AN ORDINANCE OF THE CITY OF CUPERTINO ESTABLISHING SPEED LIMITS AND
SAFETY ZONES AT OR NEAR THE NEW CUPERTINO HIGH SCHOOL AND ON MILLER
AVENUE AND STEVENS CREEK BOULEVARD IN THAT VICINITY.
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WHEREAS, the City Council, pursuant to the provisions of
Section 511.3(b) of the Vehicle Code, having determined, upon the
basis of an engineering and traffic investigation, that the prima
facie speed limit of ~+5 miles per hour is more than is reasonable
and safe upon the portion of Stevens Creek Boulevard hereinafter
described (said speed limit of ~5 miles per hour being applicable
at said location under said Code), and that the speed limit herein-
after specified lower than ~-5 miles per hour is appropriate to
facilitate the orderly movement of traffic and is reasonable and
safe thereon, and that such spee~~. limit shall be effective upon the
erection of appropriate signs giving notice thereof; and
WHEREAS, a portable type of traffic control signal to be
installed at the intersection of Miller Avenue and Stevens Creek
Boulevard has been recommended as a safety device in said survey;
and
WHEREAS, said survey has further recommen ded pedestrian cross-
walks on both Miler Avenue and Stevens Creek Boulevard at said
intersection;
NOW, THEREFORE, BE IT ORDAI:~TED:
That rezoning of Stevens Creek Boulevard from ~+5 miles per hour
to 35 miles per hour from the east city limits to 100 yards west
of the Calabazas Creek including both east bound and west bound
traffic be and the same is hereb;~r determined and declared.
BE IT FURTHER ORDAINED:
That a portable type of tra:E'fic control signal shall be installed
at the intersection of Miller A~Jenue and Stevens Creek Boulevard,
the specific details of which sh<~,11 be determined by resolution upon
recommendation of the City Engineer.
BE IT FURTHER ORDAINED:
That yellow crosswalks be p:Laced across Stevens Creek Boulevard
immediately east to the entrance of Miller Avenue and a second
pedestrian crosswalk across Mill~:r Avenue opg~osite the north entrance
to the school parking area; that 4' x ~' w66 signs be posted 100
feet on each side of each of saki crosswalks indicating a school
crossing.
BE IT FURTHER ORDAINED:
That the traffic survey dated September 2~, 1958, and signed by
Captain John Perusina, Commander,, Patrol Division, be, and hereby
is, incorporated by reference in~~o this Ordinance.
BE IT FURTHER ORDAINED:
That this Ordinance shall t~~.ke effect and be in force thirty
30 days after its passage, and before the expiration of fifteen
~15 days from and after its passage, this Ordinance shall be
published once with the names of the members voting for or against
the same, in the Cupertino CouriE~r, a newspaper published in said
County of Santa Clara.
