casa Loma Ct., San Jose, said he had been asked to develop a plan so some entity would take the pond over. He said the biggest thing would be fencing it off. Mr. Chamberlain said they would not fence that area until the pond issue had been resolved. He said the time period could be extended as far as they were concerned. A resident expressed concern about the state of the fence along the property line next to apartment houses. MINUTES OF THE JUNE 23, 1977 H -CONTROL MEETING A resident said the fences facing the streets should be of durable material and should be landscaped properly. Chairman Claudy said he had studied the fencing ordinance and explained what he felt was the intent of it. He pointed out several of these lots will have 4 ft. pasture type fences. Mr. Chamberlain explained landscaping to cover cut areas. He said landscaping within the subdivision would be done by the home owners. A resident then asked that street lights be shielded. She was concerned that because of grade differences the lights would be shining directly into their property. Chairman Claudy explained that since the streets would be dedicated to the City, City lighting standards would be followed. Mr. Don Pezzolo, 22811-A Medina Lane, Cupertino, asked for clarifi- cation of fencing. He wondered if the fences on Voss Avenue could be controlled to 4 ft. high open fences. The fencing ordinance was discussed further. It was agreed the intent was to have a visual corridor. Mr. Chamberlain said this was included in their CC&R. He described fence being proposed. Types of fencing were discussed. Mr. Pezzolo said the usual type of fencing lasted about two or three years. Chairman Claudy pointed out that with homes of this value, the fences were usually maintained'; Mr. Chamberlain said they would be putting a fence 5 ft. in on their property line adjacent to apartments so he felt the apartment fence would be torn down. Ms. Hertert ascertained the fencing around pond would be chain link of a height not easily scaled by youngsters. Mr. Caughey referred to wire mesh fences to contain pets. He said there was the danger of inhibiting migration habits of wild life in the area. It should be understood that migratory patterns are to be left open. Mr. Chamberlain felt this would be handled by the CC&R. Chairman Claudy then spoke to the grading. He noted most of the cut areas behind the houses are roughly 34 degree slopes and he knew from personal experience that this was too steep. HC -196 Page 7 H C-196 Page 8 Public Hear- ing closed MINUTES OF THE JUNE 23, 1977 H -CONTROL MEETING Mr. Chamberlain said lots 29-33 are down slope houses and most cut and fill areas would be covered by structure. The rear and front yards will be level. He said they had tried to keep natural slope so as not to disturb vegetation. He said they were trying to minimize earthwork to prevent visible scarring. Mr. Chamberlain exhibited plans showing profiles of several buildings. Mr. Ronald Jackson, 1407 E. 3rd Avenue, San Mateo, described method for cutting angle face. Chairman Claudy said the ideal solution would be to terrace these lots. Mr. Chamberlain suggested some retaining walls. Member Irvine said he felt the grading should be tied into contours more. Mr. Jackson said they could be 2 to 1, but that would entail sliver cutting. Mr. Chamberlain said intent was to replant with native plants. Chair- man Claudy noted proposed plantings were really not a majority of native plants . Chairman Claudy said he did not feel competent to make a decision on the slope but from his personal experience, he had a concern about this proposal. A resident again expressed concern about the lighting fixtures. She was advised to attend the City Council meeting and express these concerns. Mr. Chamberlain said there were several very nice fixtures on the market that they would be happy to install. Ms. Hertert referred to Hillside goals, noting some areas did not have lights at the request of the homeowners. Mr. Clark noted the drainage for pond runs through Lot 1 and makes a difference in grade. Mr. Chamberlain said the drainage channel was being approved and the City asked for easement so fence could run parallel with disc. Member Sallan then moved to close Public Hearings, seconded by Member Irvine. Motion carried, 4-0 MINUTES OF THE JUNE 23, 1977 H -CONTROL MEETING Member Irvine moved for approval of Application HC -51,423.1 with the following conditions: 1-8. Architectural and Site Approval Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 9. That the approval is based on