AN ORDINANCE OF THE CITY OF CUPERTINO RELATING TO TIME AND PLACE
AND CONDUCT OF MEETINGS AND PROVIDING FOR PUNISHMENT OF ANY PERSON
FOR DISORDERLY BEHAVIOR.
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS
FOLLOWS:
Section 1 TIME OF REGULAR MEETINGS
The City ouncil shall hold regular meetings on Monday of
each week at 8:00 P. M, and may adjourn any regular meeting at a
date certain, which shall be specified in the order of adjournment,
and when so adjourned such adjourned meeting shall be a regular
meeting for all purposes. Such adjourned meetings may likewise
be adjourned and any so adjourned shall be a regular meeting for
all purposes.
Section 2 SPECIAL MEETINGS
Special meetings may be called at any time by the Mayor or by
three (3) members of the City Council, by written notice delivered
personally to each member at least twenty-four (2~) hours before
the time specified for the proposed meeting; provided, however,
that any special meeting of the City Council shall be a validly
called special meeting, without the giving of such written notice,
as above provided, if all members of the City Council shall give
their consent in writing to the holding of such meeting, and such
consent is on file in the office of the Acting Secretary and City
Clerk at the time of such holding of such meeting. A telegraphic
communication for a councilman consenting to the holding of a meet-
ing shall 'pe deemed to be a consent in writing, within the meaning
of the terms as expressed in the foregoing sentence. At any special
meeting the power of the City Council to transact business shall
be limited to matters referred to in such written notice or written
consent.
Section 3 PLACE OF MEETINGS
All regular mee ings and all special meetings unless changed
in the written notice of meeting shall be held in the library room
of the Cupertino Union School.
Section ~- METHOD OF PRESENTING MATTERS TO COUNCIL
Every official, board, commission or other body, connected with
the City government, and every citizen, individual, corporation,
committee or Civic group, having any reports, communications, or
other matters to be presented at a Council meeting, shall notify the
Acting Secretary and City Clerk of that fact in writing before
5:00 P. M, of the fourth day (Sunday included) preceding the day of
such meeting, whereupon the Acting Secretary and City Clerk shall
prepare a list setting forth such matters and the nature thereof
under their appropriate headings, all under the hearings in order
Specified in Section 5 hereof; and the Acting Secretary and City
Clerk shall, preceeding such meeting, cause one copy thereof to
be delivered to each Councilman. Anyone having an urgent matter to
present to the Council within four (~) days of meeting shall first
receive special permission of the Mayor to present the matter on
such conditions as the Mayor shall see fit to make.
Section 5. ORDER OF BUSINESS
Each meeting shall be called to order by the Mayor whereupon
the business of the meeting shall be taken up in the following order:
1. Salute to the Flag
2. Roll call
Minutes of previous meeting
. Oral communications
5. Protests, ~fritten communications
6. Reports of special committees
7. Reports of officers and commissions
8. Unfinished business
9. New business
10. Paying bills
The foregoing Order of Business may, at any meeting on motion
duly made and carried, be changed car suspended for the period of
such meeting .
Section 6 UNFINISHED BUSINESS
Any matter, the consideration of which has not been completed
at any meeting of the Council and. which has not been continued to
a spe~ifjc date, shall be listed for consideration at the next
regular meeting of the Council ur..der the heading of "unfinished
business."
Section 7 ORDER OF ORAL COMMUNICATIONS
Under the head of oral communications any person may address
the Council on any matter concerr..ing the City's business or on any
matter over which the City has control, but preference shall be
given to those who have previously and personally notified the
Acting Secretary and City Clerk 3n advance of their desire to speak.
Section 8 PROTESTS
Under the head of protests, written communications or petitions,
all persons may, personally, or key their representatives, address
the Council in regard to any matters in which they are interested.
Section g ORDINANCES
Ordinances may be introduces. under the head of new business
by reading the title only. Ordinances ready for final passage
shall be taken up under unfinishE~d business and be read in full
unless the reading thereof is di~:pensed with by unanimous vote
of the Council.
Section 10 DISCUSSION PROCEDURE
While discussing any question under consideration by the Council,
it shall be the duty of the membE:rs thereof to remain seated and
address their remarks to the prey>iding officer and their fellow-
members. Any remarks or orders t;o the audience shall be addressed
by the presiding officer, or witr~ his permission by the members of
the Council.
Section 11 SERGEANT-AT-ARMS
Any person in the audience vrho, while in attendance at any
Council meeting, uses profane language, or language tending to
bring the Council or any of its members into contempt, or any
person who persistently interrupts the proceedings of the Council,
or refuses to be seated or keep quiet when ordered to do so by the
presiding officer, shall be deemE~d guilty of a misdemeanor.
Section 12 URGENCY CLAUSE
This ordinance shall take effect immediately upon its adoption
as an urgency ordinance for the ~~eason that it is immediately
necessary to provide f~elease for procedure for the City Council
and to promote the public welfarE~ .
Section 13 POSTING CLAUSE
Copy of this Ordinance shal:L be posted in at least (3) three
public places in the City of CupE~rtino within fifteen (15) days
after its passage as provided in Section 36933 of the Government
Code of the State of California.
