The meeting shall be adjourned by midnigh. INFORMAL REVIEW OF PLANNED DEVELOPMENT USE PERMIT APPLICATION: None APPROVAL OF MINUTES: Minutes of Regular Meeting of December 15, 1977 Approval of the minutes was deferred until the arrival of Member Irvine. POSTPONEMENTS: None WRITTEN COMMUNICATIONS: None ORAL COMMUNICATIONS: Mr. Caughey noted that he had an oral communication from the Planning Director which will be taken up at the end of the meeting. PUBLIC HEARING: 1. Application HC -51,442.1 - Dividend Development Corporation requesting approval of site, architecture, landscaping and grading for a mini - storage warehouse complex with caretaker's residence located adjacent to and southerly of 280 Freeway adjacent to Blaney Avenue. Continued from ASAC meeting of December 15, 1977. HC -209 JMINUTES OF THE JANUARY 5, 1978 ASAC MEETING Page 2 Mr. Martin Oakley was present for this application. IMr. Oakley obtained clarification from the Water. District on the amount of dedication on the north side of the development adjacent to the 280 Freeway. The Water District had asked for only 5' of dedication. Dividend is allowing 8'. They will be able to have an overhang and some landscaping within the 3' difference. Also, the Water District has given permission for drainage of the development into the canal. Also, the building on the south side has been shifted to the property line. Mr. Oakley reported that the lender will not allow a wood frame building but has insisted on concrete block. This is not required by the Fire Code according to Mr. Oakley. Staff is concerned about the change in appearance from stucco to concrete block and suggested that all walls adjacent to public thoroughfares be treated with stucco texturing. Applicant objects to this because of the cost. Chairperson Claudy suggested that if the grouting between the blocks was left flush and the walls were painted it would minimize ze thevisualthe block. ,_ l:1C. i impact of file V. Mr. Oakley said that from a distance, this would not look like concrete block. Consensus: Concrete block grouting shall be left flush and should be texture - painted to minimize the block appearance of the buildings. The Applicants have not designated the location of exterior public parking space. Mr. Oakley said there is enough room for a parking space. Chairperson Claudy noted that the location will be per the Traffic Engineer's approval before issuance of a building permit. A ramp for emergency vehicle access has also not been provided. Mr. Oakley said that this point was not discussed in his meeting with the apartment complex owner. Member Bond asked if it is required to be a paved ramp. Mr. Caughey indicated he will research this question with the Central Fire Protection District. Mrs. Dorothy Zeszutek, noted that the owner of the Greenwood Apartments wishes to keep this a private street (Olivewood Dr.), but that residents would have no problem with having emergency access to the mini -storage complex. She noted that there nave been two fires in the apartments and several minor alarms; the fire marshal had told her that the Department would use any means to get to a fire and evacuate residents if necessary. Revised roof line relationship between Building A and the caretaker's residence were shown. The roof will be the same material and style. ;onsensus: Committee Members saw no problem with the roof line relationship. MINUTES OF THE JANUARY 5, 1978 ASAC MEETING Regarding landscaping, it was noted that the proposed landscaping on the apartment complex property by the applicant will not go in because the owner of the complex does not wish additional landscaping on their site. The applicant provided written evidence of this statement. Mrs. Zeszutek noted that there are ill pines along this stretch and 50-60 pyracantha as well. Member Ripplinger noted that there are also spots which are skimpy. Chairperson Claudy commented that any further land- scaping along this stretch would be between the applicant and the owner of the apartment complex. Condition 18 of Planning Commission Resolution No. 1776 requires installa- tion of a hedge on the east slope adjacent to Blaney Avenue overpass. This is City property. The intent of the Planning Commission is to provi< a screen. Mr. Caughey stated that the intent was a physical barrier rathE than a visual screen. Mr. Oakley asked why the developer of the lot shout have to landscape this area if it is only to provide a barrier rather that to hide the development. Member Bond pointed out that this objection shot have been brought up at the Planning Commission level, since the ASAC has no power to overule the Planning Commission's Resolution. The Traffic Engineer has indicated that nothing should be planted on the upper part of the slope since this would interfere with the visibility of motorists trying to see cross -traffic coming south over the overpass. (This point was brought by the Zeszuteks at the last ASAC meeting.) Mr. Zeszutek stated that they had wanted to donate 12 trees along this area several years ago, but the City only allowed 6, of which 4 now remain. He stated that the only way to keep people from trampling planting in this area is to put up a