Subject: Director's Minor Modification (DIR-2009-14) to add an exterior elevator to the
rear of a clubhouse at the Commons of C pertino residential condominium
complex located at 21116 Freedom Drive.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow any
Council member or Planning Commissioner to appeal the decision within
fourteen calendar days.
DISCUSSION:
The applicant, Keith Williams, representing the Commons of Cupertino, is requesting
approval to install an elevator to provide access for the disabled in compliance with the
Americans with Disabilities Act (ADA) requirements.
The project property is located in a P (Res) zoning district, bounded by Memorial Park
to the north and west, near the intersection of North Stelling Road and Alves Drive at
21116 Freedom Drive. The proposed exterior elevator at the rear of the clubhouse will
be minimally visible from street view, and a condition has been added to paint the
elevator to match the clubhouse. Also included in the modification are interior restroom
remodeling for ADA compliance and the replacement of exterior windows (see
Attachment 1). The applicant has obtained approval from the Homeowner Association
(Attachment 2).
ACTION:
The Community Development Director deems the project minor and hereby approves
the modification effective July 14, 2009 with the following condition:
1) The exterior elevator shall be painted to match the clubhouse building.
The fourteen-calendar day appeal period will expire on July 28, 2009.
