years and I am not a party to or interested in the above entitled
matter. I am the Legal Advertising Clerk of the printer and
publisher of the Cupertino Courier, a newspaper published in the
English language in the City of Cupertino, County of Santa Clara,
State of California.
I declare that the Cupertino Courier is a newspaper of general
circulation as defined by the laws of the State of California as
determined by court decree dated November 13, 1956, Case

ADVERTISEMENT FOR BIDS
NOTICE: THE CITY OF CUPERTINO, a Municipal Corporation of the State of California ("City")
hereby gives notice that it will accept Bids for construction of the following public work:
CITY PROJECT NUMBER 2017-10
STORM DRAIN IMPROVEMENTS -
FOOTHILL BOULEVARD AND CUPERTINO ROAD -REBID
1. BID SUBMISSION: The City uses a two-part Bid process with Bids in Envelope "A" and State-
ments of Qualification and Financial Information in Envelope "B". City will accept Envelope "A"
and Envelope "B' before 2:00 p.m. on July 6, 2117 in the City Clerk's Office. Bids will be publicly
read at 2:10 p.m. 1n the City Hall Lobby at 10300 Torre Avenue. City's representative will call out
the designated time in the Office of the City Clerk, 10300 Torre Avenue, stating that the period
for accepting Bids Is closed. The Bid opening will be in accordance with procedures set forth n
Document 00200 (Instructions to Bidders).

3. STATEMENT OF QUALIFICATIONS: Each Bidder shall be required to submit a "Statement of

4. DESCRIPTION OF THE WORK: Work includes the installation of approximately 1,000 feet of 18
inch reinforced concrete pipe, eight manholes, and drain inlets. Also included are modifications
to existing manholes, pavement restoration, and other pertinent work as necessary to con-
struct the project as shown on the approved plans and specified in the project specifications.
5. CONTRACT TIME: Work shall be completed no later than 100 calendar days following the ef-
fective date of the Notice to Proceed, in accordance with contract requirements, and project
completion.
6. REQUIRED CONTRACTOR'S LICENSE: A California Class A, General Engineering, or C-34, Pipe-
line, contractor's license is required to Bid this Contract. In addition, this project also requires
that the bidder has a C-31, Construction Zone Traffic Control Contractor, license. Bidder may
propose to self -perform traffic control work if they possess a C-31 license or submit a traffic
control sub -contractor that has appropriate qualifications, Including a C-31 license. Joint ven-
tures must secure a joint venture license prior to award of this Contract. Removal, handling,
and/or disposal of hazardous materials may, by law, require hazardous substance removal cer-
tification by the Contractor's State License Board.
7. REQUIRED CONTRACTOR AND SUBCONTRACTOR REGISTRATION:
A. Owner shall accept Bids only from Bidders that (along with all Subcontractors listed in
Document 00430 Subcontractor List) are currently registered and qualified to perform public
work pursuant to Labor Code Section 1725.5.
B. Subject to Labor Code Sections 1771.1(c) and (d), any Bid not complying with paragraph 1.01A
above shall be returned and not considered; provided that if Bidder is a joint venture (Business
& Professions Code Section 7029.1) or if federal funds are involved in the Contract (Labor Code
Section 1771.1(a)), Owner may accept a non -complying Bid provided that Bidder and all listed
Subcontractors are registeredatthe time of Contract award.
8. PREVAILING WAGE LAWS: The successful Bidder must comply with all prevailing wage laws
applicable to the Project, and related requirements contained in the Contract Documents.
9. INSTRUCTIONS: Bidders shall refer to Document 00200 (Instructions to Bidders) for required
documents and items to be submitted in sealed envelopes to City Clerk's office, as well as ap-
plicable times for submission.
10. SUBSTITUTION OF SECURITIES: City will permit successful Bidder to substitute securities for
retention monies withheld to ensure performance of Contract, as set forth in Document 00680
(Escrow Agreement for Security Deposits in Lieu of Retention), in accordance with California
Public Contract Code, Section 22300. By this reference, Document 00680 (Escrow Agreement for
Security Deposits in Lieu of Retention) 1s incorporated in full in this Document 00100.
11. PRE -BID CONFERENCE: This project will not have a pre -bid conference. Any Bidder wishing
to investigate subsurface conditions at the site must schedule such a visit with the City in ac-
cordance with Document 00200 (Instructions to Bidders).
12. PROCUREMENT OF BIDDING DOCUMENTS: Bidders may examine a complete hard -copy set
of bid documents at the City's Public Works Department, City Hall, 10300 Torre Avenue in
Cupertino.
To obtain a copy of the bid documents, Bidders must download a set of bid documents from the
City of Cupertino Web site at: htt�://www.cupertino.orn/i-want-to/bid-on/open-bids, or from a
plan room or trade journal site that carries them. The City will post all addendums to the orni-
ect on the City' web site arid- it-ls the—C-untraetOf s��espons ihty toad' the
addendums for the project. If a Contractor wishes to be on the plan holders list for the project
the Contractor must send an e-mail to: capitalprojects@cupertino.org containing the following
information: Contractor's name, address, phone and fax number, and e-mail address for future
communications. The plan holders list will be updated daily. Bidder is responsible for printing
all of the bidding documents.
13. BID PREPARATION COST: Bidders are solely responsible for the cost of plan and specifica-
tion printing and preparing their Bids.
14. RESERVATION OF RIGHTS: City specifically reserves the right, in its sole discretion, to reject
any or all Bids, or re -bid, or to waive inconsequential deviations from Bid requirements not in-
volving time, price, or quality of the Work.
15. PORTION OF WORK PERFORMED BY THE CONTRACTOR: The Contractor shall perform no
less than 50% of the Work, excluding Specialty Items, with its own organization. Specialty
Items will be identified on the Bid Form.