Exhibits A, B, B-1, B-2, B-3, B-4, C, D, D-1 through D-11 of this application except as may be amended by special conditions contained he rein. 10. Lots 1 through 28 shall be permitted a combination of pasture type fencing and solid board privacy type fencing as illustrated on Exhibit A. Additionally, these lots may be permitted to fully enclose the yard areas with the provision that lot lines commonly shared with the remaining lots in the development shall be required to utilize the open rail fencing. Lots 1 through 33 shall be permitted to extend fence lines as required and allowed under the fence ordinance. Lots 34 through 43 shall be required to utilize the fence type as illustrated on Exhibit A. Lot owners in this area similarly may be allowed to further enclose property lines with this type of fencing subject to the setbacks and constraints of the Fence Ordinance. In no case, shall fencing of Lots 41, 42, 43 which is commonly shared with the adjoining property in this development be permitted solid board privacy fencing on the property line. 11. The grading plan as illustrated on Exhibit D is approved in concept with the provision that the staff shall review the final grading plans at the building permit stage to ensure conformity with this plan. The Applicant shall provide a minimum of 13 ft. of slope rounding as provided for in Condition No. 17 of Planning Commission Resolution No. 1614. Staff shall have the ability to refer any specific lot grading plan back to the Architectural Committee should the final grading not conform with this plan in concept. Side yard fences for Lots 1, 6 and 7 shall be limited to the open pasture fencing as approved for the larger lots on the site in order to retain a view corridor. Height shall not exceed 4 ft. Seconded by Member Sallan. Motion carried, 4-0 Member Sallan referred to Hillside Goals study. The hills are unique and one issue in the study was lighting. Mr. Chamberlain said he would submit photos to staff of a light fixture he felt would be satisfactory. UNFINISHED BUSINESS: Staff member Caughey distributed a letter from Henry J. Brook regarding Spring Oaks Development's proposal for revised sound wall. A rendering of the wall was displayed. Member Irvine agreed that the redwood fence proposed would be more desirable. Member Ripplinger ascertained there would be ground cover and trees for the slope. Mr. Henry J. Brook, 86 Third Street, Los Altos, said the fence would be a T-8 plywood stained to match the building itself. Chairman Claudy referred to another proposed project adjacent to this and felt this could be a good point for a continuation of a redwood fence rather than a masonry wall. Mr. Caughey pointed out another type of tree might be desirable since the City felt the pine tree was not appropriate. Member Sallan said she would like to know the reasoning behind the suggestion of change before it was done. After further discussion, the committee agreed that moving the fence up the slope and using a redwood fence would be satisfactory. Member Sallan pointed out the need for very good landscaping to screen the fence and felt the landscaping portion of the application should be looked at again in light of this change. The committee agreed. Member Ripplinger ascertained the City would maintain the landscaping on the outside of the fence. MINUTES OF THE JUNE 23, 1977 H -CONTROL MEETING Member Irvine ascertained the resawn side of the plywood would face Foothill Boulevard. The applicant indicated his willingness to do anything within reason with regard to the landscaping. He was given the guideline that the fence should be densely landscaped. Mr. Caughey was to ascertain why the City was opposed to the pine tree . Chairman Caughey advised again that the Zilog trash container was still sitting in front of the trash enclosure. A brief discussion was held on why this had not been corrected. Letters to the City Council regarding landscaping and ASAC request to participate in advisory capacity to Parks and Recreation were discussed. NEW BUSINESS: None INTER COMMISSION NOTES: i1INUTE ORDER TO THE CITY COUNCIL The ASAC request the Council to direct staff to study and develop an approach to street light standards in the hill areas of Cupertino which will reflect the uniqueness of this area and which we believe requires a different approach than that on the valley floor. This request is in support of citizen and developer input in the recent San Carlos Homes application and also is consistent with the original recommendation by the Cupertino Goals Committee.
