Subject: Director's Minor Modification (DIR-2009-10) to allow the expansion of an
existing personal wireless service facility by adding three panel antennas to the existing
six panel antennas mounted on the PG&E lattice tower located at 10110 California Oak
Way.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council, Planning Commission and property owners in a 1,000-
foot noticing radius in time to allow any Council member, Planning
Commissioner or noticed property owner to appeal the decision within
fourteen calendar days.
BACKGROUND:
The applicant, Tawni Parr (representing Verizon Wireless) proposes an expansion of an
existing personal wireless facility approved in 2005 (DIR-2005-28, EXC-2005-17) by
adding three new panel antennas to the existing six panel antennas mounted in a top
hat arrangement on a PG&E lattice tower (Attachment 1 & 2). The tower is located at
the Monta Vista electrical substation.
DISCUSSION:
Both Sprint-Nextel and Verizon Wireless have colocated antennas on this PG&E lattice
tower with Sprint occupying the tower legs below the conductors and Verizon above
the conductors. Verizon Wireless is moving to 4~ generation technology with
increased data speeds for wireless handsets and computers (Attachment 1),
consequently additional antennas are required.
The three additional antennas will be mounted on the top hat rack at the same height as
the existing antennas. The antennas will look similar to the current arrangement and
will be minimally visible from residential areas and the public street views (which area
over 570 feet away). See diagram below and Attachment 2.

ACTION:
In accordance with CMC Section 19.108.090(B)(1), The Director of Community
Development finds that the proposed facility minimally visible to residential properties
and public rights-of-way. The Director deems the antenna additions minor and
approves the change as described in the plan set titled: "Foothill & McClellan/ 10110
California Oak Way, Cupertino, CA 95014/ APN 342-63-001" prepared by MST
Architects and consisting of four sheets labeled T1.1, C-1, A1.1 and A1.2 dated 5/ 20/ 09
(Attachment 3), except as may be modified by the conditions enumerated below:
1) ANTENNA CAMOUFLAGE
The new antennas, supporting brackets and all existing and new tower cables
shall be painted a flat gray color that matches the tower.
2) ABANDONMENT
If after installation, the aerial is not used for its permitted purpose for a
continuous period of 18 months, said antennas and associated facilities shall be
removed. The applicant shall bear the entire cost of demolition, removal and
land restoration to its former condition.
3) PERMIT EXPIRATION
The Director's approval is valid until November 22, 2010, in order to coincide
this permit with the expiration date of the approvals for the personal wireless
service facility.

appeal period will expire on July 6, 2009.

What is LTE?
LTE (or Long Term Evolution) represents the latest in wireless technology. Verizon Wireless has made a
commitment to bring this 4'h generation service to the Bay Area. LTE will vastly increase data speeds for
wireless handsets and computers. The data speeds offered by LTE will be on par with DSL and cable
Internet speeds. As such, smaller wireless "hot spots" or isolated WiFi networks will become obsolete, as
the entire Bay Area Verizon network will provide customers unprecedented data speeds for personal and
business uses. This network upgrade will also increase public safety by enabling users to access up to
the minute news and traffic information.
This Project
The addition of LTE technology requires modification to each of Verizon's sites in the network. This
project entails merely the installation of new antennas to accomplish the objective of bringing high speed
capabilities to Verizon users in the City of Cupertino.

Compliance with City Development
This project has been carefully designed to comply with the applicable standards set forth in the City's
Municipal Code. Specifically, the proposal is satisfies the criteria set forth in Code Section 19.108.070
concerning design and siting review of telecommunications facilities and is appropriately processed as
administrative approval of minor changes per Code Section 19.132.00.
As discussed above, Verizon proposes adding three (3) antennas to its existing six (6) antenna array on
the top of a PG&E tower. When weighing the design and site advantages and disadvantages, the
addition of antennas to an existing tower greatly outweighs the alternatives which would require either
developing a new facility or co-locating on another tower or rooftop in order to accommodate the new
antennas and technology. The collocation on an existing tower satisfies the City's requirement that
existing towers and masts be utilized to reduce "visual clutter" and to avoid concentration of
telecommunications facilities. (§ 19.108.070 (A,E-G).) The new antennas are substantially the same size
as the existing and will be integrated to match the PG&E tower thereby satisfying the requirement that
colors, materials and textures integrate with the surrounding building and environment. (§19.108.070(B).)

Interference
The project will not interfere with any TV, Radio, Telephone, Satellite, public safety communications or
any other signals. Any interference would be against the Federal Law and would be a violation of
Verizon's FCC License.
Notices of Actions Affecting this Development Permit
In accordance with California Government Code Section 65945(x), Verizon requests notice of any
proposal to adopt or amend the: general plan, specific plan, zoning ordinance, ordinance(s) affecting
building or grading permits that would in any manner affect this development permit. Any such notice
may be sent to 2009 V Street, Sacramento, CA 95818.
Construction Schedule
The construction of the facility will be in compliance with all local rules and regulations. The typical
duration is less than one month. The crew size will range from approximately 2 to 10 individuals.
