Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council, Planning Commission and property owners within a', 1,000 foot noticing radius in time to allow an appeal of the decision within' fourteen calendar days. BACKGROUND: In 2000, Pac Bell Wireless was allowed (DIR-2000-24) to erect aloes-power, personal wireless service facility (i.e. microcell) on a utility pole on Foothill Boulevard at Monta Vista Park (Attachment 1). The original permit was granted for five years (to year 2005) with the proviso that upon renewal, the City would have an opportunity to determine if the facility was well-maintained, and to determine if there were opportunities to improve the concealment based on new technologies and/ or camouflage techniques. The personal wireless service facility has since been acquired by T-Mobile. DISCUSSION: The subject wireless communications microcell facility consists of two antennas mounted on an existing utility pole with the power and communications boxes located on the pole itself (Attachment 2). The project proposes to extend the existing antenna mounting bracket about 8 inches to allow the two antennas to be adjustable for signal optimization. Typically, a microcell facility is the preferred design for residential areas given its small size. Consequently, additional camouflage measures are not warranted. In accordance with State Law- SB 1627, wireless facility approvals must be granted for a period of at least 10 years. The Director of Community Development deems the proposed modification minor and approves an extension of 10 years from the permit expiration date, which is August 7, 2015 with the following conditions: 1. Approval is based on the plan set titled: "PG&E Distribution Pole, SF04638A" DIR-2009-05 Foothill Blvd. @ Monta Vista Park Page 2 consisting of four pages dated May 20, 2009 and labeled T-1, A-1, A-2 and A-3. 2. If the facility is abandoned for a period of eighteen months, then the aerial and its associated facilities shall be removed at the expense of the applicant or pole owner. 3. The approval of the personal wireless service facility shall lapse if the City of Cupertino decides to remove the existing utility pole and underground the public utilities currently attached to said pole. The process of removing the utility pole shall not be delayed by the existence of the aforementioned personal wireless service facility. This approval is effective June 22, 2009. The fourteen calendar day appeal period will expire on July 6, 2009. Description: The applicant, Pacific Bell Wireless, is requesting the attachment of a "microcell" aerial installation on an exsting high voltage power pole on the Foothill Boulevard right-of- way, abutting Monta Vista Pazk and across the street from Walnut Circle North. A microcell is a low power aerial facility designed to serve a small area, usually filling a radio coverage hole for a Personal Communications Services (PCS) carrier. This one is oriented to provide coverage along Foothill Boulevard. As been previously reported to the Planning Commission by a number of wireless carriers, the west side of Cupertino has poorer radio coverage than all other azeas of the City (see attached antenna inventory list and map). The City's wireless communications facilities ordinance requires such aerials to be setback from residential properties 50 feet or the height of the antenna, whichever is greater. In this case, the setback is 61 feet and the antenna is mounted only about 35 feet above grade, so the project conforms with this section of the ordinance. Given the distance to residences, the applicant has supplied a report documenting the radio emission levels for a microcell antenna in relation to Federal exposure standards (Exhibit B). This line of power poles is not part of any current City undergrounding utility district nor aze there plans to form one. The Foothill Boulevard power poles are part of the primary electrical power distribution network, which aze not normally undergrounded by Pacific Gas and Electric. The panel antennae and microcell cabinet will be painted to match the pole. Action: The Director finds the microcell aerial facility to be small and unobtrusive, and blends in well with the other equipment attached to the pole (See photosimulation). The Director of Community Development deems the modification minor and conditionally approves the modification as depicted in exhibits titled "Pacific Bell Wireless SF 638-02 Stevens Creek Cupertino, CA", consisting of four sheets labeled T1, C-1, Al & A2 dated 4/17/00 and 5/2/00. The first condition of approval provides for the removal of the aerial and its associated facilities if the aerial is not used for its permitted purpose for a period of eighteen (18) months. The second condition of approval provides fora 5-yeaz expiration date on this permit. Before the expiration date, the applicant may apply for a time extension at which point the state of its technology will be reviewed in conjunction with the project. The expiration date shall be August 3, 2005 or a later date approved by the Planning Commission upon the appeal of the project. r_ v This approval of the modification is effective August 7, 2000.
