years and I am not a party to or interested in the above entitled
matter. I am the Legal Advertising Clerk of the printer and
publisher of the Cupertino Courier, a newspaper published in the
English language in the City of Cupertino, County of Santa Clara,
State of California.
I declare that the Cupertino Courier is a newspaper of general
circulation as defined by the laws of the State of California as
determined by court decree dated November 13, 1956, Case
Number 100637. Said decree states that the Cupertino Courier is
adjudged to be a newspaper of general circulation for the City of
Cupertino, County of Santa Clara and State of California. Said
order has not been revoked.

ADVERTISEMENT FOR BIDS
NOTICE: THE CITY OF CUPERTINO, a Municipal Corporation of the State of California ("City") hereby gives notice that it
will accept Bids for construction of the following public work:
CITY PROJECT NUMBER 2017-03
CITY HALL TURF REDUCTION
1. BID SUBMISSION: The City uses a two-part Bid process with Bids in Envelope "A" and Statements of Qualification and
Financial information in Envelope "B". City will accept Envelope "A" and Envelope "B" before 2:00 p.m. on Tuesday,
February 21, 2017 in the City Clerks Office. Bids will be publicly read at 2:10 p.m. in the City Hall Lobby at 10300 Torre
Avenue. City's representative will call out the designated time in the Office of the City Clerk, 10300 Torre Avenue, stat-
ing that the period for accepting Bids Is closed. The Bid opening will be in accordance with procedures set forth in
Document 00200 (Instructions to Bidders).

3. STATEMENT OF QUALIFICATIONS: Each Bidder shall be required to submit a "Statement of Qualifications" in accord-
ance with Document 00200 (Instructions to Bidders) and Document 00450 (Statement of Qualifications for Construction
Work).
4. DESCRIPTION OF THE WORK: Work includes installation of irrigation and plantings and DG pavingg The work will in-
cludes excavation of trenches, laying of pipe and installation and maintenance of plantings, backfill of trenches, and
other pertinent work as necessary to construct the project as shown on the approved plans and specified in the project
specifications.
5. CONTRACT TIME: Work shall be completed before June 19, 2017 in accordance with contract requirements, and proj-
ect completion. A notice to proceed is anticipated to be issued on or before March 22, 2017.
6. Expected Expenditure: The City's expected expenditure is $237,000 (This price is expected — not guaranteed)
7. REQUIRED CONTRACTOR'S LICENSE: A California Class "C27" Landscaping, contractor's license is required to Bid this
Contract. Joint ventures must secure a joint venture license prior to award of this Contract. Removal, handling, and/or
disposal of hazardous materials may, by law, require hazardous substance removal certification by the Contractor's
State License Board.
8. Required Contractor and Subcontractor Registration [Applies if bid is submitted on or after March, 1, 2015 or if
Contract is awarded on or after April 1, 2015. Labor Code Section 1771.1.]
A. Owner shall accept Bids only from Bidders that (along with all Subcontractors listed in Document 00430 Subcontrac-
tor List) are currently registered and qualified to perform public work pursuant to Labor Code Section 1725.5.
B. Subject to Labor Code Sections 1771.1(c) and (d), any Bid not complying with paragraph 1.01A above shall be re-
turned and not considered; provided that if Bidder is a joint venture (Business & Professions Code Section 7029.1) or if
federal funds are involved in the Contract (Labor Code Section 1771.1(a)), Owner may accept a non -complying Bid pro-
vided that Bidder and all listed Subcontractors are registered at the time of Contract award.
9. PREVAILING WAGE LAWS: The successful Bidder must comply with all prevailing wage laws applicable to the Project,
and related requirements contained in the Contract Documents.
10. INSTRUCTIONS: Bidders shall refer to Document 00200 (Instructions to Bidders) for required documents and Items to
be submitted in sealed envelopes to City Clerk's office, as well as applicable times for submission.
11. SUBSTITUTION OF SECURITIES: City will permit successful Bidder to substitute securities for retention monies with-
held to ensure performance of Contract, as set forth in Document 00680 (Escrow Agreement for Security Deposits in Lieu
of Retention), in accordance with California Public Contract Code, Section 22300. By this reference, Document 00680 (Es-
crow Agreement for Security Deposits in Lieu of Retention) Is incorporated in full in this Document 00100.
12. PRE -BID CONFERENCE: City will conduct a non -mandatory Pre -Bid Conference at 10:00 AM on Monday, February 13,
2017 at the site, City Hall, 10300 Torre Ave. in the City of Cupertino. Meet at corner of Torre Ave. and Rodrigues Ave. by
the statue. Any Bidder wishing to investigate subsurface conditions at the site must schedule such a visit with the City
in accordance with Document 00200 (Instructions to Bidders).
13. PROCUREMENT OF BIDDING DOCUMENTS: Bidders may examine a complete hard -copy set of bid documents at the
City's Public Works Department, City Hail, 10300 Torre Avenue In Cupertino. To obtain a copy of the bid documents, Bid-
ders must download a set of bid documents from the City of Cupertino Web site at: http://www.cupertino.org/*index.as
px?page=119, or from a plan room or trade journal site that carries them. The City will post all addendums to the proj-
ect on the City web site and it is the Contractor's sole responsibility to download the addendums for the project. If a
Contractor wishes to be on the plan holders list for the project the Contractor must send an e-mail to: capital projects a@c
upertino.org with the following information: Contractor's name, address, phone and fax number, and e-mail address for
future communications. The plan holders list will be updated daily and posted on the City Web site. Bidder is responsi-
ble for printing all of the bidding documents.
14. BID PREPARATION COST: Bidders are solely responsible for the cost of plan and specification printing and preparing
their Bids.
15. RESERVATION OF RIGHTS: City specifically reserves the right, in its sole discretion, to reject any or all Bids, or re -bid,
or to waive inconsequential deviations from Bid requirements not involving time, price, or quality of the Work
16. PORTION OF WORK PERFORMED BY THE CONTRACTOR: The Contractor shall perform no less than 51% of the Work,
excluding Specialty Items, with its own organization. Specialty Items will be identified on the Bid Form.CITY OF
