HomeMy WebLinkAboutCC Resolution No. 26-041 approve Budget Modification #2526-436 to increase appropriations in 100-71-702 750-101 (Fiscal Year 2025-26 Adopted Budget) by $660,000RESOLUTION NO. 26-041 A RESOLUTION OF THE CUPERTINO CITY COUNCIL AUTHORIZING THE CITY MANAGER TO EXECUTE A CONSULTANT AGREEMENT WITH PLACEWORKS, AND APPROVING BUDGET MODIFICATION #2526-436 FOR THE FISCAL YEAR 2025-26 FOR A HOUSING ELEMENT UPDATE, INCLUDING INTERNAL CONSISTENCY UPDATES TO THE GENERAL PLAN, RELATED REZONING, AND ALL NECESSARY ENVIRONMENTAL REVIEW AS REQUIRED UNDER STATE LAW. WHEREAS, the Housing Element of the General Plan is required to maintain an inventory of housing sites which will accommodate the City’s Regional Housing Needs Allocation (RHNA) by income level at all times during the Planning period (2023-2031); and WHEREAS, beginning December 16, 2025, the City has been unable to make the necessary findings of no net loss pursuant to Government Code Section 65863; and WHEREAS, pursuant to state law, the City has 180 days to identify and complete rezoning to find additional sites to accommodate the City’s remaining unmet RHNA by income level from December 16, 2025; and WHEREAS, the City Council has directed staff to begin the process of finding additional sites to comply with state law; WHEREAS, Placeworks assisted the City with its update the 6th Cycle Housing Element between 2022 and 2024, and has familiarity with the City and its adopted policy documents and geography; and WHEREAS, Placeworks submitted a proposal on March 2, 2026 to assist with updating the Housing Element to address the requirements of state law related to no net loss; and WHEREAS, Staff is recommending that Council award a consultant agreement to Placeworks, and authorize the City Manager to make change orders to said agreement, for the update to the Housing Element, associated General Plan amendments, rezoning and all necessary environmental review as required under state law to comply with the requirements of Government Code Section 65863; and NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby approve Budget Modification #2526-436 to increase appropriations in 100-71-702 Resolution No. 26-041 Page 2 750-101 by $660,000 for an update to the Housing Element, associated General Plan amendments, rezoning and all necessary environmental review as required under state law to comply with the requirements of Government Code Section 65863 PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cupertino this 7th day of April, 2026, by the following vote: Members of the City Council AYES: Moore, Chao, Fruen, Mohan NOES: None ABSENT: Wang ABSTAIN: None SIGNED: ___________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________ Kitty Moore, Mayor City of Cupertino _______________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________ Date ATTEST: ________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________ Lauren Sapudar, City Clerk ___________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________ Date 4/15/2026 4/15/2026
