Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow any Council member or Planning Commissioner to appeal the decision within fourteen calendar days. DISCUSSION: The project property is located in a P (Res) zoning district located at 10115 Congress Place. In 1974, the City Council approved the use permit for the development of the Commons. The proposed conversion is contained within the footprint of the existing house and proposes minimal alternations to the exterior (see Attachment 1). Since no windows are being added, the project is not subject to any privacy protection requirements. The applicant has obtained approval from the Homeowner Association (Attachment 2). ACTION: The Community Development Director deems the project minor and hereby approves the modification effective June 11, 2009. The fourteen-calendar day appeal period will expire on July 10, 2009. Other modifications you have planned for your property and discussed with the Architectural Committee fall into "interior" rather than "exterior" changes and therefore are not under the architectural control of the association. The association's approval was for the skylights because they are an exterior item. Since there were no other exterior modifications described in your application and the other contemplated modifications are interior as we understand them, the association has no objection.
