NOTICE INVITING BIDS
I. Bid Acceptance. The City of Cupertino ("City') will accept sealed bids for Its Sports Center
Upgrades -LEI] ,Mss eage Sign_ Project ("Project"), by or before February 20, 2019, at 2:00 pro, at
the Clty Clerk's Office, located at 10300 Torre Avenue, Cupertino, California, 95014 at which time
the bids will be publicly opened in the City Hall lobby and read aloud. The City may, acting in its
sole discretion, reject any and all bids, and may waive any immaterial deviation from the bid re-
quirements to the full extent permitted by law,
2. Project Information.
2.1 Location and Descripption. The ProlI'ect is located at the Cupertino _Sports Center 21111
Stevens Cree& Boulevard, Cupertlnp, CA_ 95014 on the corner a! Stevens Creek B66[evard and
North Ste ling Avenue and Is described as follows: Remove existing monument sign, prepare

2.2 Time for Completion. The planned timeframe for commencement and completion of con-
struction of the Project is: Sixty (60) working days from the City Notice to Proceed.
2,3 Estimated Cost. The estimated construction cost Is17,S,BUE)..
3. License and Registration Requirements.
3.1 License. This Project requires avalid California contractor's license for the following
classification(s): Califorma General "A"license ,
3.2 DIR Registration. City will not accept a Bid Proposal from or enter into the Contract with
a bidder, without proof that the bidder is registered with the California Department of Industrial
Relations ("DIR') to perform public work under Labor Code section 1725.5. subject to limited le-
gal exceptions.
4. Contract Documents. The plans, specifications, bid farms and contract documents for the
Project, and any addenda thereto ("Contract Documents") are available In electronic form only,

maximum bid amount, in the form of a cashier's or certified check made payable to city, or a
bid bond executed by a surety licensed to do business In the State of California on the Bid Bond
farm included with the Contract Documents, The bid security must guarantee that within ten
days after City issues the notice of award, the successful bidder will execute the Contract and
submit the payment and performance bonds. Insurance certificates and endorsements and any
other submittals as required by the Contract Documents and specified in the notice of award.
6. Prevailing Wage Requirements.
6.1 General. This Project is subject to the prevailing wage requirements applicable to the lo-
cality in which the Work is to be performed for each craft, classification or type of worker need-
ed to perform the Work, including employer payments for health and welfare, pension, vaca-
tion, apprenticeship and similar purposes.
6.2 Rates. These prevailing rates are on file with the City and available online at http;//
www,dir.ca,ge, y/DLSR. Each Contractor and Subcontractor must pay no less than the specified
rates to all workers employed to work on the Project. The schedule of per diem wages is based
upon a working day of eight hours. The rate for holiday and overtime work must be at least
time and one-half.
5.3 Compliance. The Contract will be subject to compliance monitoring and enforcement by
the DIR, under Labor Code section 1771.4.
7. Performance and Payment Bonds. The successful bidder will be required to provide per-
formance and payment bonds, each for 100% of the Contract Price.
8. Substitution of Securities. Substitution of appropriate securities in lieu of retention
amounts from progress payments is permitted under Public Contract Code section 22300.
9. Subcontractor List, Each bidder must submit a completed Subcontractor List form with its
Bid Proposal, including the name, location of the place of business, California contractor license
number, DIR registration number, and percentage of the Work to be performed (based on the
Base Bid) for each Subcontractor that will perform work or service or fabricate or Install work
for the prime contractor in excess of one-half of 1% of the bid price or, for construction of
streets and highways, $10,000 (whichever is greater), using the Subcontractor List form inc lud
ed with the Contract Documents.
10. Subcontractor Limit. The prime contractor is required to self -perform at least 51% of the
Work on the Project, as further specified In the Instructions to Bidders.
11. Bidders' Conference. A bidders' conference will be held on February 7,_Z018 at 10.00 am, at
the Cupertino Sports_Center 21111 Stevens,. Creek Boulevard,.Culre►tmo_CA.- 9W14 for the pur-
ppose of acquainting all prospective bidders with the contract Documents and the Worksite. The
bidders'conference iS not mandatory.
12. Instructions to Bidders. Alf bidders should carefully review the Instructions to Bidders be-
fore submitting a Bid Proposal.

The City of Cupertino will consider Municipal Code Amendments to regulate the placement of storage containers and temporary fencing (Chapter
9.22 - Property Maintenance), size of signage notice boards for development (Chapter 19.12 - Administration), size of Accessory Dwelling Units
(Chapter 19.112 - Accessory Dwelling Units in R-1, RHS, A and A-1 Zones), and amendments to various other chapters of Title 19 — Zoning of the
Municipal Code, including but not limited to, Chapter 19.08 (Definitions), Chapter 19.28 (Single -Family Residential (R-1) Zones), Chapter 19.40
(Residential Hillside (RHS) Zones), Chapter 19.60 (General Commercial (CG) Zones), and 19.116 (Conversions of Apartment Projects to Common
Interest Developments) for compliance with State Law, readability, clarifications, and internal consistency. The amendments will apply citywide.
The project is categorically exempt as there is no potential for this action to cause a significant effect on the environment and/or any project would
be exempt under CEQA. (Existing Facilities (Sec. 15301), Replacement or Reconstruction (Sec. 15302), or Construction or Conversion of Small
Structures (Sec.15303))
At its regular meeting on May 23, 2017, The City of Cupertino's Planning Commission voted 5-0 -1, P MW M ! �
to recommend that the City Council approve the application per Resolution No. 6832. City Council
The City Council will hear the proposed amendments on Wednesday, July 5, 2017 at 6:45 pm at Wednesday, July 5, 2017
