AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1 OF
ORDINANCE N0. 2 BY RECLASSIFYING A CERTAIN PORTION OF THE CITY OF
CUPERTINO FROM AN R-l:B-2 DISTRICT TO AN R-1 DISTRICT.
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS
FOLLOWS:
WHEREAS, on September 22, 1158, an application Was filed by
William L. Irvine for the rezoni:~.g of property from an R-1:B-2
Dist?-ict to an R-1 District; and
WHEREAS, upon due notice an~3 after two public hearings the
Planning Commission did not recommend to the City Council that
the reclassification be granted; and
WHEREAS, applicant appealed to the City Council upon con-
clusion of the hearings before t]ze Planning Commission;
WHEREAS, the City Council v~~ted to instruct Counsel to
cause preparation of an ordinance: rezoning the subject area;
WHEREAS, the property to be rezoned is presently in an
R-l:B-2 District; and
WHEREAS, a map of the subje~~t property is attached hereto
as Exhibit "A" as a proposed ame~zdment to the Master Zoning Map
of the City of Cupertino;
NOW, THEREFORE, BE IT ORDA I:VED AS FOLLOWS
Section I. That the following described property, be and
hereby is zoned to R-1 classific~~.tion and that Exhibit "A"
attached hereto is made part of ~~he Master Zoning Map of the
City of Cupertino:
All that certain real property situate in the City of
Cupertino, County of Santa Clara., State of California, described
as follows:
Beginning at a point on the northeasterly line of the
Bollinger Road distant thereon North 69° 40c West, 13.79-3/~+
chains from the point of interse~;tion of the northeasterly line of
said Bollinger Road with the wes~~ line of the Blaney Road; thence
North and along the west line of that certain 10-acre tract of
land conveyed by J. C. Murphy, e~~ ux, to Albert B. Lamson by deed
dated February 2~-, 1893, and recorded February 2~-, 1893, in
Volume 157 of Deeds, page 120, S~~.nta Clara County Records, and
along the west line of the 10 ac:^e tract of land conveyed by
J. C. Murphy to Peter Engel, Sr.;, by deed dated February 9, 1888,
and recorded February 9, 1888, iti Volume 105 of Deeds, page 1~+9,
Santa Clara County Records; 15.E-t) chains to the point of the
southwesterly line of that certa:Ln 25.61 acre tract of land con-
veyed by Fredericke Ernestina Dorothea Blumcke, a widow, to F. M.
Coleman, by deed dated April 20, 1905, and recorded April 20,
1905, in Volume 29~+ of Deeds, page 60, Santa Clara County Records;
thence along southwesterly line of said 25.61 acre tract North
69° ~Oc West, 7.25 chains to the southwesterly corner of said
25.61 acre tract; thence South 1~~.37 chains to a point on the
northeasterly line of the Bollin€;er Road; thence South 69° ~-Oc
East, and along the northeasterl;,r line of said Bollinger Road
7.2625 chains to the point of beginning, and being a part of the
Northeast 1/~ of Section 2~-, Towziship 7 South, Range 2 West,
M. D. B. & M.
SECTION II. This Ordinance shall take effect and be in
force thirty 30) days after its passage, and before the expiration
of fifteen (15) days from abd after its passage, this Ordinance,
shall be published once with the names of the members voting for
or against the same in the Cupertino Courier, a newspaper
published in said County of Santa Clara.
Introduced at a regular meeting of the City Council of the
City of Cupertino on the 17th day of November, 1958. Passed
and adopted at a regular meeting of the City Council of the City
of Cupertino on the 15th day of December, 1958, by the following
vote:
AYES: Councilmen: Nathanson, Pelosi, Saich, Wilson
NOES: Councilmen: None
ABSENT: Councilmen: Lazaneo
