matter. I am the Legal Advertising Clerk of the printer and

English language in the City of Cupertino, County of Santa Clara,
State of California.

NOTICE OF PUBLIC HEARING ON PROPOSED
ORDINANCE RELATED TO MEDICINAL AND
ADULT USE (RECREATIONAL) MARIJUANA IN
THE CITY OF CUPERTINO
NOTICE IS HEREBY GIVEN pursuant to Califor-
nia Government Code section 65090 et seq.,
that the Cupertino City Council will conduct a
public hearing on an ordinance that (1) estab-
shes regulations regarding. adult use (recrea-
tional) and medicinal marijuana by adding a
new Chapter in Title 10, Public Peace, Safety
and Morals, Chapter 10.84, Medicinal and Adult
Use of Marijuana, (2) amends Chapter 19.08,
Definitions to repeal definitions related to Mar-
ijuana, and (3) amends Chapter 19.98, Medical
Marijuana to reference the newly established
Chapter 10.84. (MCA-2017-04)

The state recently adopted Medicinal and
Adult -Use Cannabis Regulation and Safety Act
(MAUCRSA) which effectively repealed the
Medical Cannabis Regulation and Safety Act
(MCRSA) and incorporated some of its provi-
sions into the licensing provisions of the Con-
trol, Regulate and Tax Adult Use of Marijuana
Act (AUMA) or Proposition 64). The proposed
ordinance responds to these legal develop-
ments and clarifies local rules and regulations
regarding the prohibited and allowable canna-
bis activities in the city of Cupertino.
The Cupertino Planning Commission reviewed
the Item on November 14, 2017 and recom-
mended approval of the proposed ordinance
with revisions on a 4-0-1(Sun absent) per Reso-
lution #6941. The Planning Commission recom-
mended that revisions be made to the pro-
posed ordinance to disallow deliveries of adult
use (recreational) marijuana within the City. In
addition, it recommended that staff present
options to the City Council for its considera-
tion for the establishment of a registration
process for regulating and inspecting sites
where indoor cultivation of marijuana for per-
sonal use is proposed.
Environmental Recommendation: Categorical-
ly Exempt. This action is categorically exempt
as there is no potential it will cause a signifi-
cant effect on the environment and/or any
project would be exempt under relevant provi-
sions of CEQA guidelines, Section 15061(b)(3)
and 15354.

ing to the ordinance are available from the Of-
fice of the City Clerk and the Community De-
velopment Department, 10300 Torre Avenue,
Cupertino, California, 95014. These records
may also be accessed through the City of

org. Interested parties may attend the public
hearing or submit written comments. If you
challenge the action of the City Council in
court, you may be limited to raising only those
issues you or someone else raised at the pub-
lic hearing described in this notice, or in writ-
ten correspondence delivered to the City of
Cupertino at, or prior to, the public hearing.
