The undersigned, being first duly sworn, deposes and says: That
at all times hereinafter mentioned affiant was and still is a citizen
of the United States, over the age of eighteen years, and not a
party to or interested in the above entitled proceedings; and was
at and during all said times and still is the principal clerk of the
printer and publisher of the San Jose Mercury News, a newspaper
of general circulation printed and published daily in the City of San
Jose, County of Santa Clara, State of California as determined by
the court's decree dated June 27, 1952, Case Numbers 84096
and 84097, and that said San Jose Mercury News is and was at
all times herein mentioned a newspaper of general circulation as
that term is defined by Sections 6000; that at all times said
newspaper has been established, printed and published in the
said County and State at regular intervals for more than one year
preceding the first publication of the notice herein mentioned.
Said decree has not been revoked, vacated or set aside.
I declare that the notice, of which the annexed is a true printed

NOTICE OF PUBLIC HEARING
MCA-2017-02
NOTICE IS HEREBY GIVEN that at its meeting on
Tuesday, April 18, 2017, the Cupertino City
Council will conduct a public hearing to con-
sider Municipal Code Amendments to revise
Title 19 to allow for the creation of a Single -
Story Overlay process in single family residen-
tial zones, and may also consider amending
the Fiscal Year 2016-17 Fee Schedule.
On March 14, 2017, the Planning Commission
recommended (4-1 (Sun - no)) that the City
Council find that the proposed actions are ex-
empt from CEQA (as there is no potential for
this action to cause a significant effect on the
environment (Section 15061(b) (3)) and adopt
municipal code amendments per Resolution
No. 6825.
City Council meets at 6:45 p.m., Council Cham-
ber, Community Hail, 10350 Torre Avenue,
Cupertino, California. Interested parties are in-
vited to attend and be heard. A copy of the
proposed amended Fee Schedule will be avail-
able beginning April 7, 2017 for public review
from 7:30 am. to 5:30 p.m. weekdays (until 4:30
p.m. on Fridays) at City Hall, 10300 Torre Ave-
nue. If you wish to challenge the CityCouncil's
action In court, you may be limited to raising
only those issues you or someone else raised
at the public hearing described in this notice,
or in written correspondence delivered to the
City of Cupertino City Hall at, or prior to, the
public hearing.
