AN ORDINANCE 0~' THE CITY OF CUPERTI~1~~ AMEPJDING ORDINANCE N0, 002 AS
AMENDED BY ESTABLISHING REQUIR};PZET~ITS F'OR OFF'-STREET PARKING WITHIN THE
CITY -
HE IT ORDAINED BY THE CITY COUNCIL OP' THE CITY OF CUPERTINO AS FOLLOWS:
SECTION l: General
Section 1:1 Im rovement Reguiremen~s: Every parcel of land here-
after used as a public par ing area or used to furnish parking by the
Zoning Ordinance or as u:~ed as an automob~.le sales area shall be de-
veloped as follows:
a. The surface of areas designated as parking an•3 loading
areas and their approaches shall be ps.~~ed with asphaltic o:c~ concreted
surfaces according to standards approved by the City Engineer.
b. Appropriate bumpeL guards and stall ent;rancE, exit and
traffic flow mark:i_ngs shall be pro ~ide~. and maintained.
c. Vehicula:~° access to and egress from parkin, areas from an
existing or proposed strt•e,: wit: four (~) or more lanes s?~a.ll be approv-
ed by the Planning Comm:~..~sion.
d. Parki.r:g ax~ee.s ~~.d~acent to property zoned f.~r residential
shall be enclosed wit:? a mason:.~y wall in accoz~da.nce witr~ the conditions
outlined in Ordinar.~ce No. 112 oi' the City, unless exist.;.ng back fence
or Live planting exists whirr. is acceptable to the Planing Commission,
H-Control, and the City Council, or unless other t~°eatr~~nt has been
predetermined in tine zoning con:l.lticns.
Section 1:2: More than One TTse ;l;z a Buii~~ing: When more than
one of the activ~.ties spccif~.ed i.z Seticns 3 ~.nd ~ of phis Ordinance
is carried on in a g~! ven b3.:;.ldin the Chief F3~.zilding Inspector shall
use a combr.nation of requirements f'cr t~se on bu;tld:;.ngs as required 1n
this section.

ticular building or use shall not bE~ transformed or changed to another
type of use, or transferred to meet the parking requirements of another

main entrance of the user.

SECTION 2: Severability
Section 2:1: If any section, subsection, sentence, clause or
phrase of this ordinance is for a:1y reasons held by a Court of
competent jurisdiction to be in°rdlid, such decision shall not
effect the validity of the remaining porf;ions of this ordinance.
The City Council of the City of Cupertino hereby declares that
it would have passed this ordinance and each section, subsection,
sentence, clause and phrase thereof, irrespective of the fact
that any one or more sec ions, subsections, sentences, clauses
or phrases be held inval:l.d or uriconsi;itutional.
SECTION 3: Publishing Clause
Section 3: 1: `r:tie Cit~T Clerk is hereby authors zed and directed
to cause a certified copy of ttir'.s ordinance Lo be published at
least once within fif':een (15 ) days afte:~.~ its enactment in the
Cupertino Courier, the official newspaper of tra City. This
ordinance shall take efi ec~t and be in i orce tY~irt:;~ (30 ) days
after its enactment.
