Ordinance 56ORDINANCE N0. 56 AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1 OF ORDINANCE N0. 2 BY RECLASSIFYING A CERTAIN PORTION OF THE CITY OF CUPERTINO FROM AN R-1:B-2 DISTRICT TO AN R-1-H DISTRICT. THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS: WHEREAS, on June 20, 1958, an application was filed by Oliver Rousseau for the rezoning of property from an R-l:B-2 District to an R-1-H District; and WHEREAS, upon due notice and after two public hearings the Planning Commission recommended to the City Council that the reclassification be granted; and WHEREAS, the property to be rezoned is presently in an R-l:B-2 District; and WHEREAS, a map of the subject property is attached hereto as Exhibit "A'~ as a proposed amendment to the Master Zoning Map of the City of Cupertino; NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS: Section I. That the following described property, be and hereby is zoned to R-1-H classification ar~7. that Exhibit "A" attached hereto is made part of the Master Zoning Map of the City of Cupertino: All that certain real property situate in the City of Cupertino, County of Santa Clara, State of California, described as follows: BEGINNING at a point in the centerline of Stevens Creek Road said point being distant S 89°36' w 33~-.03 feet from a pipe dri ven in the centerline of Stevens Creek Road at the Northeast corner of Lot 3 as said Lot is shown and delineated upon Map entitled "Map of the Craft Estate Partition" and which map was filed March 1g, 1906 in the office of the County Recorder of the County of Santa Clara, State of California in Vol. "L" of Maps, Page 28, running thence along the centerline of Stevens Creek Road and the North line of said Lot, 3, S 8g° 361 W.565.88 feet to an iron pin in the centerline of said Stevens Creek Road standing at the Northeasterly corner of the 8.696 acre tract conveyed by Romilda Perinoni and Edward Perinoni, her husband to A. L. Townar by deed dated June 10, 1916 and recorded June 10, 1816 in Book 443 of Deeds, Page 304 thence along the Easterly line of said 9.696 acre tract S 0° 24' E 300.00 feet to the TRUE POINT OF BEGINNING; thence continuing along said Easterly line S. 0° 24' E. 131.97 feet; thence along the Southeasterly line of said 9.696 acre tract the following courses and distances, S 89° 371 W 135.80 feet to a stake marked P. T. 2 and 3~4" iron pipe and South 17° 39' West 1434.14 feet to the Southerly line of laid Lot 3; thence along the Southerly line of said Lot 3 South 80 55' E. 548.46 feet to the southwest corner of the 0.328 acre parcel of land conveyed by Romilda Perinoni and Edward Perinoni, her husband to Giovanni B. Adamo and Elida Adamo, his wife, by Deed dated July 30, 1923, and recorded March 14, 1924, in Book 76 official Records, page 297, thence North 17° 451 East along the Westerly line of said 0.328 acre tract and the Westerly line of that particular tract of land conveyed by Romilda Perinoni and Edward Perinoni, her husband to Giovanni B. Adamo and Elida Adamo, his wife, by deed dated July 14, 1922 in Book 557 of Deeds, Page 415, 1672 feet more or less to a point distant 300.00 feet measured at right angles from the said centerline of Stevens Creek Rgad, thence Westerly and parallel with said centerline South 89 36' West 468 feet more or less to the point of beginning. Containing 19.86 acres of land more or less and being a portion of Lot 3 of the Craft Estate Partition as hereinabove referred to. SECTION II. This Ordinance shall take effect and be in force thirty (~;0) days after its passage, and before the expiration of fifteen (15) days from and after its passage, this Ordinance shall be published once with the names of the members voting for o r against the same in the Cupertino Courier, a newspaper published ir.~ said County of Santa Clara.
