RESOLUTION NO. 810
OF THE ARCHITECTURAL AND SITE APPROVAL COMMITTEE
OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL
OF ARCHITECTURE FOR THE "B" MALL SHOPS AS A
PORTION OF THE ORCHARD VALLEY MARKET PLACE DEVELOPMENT
PROPERTY OWNER: Terranomics Development Corporation

FINDINGS:
The Architectural and Site Approval Committee finds as follows with respect
to this application:
1. That the proposed development is consistent with the architectural
theme of the shopping center of which it is a part, subject to
conditions and controls contained, in this Resolution.
CONDITIONS OF APPROVAL:
1-8. Architectural and Site Approval Standard Conditions to the extent
that they do not conflict with the special conditions enumerated
herein. In the event a conflict does exist, the special conditions
as enumerated herein shall apply.
9. The recommendation of approval is based on Exhibits A, A-1, and B
of this application, except as may be amended by special conditions
contained herein.
10. Prior to release of development permits for this subject structure,
the applicant shall submit to staff a letter by an acoustical con-
sultant, addressing the noise impacts associated with the "B" Shops
truck loading area, especially any impacts therefrom on nearby
residential properties, and detailing noise control measures which
may be required to mitigate such impacts.
11. In recognizing that the west -most tenant in the "B" Shops structure
contemplates engaging in outdoor display and/or sale of merchandise,
the ASAC shall retain authority to review such activity and make
appropriate recommendations to City Council regarding corrective
action, to be certain that the public safety is not impaired by
cluttering of walkways, litter, etc. , and that the aesthetic
harmony of the Center's exterior appearance is not compromised by
said outdoor retailing activity.
12. Signing for "B" Shop's tenants shall be subject to the minor
tenant sign program criteria specified in Resolution 800 of the
Architectural and Site Approval Committee.

of the Architectural and Site Approval Committee of the City of Cuper-
tino, State of California, by the following roll call vote:
