Subject: Director's Minor Modification (DIR-2009-06) to allow a 3'6" tall illuminated
IMAX exterior wall sign at the existing AMC Theater located in Cupertino Square.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports her decision
to the City Council and Planning Commission in time to allow any
Council member or Planning Commissioner to appeal the decision within
fourteen calendar days.
BACKGROUND:
The City of Cupertino adopted a Development Agreement with Vallco Fashion Park
(now Cupertino Square) in 1991. The Development Agreement includes a sign program
which states that tenants with 50,000 square feet or more are allowed building mounted
signage with staff approval. Further, it specifies that staff approval be based on height,
setback, and visibility of the sign.
DISCUSSION:
The AMC Theater is approximately 93,332 square feet in size. Currently, AMC has two
exterior illuminated wall signs and one exterior illuminated blade sign. AMC is
requesting a third exterior illuminated wall sign for its IMAX movie screen.
The proposed sign is approximately 3'6" x 18'9" (or 63 square feet) in size and
illuminated to read "IMAX". It would be east facing along North Wolfe Road, located
center from the edge of the exterior building wall to the silver bands, and positioned
two feet from the top of the facade.
The proposed sign is consistent with the provisions of the Development Agreement and
is compatible with Cupertino Square's general architectural style.
ACTION:
The Community Development Director deems the project minor and hereby approves
the modification effective June 26, 2009. The fourteen-calendar day appeal period will
expire on July 10, 2009.