cyclone fence. Chairperson Claudy agreed, since foot and bicycle traffic would not allow plantings to grow to the desired height for screening. Member Sallan commented that the ASAC can make a recommendation as to the kind of planting material that would be desirable on this slope per the Traffic Engineer's recommendation. Chairperson Claudy stated that the ASAC could propose planting of evergreens (Monterey Pines, for example), which would eventually provide a fair amount of screening and accomplish the aims the Planning Commission has in mind (as opposed to a hedge). Member Ripplinger proposed that landscaping be continued until the applicant has had an opportunity to plan his landscaping or go back to the Planning Commission for modification or removal of the Condition. Mr. Caughey stated that since the landscaping ban is still in effect, the applicant could not install landscaping at this time anyway. Therefore, the continuance of this portion of the application would not delay the start of construction. Chairperson Claudy noted that any landscaping installed on the north elevation (along the 280 Freeway) would have to use drip irrigation; he said he would like to see additional shrubs planted besides the trees and vines proposed by the applicant. Consensus - The landscaping portion of this application is continued. HC -209 Page 3 HC -209 Page 4 Approval of Application HC -51,442.1 MINUTES OF THE JANUARY 5, 1978 ASAC MEETING Regarding grading, as was noted earlier in the minutes, the Water District has given permission for drainage of the subject site into the canal. This was the only concern remaining regarding grading. Lighting plan was previously reviewed by the Committee and Committee's recommendation to move security lighting from the south facade of Building A has been complied with. There are no other concerns. The hearing was opened up to the public. Mrs. Zeszutek said that they would like to donate more trees for the east slope. Member Bond suggested that this be worked out with Staff. Since there were no further comments from the audience, Member Bond moved and Member Irvine seconded that the public hearing be closed. That the recommendation of approval is based upon Exhibits A 1st Revision, B 1st Revision, B-1,. C, D 1st Revision and E of this application except as may be amended by special conditions contained herein. 10. Outdoor storage on the subject site of vehicles, boats or personal property shall not be permitted. 11. Final configuration of the emergency access route from Olivewood Avenue shall be subject to staff review at the building permit level. 12. Exhibits B 1st Revision and B-1 shall be revised at the building permit level to include block walls with flat grouting technique and painted to resemble stucco as closely as possible on all walls which are adjacent to public or private thoroughfares. 13. Final arrangement of plantings on the fill slope adjoining the east edge of Blaney Avenue, as required by Condition 18 of Planning Commission Resolution No. 1776, shall be subject to staff approval at the building permit level. 14. The development lighting plan shall be revised at the building permit level to eliminate fixtures on the south elevation of Building A. Staff shall have authority to review exterior lighting following occupancy of the complex, and to require satisfactory correction of any off -site lighting intrusion problems. 15. Prior to issuance of building permits, the applicants shall obtain ASAC approval of a comprehensive sign program for the subject development. MINUTES OF THE JANUARY 5, 1978 ASAC MEETING 16. Additional planting of shrubs in the 3' area adjacent to the 280 Freeway shall be subject to staff approval. 17. Staff shall approve the location of one parking space on the site. 18. The applicant shall present evidence that the Water District has approved the construction of a direct storm discharge outfall. Member Sallan seconded the motion. Motion carried, 5-0 2. Application HC -51,385.2 - Cupertino Gardens Patio Homes requesting approval of perimeter fencing for the north property line of a residential cluster development located at the northwest corner of Homestead Road and North De Anza Boulevard. Ms. Joy Jones was present as representative for the applicant. The north property line is adjacent to Sunnyvale. Staff suggests a requirement that the top of the wall height be equal at the northeast c post of Lot 54, and that the appearance of rear yard fencing would be iml by the addition of one precast panel section which would allow better visual continuity in that nearly the entire north property line of Lot 54 would have one consistent style of fencing. A retaining wall will be built in some areas so that drainage will be into the project rather than into Sunnyvale. The easement currently thei is now not needed. Since there were several members of the audience present for this applica tion, Chairperson Claudy opened the hearing to the public at this time. Mr. Larry Irvine, Vice -President of the homeowners association for the development on the Sunnyvale side of the proposed development raised an objection to the height of the fence, which would be 8' (2' of retaining wall and 6' of fence) for some of the Sunnyvale residents. He stated tha such a structure would be hazardous to Sunnyvale residents since it would 1) present a fire hazard by blocking escape from the back yards of the present residences, 2)the distance from the units would be very small, which would mean that residents along the boundary would be looking at an 8' concrete structure. Mr. Irvine stated that the structure should be no higher than the present fence and that it be made of wood. Chairperson Claudy responded that the only lot that would have concrete for the entire wall would be lot 54. This would be a sound wall. The concrete retaining wall would be only 2' high and the rest of the height would be made up of a grapestake fence, which would be wooden. The retaining wall is to achieve drainage away from the Sunnyvale properties. HC -209 Page 5 �rner �'oved HC -209 j MINUTES OF THE JANUARY 5, 1978 ASAC MEETING Page 6 Mr. Jay Tucker, another Sunnyvale resident affected by the development, noted that there has been soil added to the Cupertino property, but only about two feet. Mr. Harold Smith, who stated he is on the Board of Directors of the Homeowner's Association, said that the mansard roofs extend out around 4' which would surface drain out to the road. He also stated that the living areas of the units are in the back; if there were a fire, residents in the living area would not be able to get out the front of their homes, and would have great difficulty getting over an 8' fence. Mr. L. Richey said that his concern is about drainage. He would rather see a high wall, since two story buildings on the Cupertino side will block the view anyway. Chairperson Claudy noted that Mr. Richey's property would have only a 6' wall. The proposed development will have storm drains. Mark Caughey stated that one reason for the high fence was that since the Cupertino property is higher than the Sunnyvale property, Cupertinians could look over their back fences right into the Sunnyvale back yards unless there were a high fence. Mr. Irvine said that he does not see any problem with a shorter fence because people can look down into the Sunnyvale yards from the second story windows anyway. His concern is with the fire hazard. He stated that the majority of the homeowners present at a meeting a couple of months ago disagree with the height of the proposed fence. He feels that there should be a common fence that is maintainable and of an agreeable height to both sides. Ms. Jones stated that the people in the Cupertino project would have a 6' wall on the Cupertino side. The reason that a separate wall will be put up on the Cupertino property without disturbing the present wood fence on the property line is so that patios which are attached to the walls will not be disturbed or damaged. ,Mr. Smith commented that he spoke to Sunnyvale Public Safety and they commented that information about the high wall proposed has been (or will be ) transmitted to the fire department, so that they know to come around the back of the units in case people are trapped in back yards. Member Bond moved and Member Sallan seconded that the public hearing be closed. Motion carried, 5-0 Staff suggested that continuation of texture on the north flank of the retaining wall be achieved to enhance its appearance from adjoining Sunnyvale condominiums, even though there would be a fence in front of it. Ms. Jones said that this may prove difficult. Approval o Member Ripplinger moved the approval of Application HC -51,385.2 subject to Application the standard ASAC conditions 1-8 and conditions 9-13 as follows: HC -51,385.2 MINUTES OF THE JANUARY 5, 1978 ASAC MEETING 9. That the recommendation of approval is based upon Exhibit G of this application except as may be amended by special conditions contained herein. 10. The applicants shall construct the proposed grapestake fence sections as depicted on Exhibit G; the proposed "alternative fence at north property line" depicted on Exhibit G is not approved. 11. The proposed texture treatment for retaining wall sections shall be applied to both sides of the wall, subject to staff approval. 12. Exhibit G shall be revised at the building permit level to require installation of three 8 ft. precast sound wall sections along the north property line of Lot 54. Top of wall elevations shall be equal at the northeast corner of Lot 54. 13. Grade breaks of 6 inches maximum or less shall be permitted between adjoining individual fence or precast wall sections. HC -209 Page 7 Member Bond seconded the motion. Chairperson Claudy informed the audienc I that the ASAC decision is not final and that this application will go bet1ore the City Council on January 16, 1978. Motion carried, 5-0 The Committee recessed at 8:49 p.m. and reconvened at 9:02. 3. Application HC -51,312.2 - Jon M. and Carol K. Garliepp requesting approval of grading for a single-family residence located in Re gn art Canyon. Mr. Jon Garliepp was present. He stated that he is trying to keep the contour of the hill rather than having a severe drop. Member Irvine noted that once the grading is done, it will look very natural since the differences would be "feathered" out. Member Ripplinger moved and Member Irvine seconded that public hearing be closed since there was no comment from the audience. Motion carried, 5-0 Mr. Caughey stated that Public Works would like to have one additional section drawing through the pool and details of offsite drainage. Member Irvine moved that Application HC -51,312.2 be approved subject to Approval of the standard ASAC conditions 1-8 and conditions 9 and 10 as follows: Application HC -51,312 .2 9. That the recommendation of approval is based upon Exhibits C and D of this application except as may be amended by special conditions contained herein. The subject grading plan is approved in concept; final approval of on -site grading work shall be subject to staff approval prior to issuance of a grading permit. Staff may refer any significant revisions to the conceptual grading plan to the ASAC for review prior to issuance of a grading permit. Member Sallan seconded the motion. Motion carried, 5-0 This application will go to the City Council on January 16, 1978. 4. Application HC -51,075.152 - Vallco Park, Ltd. (Montessori School) requesting approval of site and architecture for a pre-school located adjacent to and southerly of Pruneridge Avenue approximately 1,100 ft. easterly of Wolfe Road. Mr. Bill Tagg was present as the applicant. The school has a temporary use permit. Because it is a preschool, it is required that there be 1 toilet for every 10 children. The applicant proposes to install portable toilets at the site. They will be regular flush toilets and in a wooden stud building with wood underneath. They will be accessable both from the inside of the building and from the outside. The principal staff concern is the placement of the westernmost unit. This would require removal of a tree approximately 14'to 15' tall. Mr. Tagg said that the tree could probably be moved safely. Moving of trees in Vallco Fashion Park has had good success. Since there were no comments from the audience, Member Bond moved and Member Irvine seconded that the public hearing be closed. Motion carried, 5-0 Member Sallan moved that Application HC -51,075.152 be approved subject to the Standard ASAC conditions 1-8 and conditions 9-11 as follows: 9. The recommendation of approval is based on Exhibits A, B, B-1 of this application except as may be amended by special conditions contained herein. 10. The existing conifer specimen which is within the proposed location for the westernmost facility shall be moved to an alternative location on the site subject to staff approval. 11. Prior to issuance of permits to effect the subject improvements, the applicants shall provide written documentation acceptable to staff detailing steps to be taken to ensure maximum chance of survival for the relocated conifer referred to in Condition 10 above; MINUTES OF THE JANUARY 5, 1978 ASAC MEETING illustrating measures to be taken to protect on -site landscaping which might be damaged during move -on of the portable facilities, and delineating final shape of lawn area contours affected by installation of the portable equipment. Member Bond seconded the motion. Motion carried, 5-0 5. Application HC -51,075.443 - Vallco Park. Ltd. (Tennis Center)reques approval of a sign program for a commercial tennis facility located the west end of Pruneridge Avenue. Mr. Bill Tagg was present for this application also. The proposed sign program provides one wall sign on the east elevation of the structure facing Wolfe Road. The size is within dimension limits. The letters are individual cans similar to those of "Wallbangers". The Committee had no concerns with the sign. Chairperson Claudy asked how thick the screening on the courts would be. Mr. Tagg did not know. Since there were no comments from the audience, Member Bond moved and Member Irvine seconded that the public hearing be closed. Motion carried, 5-0 Member Sallan moved that Application HC -51,075.443 be approved subject to Standard ASAC conditions 1-8 and conditions 9 and 10 as follows: 9. The recommendation of approval is based on Exhibits F and F-1 of this application except as may be amended by special conditions contained herein. 10. The Architectural and Site Approval Committee or its staff shall retain authority to review lighting intensity for any sign approved under this application, as provided in Section 7.07, Ordinance 746. Member Ripplinger seconded the motion. Motion carried, 5-0 NOTE: Member Irvine stepped down from the Committee for discussion of the next two applications (HC -51,421.1 and HC -51,450.1). 6. Application HC -51,421.1 - Pacific Valley Bank requesting approval of exterior lighting for a bank parking lot located at the northeasterly quadrant of North De Anza Boulevard and Stevens Creek Boulevard. Mr. Phil Boyce, President of Pacific Valley Bank was present for this application. HC -209 Page 9 Approval of Application 51,075.443 HC -209 ! MINUTES OF THE JANUARY 5, 1978 ASAC MEETING Page 10 Mr. Bovice reported that the bank will install the energy saver time and temperature sign. This will be the first of its kind on the West Coast. The only staff concern is about the style of the lamps in the parking lot. Staff feels that the proposed antique metal lamp style is not sympathetic to the contemporary lines and strong emphasis on exterior woods of the approved bank building. They encourage a more modern approach and presented an example of an acceptable fixture. Staff was also concerned about the use of a "pedestal -type" fixture. Mr. Boyce stated that there is no concrete base on these fixtures and they will be in the planter areas. The aluminum would be painted a darker color to blend with the exterior of the bank. He pointed out that the bank building, although modern, also has traditional lines. The windows have small panes and are anodized and the skylights are flush with the roof. The building has a 40% coverage with brick finish. The proposed light fixtures are a combination of modern and traditional styles and would blend in well. They are similar to light fixtures at Bruener's near Hamilton and Bascom. Mr. Boyce also pointed out that the Baer property next door will be renovated into a turn -of -the -century building. More traditional lamps would tie in with this development. Only one lamp will be visible from the street. Member Ripplinger asked what the color of the globe is. Mr. Boyce re- sponded that he is not sure, but probably a frosted white globe. He reaffirmed that he does not want the fixtures to stand out and the color would not be overly bright. Member Sallan expressed concern with the shape of the globe. She feels the circle of the globe would stand out and detract from the building. She agrees with a more traditional style, however. Chairperson Claudy commented that his personal taste runs to contemporary styling and that he agrees with Member Sallan's concern about the shape of the fixture. Mr. Boyce said that if possible, he will try to get another shaped globe, but asked for approval of the application this evening so that the bank could open with some sort of lighting in the parking lot. The globes would go up, but if another style can be found, they will be substituted at a later date. Member Sallan noted that a traditional style would fit in with the Baer property and suggested that perhaps an agreement as to a certain fixture could be reached with the Baer property owners. The hearing was opened to the public. Mr. Dunckley Murray, landscape architect for the Baer property, stated that they would like to review the lighting situation. They do not wish to be locked into a certain fixture. Since there were no further comments from the audience, Member Ripplinger moved and Member Bond seconded that public hearing be closed. Motion carried 4-0 Member Irvine absent MINUTES OF THE JANUARY 5, 1978 ASAC MEETING Member Ripplinger felt the application should be continued until the next meeting so that the owners of the Baer property could establish their lighting needs. Mr. Boyce said that his building will open in less than 30 days and lighting needs to be installed before that time. The second phase of the Pacific Valley Bank development will come up at a later date. He would be happy to work with the Baer property owners re- garding lighting needs at that time. Mr. Boyce feels he should not have to wait for the owners of the neighboring property to make up their minds about lighting. Chairperson Claudy commented that the Pacific Valley Bank application has been in the works for a long time, that the Committee has seen the Baer application only once in informal review, and that Mr. Boyce should not have to be liable for the Baer property lighting. He further stated that Pacific Valley Bank has been willing to negotiate and fees that if Mr. Bo, can find another shape for his fixtures, he will do so. Member Sallan moved that Application HC -51,421.1 be approved subject to the Standard ASAC conditions 1-8 and conditions 9-12 as follows: 9. That the recommendation for approval is based on Exhibits A and G of this application except as may be amended by special conditions contained herein. 10. That the applicant is to make a serious effort to obtain a different shaped lamp globe for the parking lot fixtures, subject to staff appro 11. That the color of the pedestals should be compatible with the color of the building subject to staff approval. 12. The Architectural and Site Approval Committee reserves the right to review lighting intensity of the fixtures approved under this applica- tion. The motion was seconded by Member Ripplinger. Motion carried 3-0 Roll call vote was as follows: Ayes - Ripplinger, Sallan, Claudy Nays - None Abstaining - Bond Absent - Irvine Mr. Boyce asked if there is a policy about painting PG&E boxes. He would like to paint the box outside the bank a color which would blend with the building. He asked if the City has any say in the matter. PG&E informed him that he could not paint the box. Application HC -51,450.1 - Marlene Sulaver & `Marilyn Hiatt (Baer House) requesting approval of site, architecture, landscaping and grading for renovation of a historically significant single—family structure to commercial/office usage located approximately 150 ft. easterly of the intersection of Stevens Creek Boulevard and North De Anza Boulevard. Mr. Dunckley Murray was present for this application. Site The applicants will provide tree protection around existing trees which would be 4' from the outside of the trunks during renovation. Mr. Murray presented a letter from the Davis Tree Service dated January 3, 1978 stating that both palm trees within public right of way in front of the Baer House are suffering from the drought. The tree service would not bid on relocating the trees since they are old and may not survive a move. Davis Tree Service also recommended that the 24" pine tree be removed because of its diseased condition and the probability that it will not recover. Architecture Staff's concern is with the proposed roofing material, which will be asphalt. Since the historic integrity of the house is to be preserved, Staff suggests that new shingles should have a "weathered" appearance when installed. Mrs. Sulaver stated that the building department requires asphalt or sprinklers. Member Bond pointed out that the house has not been officially declared a historical landmark. The Planning Commission did not require authentic reproduction of the original building, but the ASAC can do so. Member Sallan asked if any information were available as to when the house was built. Mr. Murray said that he was not sure of an exact date but it is somewhere around the turn of the century and was built by Mr. Parrish. Member Sallan asked that more research be done regarding possible roofing materials that would more closely resemble the original materials. Mr. Murray said that the owners are anxious to get going on the project and feel that as long as the roofing material blends in, it should be approved even though it would not be the original material. Member Bond commented that the applicants should not be required to reproduce the original roofing since the property is not a. defined historical site. Mark Caughey pointed out that combination shake/shingle roofs have been required on past applications. Mr. Boyce commented that the historical character of the house should be preserved and that new shingles would look incompatible with this. Mr. Boyce made a suggestion that the handicap ramp in the rear of the house be veneered with brick or some other surfacing which would blend it in better. Mr. Murray agreed with this. rnncancua - The proposed roofing will be approved with the stipulation that the applicant make a serious effort to find a more appropriate material. MINUTES OF THE JANUARY 5, 1978 ASAC MEETING Landscaping CnnsenCnS - Since feasibility of relocating the two palm trees without killing them is small, the trees should be removed completely. Staff suggested that applicants may wish to consider gentle mounding in the 20 ft. front setback. Canspn�>>� - Members agreed that because of the attractiveness of the building, mounding should not be required. Grading - No problems. Lighting Lighting was not proposed at this time, but it was noted that some degree of compatibility with that of Pacific Valley Bank next door should be achieved. Signing HC -209 Page 13 Signing was not proposed at this time. However, the applicant requested that the Committee consider an exception to the requirements for a ground sign. Member Sallan commented that she would rather see something which tried to meet the ordinance first before considering an exception. Mr. Murray said that an effort will be made to find a way to comply with the ordinance] and have an attractive sign that will not detract from the house. The hearing was opened to the public. Mr. Boyce asked if there is any fencing proposed. Mr. Murray replied that some fencing exists and there are no plans to take it out at the present time. Fencing can be worked out with Pacific Valley Bank at a later date. That the recommendation of approval is based upon Exhibits A, B, C, and D of this application except as may be amended by special conditions contained herein. 10. Exhibit C of this application shall be revised prior to issuance of building permits to provide minimum five gallon size shrubs in planting areas adjacent to Stevens Creek Boulevard, and to provide a planter strip on the east property line of the parking area subject to staff approval. 11. He reported that he has not followed through on the De Anza Racquet Club screening which Chairperson Claudy brought up at the last meeting_ Member Ripplinger noted that the permanent sign is still not up at Any Mountain and the parking lot has still not been developed. The landscaping has not been started. Mr. Caughey noted that they are delaying until the rain lets up. Mr. Caughey reported that Vallco Park plans. to modify their "travelling message" si at the Vallco Village Shopping Center and have flashing messages instead. The, .e obtaining their own message maker rather than buying pre-programmed circuits, which will allow them greater control. There has been a request by Vallco Park to the City to lift the landscaping moratorium; this request will be discussed at City Council on Jan. 9, 1978. Consensus - Members agreed that lifting of the landscaping moratorium would be a pre -mature action and it should be extended for at least 3 more months. Member Sallan noted that she would support a statement to the City Council to the effect that City landscaping use the drip emitter system.
