AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1 OF
ORDINANCE N0. 2 BY RECLASSIFYING A CERTAIN PORTION OF THE CITY OF
CUPERTINO FROM AN R-1:B-2 DISTRICT TO A C-1-H DISTRICT.
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS
FOLLOWS:
WHEREAS, on March 10, 1958, an application was filed by Pauling
Woodruff & Warner Wilson for the rezoning of property from an
R-l:B-2 District to a C-1-H District; and
WHEREAS, upon due notice and after two public hearings the
Planning Commission recommended to the City Council that the reclass-
ificatinn be granted; and
WHEREAS, the property to be rezoned is presently in an R-l:B-2
District; and
WHEREAS, a map of the subject property is attached hereto as
Exhibit "A" as a proposed amendment to the Master Zoning Map of the
City of Cupertino;
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the following described property, not already
zoned C-1-H, be and hereby is zoned to C-1-H
classification and that Exhibit "A" attached hereto is made part of
the Master Zoning Map of the City of Cupertino:
All that certain real property situate in the City of Cupertino,
County of Santa Clara, State of California, described as follows:
BEGINNING at the point of intersection of the Westerly line of
Saratoga-Sunnyvale Road, formerly Saratoga-Mountain View Road, as
said line was established in the Deed from Union Church of Cum rtino,
a corporation to the State of California, dated November 7, 1955
recorded March 21, 1956 in Book 3~+~+~+ Official Records, page 288,
Santa Clara County Records, with the Southerly line of that certain
parcel of land described in the Deed from Board of Church Extension
of the United Presbyterian Church of North America, a cor oration to
Cupertino Union Parish, a corporation, dated June 30, 188, recorded
August 22, 1888 in Book-106 of Deeds, page 600, Santa Clara County
Records; thence from said point of beginning Westerly along said
Southerly line and its Westerly prolongation 20,00 feet to the
Northwesterly corner of that certain 0.10 acre tract of land described
in the Deed from Archibald Wilson, et ux to Roy Larson, et al,
Trustees of Cupertino Lodge No, 70 Independent Order of Odd Fellows
and their successors in office, dated September 30, 1952, recorded
September 30, 1952 in Book 2+96 Official Records, page 535, Santa
Clara County Records; thence Southerly along the Westerly line of said
0,10 acre tract 101.11 feet to the Southwesterly corner thereof on the
Easterly prolongation of a Northerly line of "Tract No. 661 Town and
Country Homesites", a Map of which was filed for record in the office
of the Recorder of the County of Santa Clara, State of California, on
October ?~-, 19+9 in Book 24 of Maps, at pages 3~- and 35; thence
South 89 ~-~-' West along said prolongation and along said Northerly
line 1103.21 feet to the Northwesterly corner of said Tract No. 661
on the Easterly line of that certain tract of land described in the
Deed from Alexander Montgomery, et ux, to 0. W, Grove, dated April 1,
190, recorded April 4, 190- in Book 277 of Deeds, page ~-~+8, Santa
Clara County Records; thence North 0° 05' West along said last named
line 23.E-3 feet to the Southeasterly corner of that certain tract of
land described in the Deed fro m 0. W. Grove to Alex Montgomery, dated
February 13, 1915, recorded February 18, lgl5 in Book x-29 of Deeds,
page 1~, Santa Clara County Records; thence West along the Southerly
line of land so described in the Deed to said Montgomery 288.8+ feet
to the Southeasterly corner of that certain tract of land described
in the Deed from Archibald Wilson, et ux, to the Union Church of
Cupertino, a corporation, dated August 6, 1956, recorded August 10,
1956 in Book 3574 Official Records, page 573, Santa Clara County
Records; thence along the genera=_ Easterly boundary of land so des-
cribed in the Deed to said Union Church of Cupertino far the three
following courses and distances: North 0° 02' East 224.84 feet, West
302.00 feet and North 0° 02' Easf; 200.00 feet to a Northeasterly corner
thereof on the Southerly line of Stevens Creek Road, as the same now
exists, 90.00 feet in width; thence East along said 1outherly line
of Stevens Creek Road 1866.90 feE~t to the Westernmost corner of that
certain tract of land described in the Deed from Archibald Wilson,
et ux to the State of California, dated October 26, 1955; recorded
May 22, 1956 in Book 3501 of Official Records, page 482, Santa
Clara County Records; thence along the general Westerly boundary of
land so described in the Deed to said State of California on the
arc of a curve to the right, tangent to the preceding course, with
a radius of 30.00 feet, through ~, central angle of 90°, for an arc
distance of 47.12 feet; thence continuing along said general Wester-
ly line South 52.81 feet to the ~~outhwesterly corner thereof on
the Northerly line of that certain 0.14 acre tract of land described
in the Deed from Archibald Wilson, et ux to Pete Zarko, et ux,
dated August 15, 1939, recorded P.ugust 17, 1939 in Book 945 Official
Records, page 199, Santa Clara County Records; thence Westerly along
said last named line 119.00 feet to the Northwesterl y corner of said
0.14 acre tract; thence Southerl~~ along the Westerly line of said
0.14 acre tract 50.00 feet to thE~ Southwesterly corner thereof;
thence Easterly along the Southerly line of saki. 0.14 acre tract
119.00 feet to the point of intersection thereof with said Westerly
line of Saratoga-Sunnyvale Road; thence Southerly along said Wester-
ly line of Saratoga-Sunnyvale Ro~.d 209.00 feet to the point of
beginning and being a portion of the North 1~2 of the Southwest 1/4
of Section 13, Township 7 South, Range 2 West, MDB&M.
Section 2. This Ordinance shall take effect and be in force
thirty (30) days after its passage, and before
the expi ration of fifteen (15) days from and after its passage,
this Ordinance shall be published. once with the names of the mem-
bers voting for or against the same in the Cupertino Courier, a
newspaper published in said County of Santa Clara.
Introduced at a regular meeting of the City Council of the
City of Cupertino on the 19th day of May, 1958. Passed and adopted
at a regular meeting of the City Council of the City of Cupertino
on the 2nd day of June, 1958, by the following vote:
