am a citizen of the United States. I am over the age of eighteen
years and I am not a party to or interested in the above entitled
matter. I am the Legal Advertising Clerk of the printer and publisher
of the Cupertino Courier, a newspaper published in the English
language in the City of Cupertino, County of Santa Clara, State of
California.
I declare that the Cupertino Courier is a newspaper of general
circulation as defined by the laws of the State of California as
determined by court decree dated November 13, 1956, Case
Number 100637. Said decree states that the Cupertino Courier is
adjudged to be a newspaper of general circulation for the City of
Cupertino, County of Santa Clara and State of California. Said
order has not been revoked.
I declare that the notice, of which the annexed is a printed copy,
has been published in each regular and entire issue of said
newspaper and not in any supplement thereof on the following
dates, to wit:

NOTICE OF PUBLIC HEARING
PETITION FOR RECONSIDERATION
TM-2015-01, TR-2016-28 (EA-2015-04)
NOTICE IS HEREBY GIVEN that at its meeting of
Tuesday, August 21, 2018 the City Counc€I of
the City of Cupertino will conduct a public
hearing to 1) consider a Petition for Reconsid-
eration of its decision of May 15, 2018 to deter-
mine if it meets the requirements of Cupertino
Municipal Code (CMC) Section 2.08.096, and if
reconsideration is granted, 2) conduct a hear-
ing to reconsider Council's decision of May 15,
2018 to deny a Tentative Map appl€cation to al-
low the subdivision of 3 parcels (approximate-
ly 1.06 acres) into 5 parcels - 4 residential and
1 common (private street), Tree Removal Per-
mit to allow the removal and replacement of
seven (7) prntected trees and associated envi-
ronmental review- based upon the new evi-
dence and grounds proffered by Petitioner, if
Council determines that the Petition meets the
requirements of Cupertino Municipal Code
section 2.08.096, and approving or denying the
JW-uc-uia, -u41. At its regular meeting of the
Cupertino Planning Commission on April LO,
2018, the Planning Commission voted (3-0-2)
(Sun and Fung voting no) to deny the applica-
tions per Resolution Nos. 6856. 6857 and 6859.
Council meets at 6:45 p.m., Council Chamber,
Community Hall, 10350 Torre Avenue,
Cupertino, California. Interested parties are
invited to attend and be heard. If you wish to
challenge the City Council's action in court,
you may be limited to raising only those issues
you or someone else raised at the public hear-
ing described in this notice, or in written corre-
spondence delivered to the City of Cupertino
City Hall at, or prior to, the public bearing. IM-
PORTANT NOTICE: Please be advised that pur-
suant to Cupertino Municipal Code 2.08.100
written communications sent to the Cupertino
City Council, Commissioners or City staff con-
cerning a matter on the agenda are included
as supplemental material to the agendized
