Action
The Design Review Committee approved the application on a 2-0 vote. This is
effective May 18, 2006. The fourteen-calendar day appeal will expire on June 2,
2006.

PROJECT DESCRIPTION: Architectural and Site approval to increase the height of the
canopy fascia from 25 inches to 48 inches and sign exceptions for two signs to exceed
the maximum allowed sign height and for two additional walls signs at an existing
service station.
RECOMMENDATION:
Staff recommends:
1) Denial of ASA-2006-08, based on the model resolution, and
2) Approval of EXC-2006-05 as modified, based on the model resolution.
BACKGROUND:
On May 8, 2006, the applicant obtained a Director's Minor Modification (DIR-2006-I4)
for minor exterior color and sign changes (Exhibit A) to the subject gas station. The
scope of the minor modification approval included exterior color/striping changes to
the existing canopy, new non-illuminated canopy logos and walI! ground sign
replacements. The director's approval did not include the increase of the canopy fascia
from 25 inches to 48 inches as shown on the plans.
The applicant, Sal Pablo (Sign Development Inc.), requests the following:
1. Increase the height of the canopy fascia (25 inches to 48 inches)
2. Exception to allow two signs to exceed 18 inches in height
3. Exception to allow two additional wall signs
DISCUSSION:
Canopy Fascia
As it exists, the gas station canopy is attached to the service building and shares the
same slope tile roof design with a 25-inch fascia board all around (see photo below).
The applicant proposes to increase the canopy fascia to 48 inches in order to facilitate
the new larger illuminated canopy logos and also the new color bands (see illustration
below).

SOUTH CANOPY ELEVATION
The proposed 48-inch fascia (sign band) acts like a parapet wall that screens the existing
sloped roof. As a result, the canopy roof is visually transformed into a flat roof design
that is inconsistent with the rest of the roof structure above the service station and
adjacent buildings (see below picture of adjacent commercial building).

Staff recommends denial of the request to increase the existing canopy fascia height for
the above stated reasons.
Number of Wall Signs
According to the City's Sign Ordinance (17.24.060), each commercial business with
exterior frontage shall be permitted one wall sign. A second wall sign is permitted
provided that one of the following conditions is satisfied:
1. For businesses which do not have a ground sign and the business is adjacent to
more than one street; or
2
2. The sign is directed to the interior of the project and not visible from a public
right-of-way.
Neither condition is applicable to the gas station since there is a monument sign and all
of the proposed signs will be publicly visible. The applicant is proposing two circular
wall signs on the gas station canopy facing the northbound and southbound traffic on
De Anza Blvd. In addition, a food mart/ auto center sign is proposed on the service
building facing east. Staff supports the exception to allow two additional signs on the
gas station canopy in order to provide reasonable sign visibility to both the public from
both directions on De Anza Blvd. All of the signs proposed are within the required
sign width and area.
Wall Sign Height
According to the Sign Ordinance Section 17.24.060, wall signs shall not exceed 18 inches
if the setback from the property line is 50 feet or less. The two circular 76 signs located
on the gas station canopy (setback approximately 30 feet) are proposed at 45 inches in
height. Staff recommends that these two signs be reduced to be no more than 24 inches
in height in order to be more proportional with the existing canopy sign band and
provide better visibility for a gasoline station that is partially obscured by mature offsite
landscaping on the adjacent property and in the street median.
Findin~s for Exception
Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant
an exception based upon the following findings:
A. Literal Enforcement of the Sign Regulations are Inconsistent with Spirit and Intent of Sign
Ordinance
The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of
signs as they relate to building design" and to "promote attractive and effective signs."
Due to the gas station canopy orientation, additional wall signs are necessary in order
to provide effective and visible signs from De' Anza Blvd. In addition, the proposed
signs (with the staff suggested height reduction) are architecturally compatible with the
existing building and canopy provided that the existing canopy fascia is not increased
in height.
B. The granting of tIre exception will not result in a condition which is materially detrimental to
the public health, safety, or welfare
The additional signage and taller sign heights will not be detrimental to the public
health, safety, or welfare.
C. Least Modification and Minimum Variance to Accomplish Purpose
The proposed signage shall be consistent with the sign ordinance in terms of total size.
The exception requested is to allow two additional wall signs on the gas station canopy.

In addition, the exception allows the two canopy signs to exceed the maximum sign
height to improve sign visibility on a site obscured by mature landscaping.
Staff therefore recommends approval of the sign exception per the model resolution.

WHEREAS, the Design Review Committee of the City of Cupertino received an

compatible with the surrounding area;

The two 76 circular canopy signs shall be limited to a maximum height of 24 feet.
4. REVISED SIGN PLAN
The revised sign plan shall be submitted and approved by the Planning
Department prior to issuance of building permits.
5. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant
to Government Code Section 66020(d) (1), these Conditions constitute written
notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that
the 90-day approval period in which you may protest these fees, dedications,

Director's Minor Modification DIR-2006-14 for minor exterior changes to
signs, canopies and building elevations at an existing gasoline station located
at 10625 N. De Anza Boulevard
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
DISCUSSION:
The applicant proposes to: 1) repaint an existing canopy and add canopy logo signs, 2)
replace existing building and ground signs, and 3) repaint an existing building as part
of a new corporate image. The repainting and replacement building signage will not
significantly change the overall appearance of the facility. The two new logo signs on
the two canopies are non-illuminated and less than four square feet in area and are
exempted by the City sign code.
ACTION:
The Director of Community Development deems the modification minor and approves
the canopy and building repainting, and the sign changes with the following
conditions:
1. The approval is based on the attached plan set titled: "10625 N. De Anza Blvd.,
Cupertino, CA, Sign Development Inc." consisting of 9 sheets dated 4/12/06,
except as may be amended by the conditions contained hereafter in this
approval.
2. The background of the ground sign shall be opaque (non-illuminated).

Director's Minor Modification DIR-2006-14 for minor exterior changes to
signs, canopies and building elevations at an existing gasoline station located
at 10625 N. De Anza Boulevard
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
DISCUSSION:
The applicant proposes to: 1) repaint an existing canopy and add canopy logo signs, 2)
replace existing building and ground signs, and 3) repaint an existing building as part
of a new corporate image. The repainting and replacement building signage will not
significantIy change the overall appearance of the facility. The two new logo signs on
the two canopies are non-illuminated and less than four square feet in area and are
exempted by the City sign code.
ACTION:
The Director of Community Development deems the modification minor and approves
the canopy and building repainting, and the sign changes with the following
conditions:
1. The approval is based on the attached plan set titIed: "10625 N. De Anza Blvd.,
Cupertino, CA, Sign Development Inc." consisting of 9 sheets dated 4/12/06,
except as may be amended by the conditions contained hereafter in this
approval.
2. The background of the ground sign shall be opaque (non-illuminated).

This approval of the modification is effective May 8, 2006. The fourteen calendar day
appeal period will expire on May 14, 2006.

SECTION II: FINDINGS
WHEREAS, the Design Review Committee of the City of Cupertino received an
application for a Sign Exception, as described in this Resolution; and
WHEREAS, the Design Review Committee finds that the changes beneficial and
compatible with the surrounding area;
1. That the literal enforcement of the provisions of this title will result in restrictions
inconsistent with the spirit and intent of this title;
2. That the granting of the exception will not result in a condition which is
materially detrimental to the public health, safety, or welfare; and
3. That the exception to be granted is one that will require the least modification of
the prescribed regulations and the minimum variance that will accomplish the
purpose.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the application no. EXC-2006-05, is hereby approved; and
That the subconclusions upon which the findings and conditions specified in this
Resolution are based and contained in the public hearing record concerning Application

May 18, 2006, and are incorporated by reference herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY
DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
Approval is based on the plans dated May 22, 2006, entitled: "76, 10625 N. De Anza
Blvd" consisting of 6 pages and the colored sign exhibits attached to the staff report
except as may be amended by conditions in this resolution.
2. SIGN AREA
The proposed sign areas shall be consistent with the City Sign Ordinance.
3. SIGN HEIGHT
The two illuminated 76 circular canopy signs shall be reduced in height to not
exceed the height of the existing canopy fascia.
4. CANOPY/BUILDING FASCIA
The existing canopy and building fascia shall be repainted or refaced. The fascia
shall not be raised in height. The fascia shall be cleared of any wiring, antennas and
flood lights. Any exterior lighting shall be consistent with the City's Lighting
Ordinance.
5. NOTICE OF FEES, DEDICATIONS, RESERV A nONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant
to Government Code Section 66020(d) (1), these Conditions constitute written
notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that
the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90-day period complying with all
of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.

WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Design Review Committee has held one or more
public hearings on this matter; and
WHEREAS, the applicant has not met the burden of proof required to support said
application; and has not satisfied the following requirements:
1. Abrupt changes in building scale is avoided and a gradual transition related to height
and bulk is achieved;
2. In order to preserve design harmony between new and existing buildings and in order
to preserve and enhance property values, the proposal should harmonize with
adjacent development;
3. The proposed height and size of outdoor advertising signs and structures shall
harmonized with adjacent development.
NOW, THEREFORE, BE IT RESOLVED:
