A RESOIIJTION OF THE CITY' <XJONCIL OF THE CITY' OF CUPERI'INO
ORDERING ANNEXATION OF AREA DESIGNATED AS "EL CAMINO
HOSPITAL 85-5" 'IO THE CITY' OF CUPERI'INO, APPIDXIMATELY 385.6
ACRES GENERALLY IDCATED WEST OF I-280 BEIWEEN
CUPERI'INO AND LOS AIJroS
WHEREAS, on JUly 7, 1986 the City Council adopted Resolution No. 6881
initiating proceedings and setting the time and place for public hearing
for consideration of armexation of the area designated "El Camino Hospital
85-5;" and
WHEREAS, said territory is inhabited and the written consent to
armexation was obtained from the property owners; and
WHEREAS, section 56826 of the California Government Code states that
the IDeal Agency Fonnation Cammission shall not have any authority to
review an annexation to any city in Santa Clara County of unincorporated
territory which is within the urban service area of the city of the
armexation if initiated by resolution of the legislative body and
therefore the City Council of the city of CUpertino is nr::M the conducting
authority for said annexation; and
WHEREAS, the property owners of the said territory were notified of
the hearing and no written protest against the armexation was filed with
the City Clerk at any time prior to the city Council's hearing on the
proposed annexation; and
WHEREAS, a duly noticed public hearing was held before the city
Council of the City of CUpertino on Monday, August 18, 1986 at 6:45 p.m.
in the Council Chamber, City Hall, 10300 Torre Avenue, CUpertino,
California; and
WHEREAS, evidence was presented to the city Council;
NOO, 'mEREFORE, BE: rr RESOLVED by the City Council of the City of
CUpertino as fOllr::MS:
1. That it is the conducting authority pursuant to section 56826 of the
Government Code for the armexation of property designated "El Camino
Hospital 85-5," more particularly described in Exhibit "A";

2. That the fOllr::Ming findings are made by the City Council of the city
of CUpertino:
a. That said territory is inhabited and comprises 385.6± acres.
b. That the armexation is consistent with the orderly armexation of
territory with the City's urban service area and is consistent
with the city policy annexing \<IDen providing City services.
c. The city COuncil has completed an initial study and has found
that the armexation of said territory has no significant impact
on the environment, and previously approved the granting of a
Negative Declaration.
d. The City Council on January 6, 1986 enacted an ordinance
prezoning the subject territory to city of CUpertino P, Ð;2 and A
zones.
e. Annexation to the City of CUpertino will affect no changes in
special districts.
f. That the territory is within the City urban service area as
adopted by the IDeal Agency Fonnation Cammission.
g. That the armexation is made subject to no tems and conditions.
h. That the County surveyor has determined the boundaries of the
proposed annexation to be definite and certain, and in compliance
with the Cammission's road annexation policies. The City shall
re:i1nburse the County for actual costs incu=ed by the County
surveyor in making this dete=ination.
i. That the proposed armexation does not create islands or areas in
which it would be difficult to provide municipal services.
j . That the proposed armexation does not split lines of assessment
or ownership.
k. That the proposed annexation is consistent with the city's
General Plan.
1. That the City has complied with all conditions ilrp:)sed by the
conunission for inclusion of the territory in the City's urban
service area.

m. That the territory to be annexed is contiguous to existing city
limits urñer provisions of the Government Code.
3. That said armexation is herby ordered without election pursuant to
section 56837 et seq. of the Government Code.
4. That the Clerk of the City Council of the City of CUpertino is
directed to give notice of said armexation as prescribed by law.

Name of Annexation: EI Camino Hospital 85-05
All of that certain territory situate in the County of Santa Clara, State of California, described as
follows:
BEGINNING at the Southeasterly corner of Parcel 10 as said parcel is described in the Final
Order of Condemnation No. P8390 had in the Superior Court of the State of California in and for
the County of Santa Clara, Palo Alto Branch, a copy of the instrument for which decree was
recorded September 7, 1965 in Book 7096 of Official Records, page 193, Santa Clara County
Records, said corner being in the Northwesterly line of that certain 37.92 acre parcel of land
conveyed to the Catholic Foreign Mission Society of America by Deed recorded July 29, 1929 in
Book 478 of Official Records, page 11, Santa Clara County Records; thence from said point of
beginning along the general Southwesterly lines of said Parcel 10, the following ten following
courses and distances: North 460 47' 46" West 37.36 feet; North 770 33' 00" West 181.89 feet;
North 56049' 44" West 166.83 feet; North 500 07' 45" West 169.97 feet; North 470 45' 48" West
