CC Resolution No. 6943 RESOIIJTION NO. 6943 A RESOIIJTION OF THE CITY' cn:JNCIL OF THE CITY' OF CUPERI'INO AMENDING RESOIIJTION NO. 6942 'IO INCIDDE THE ANNEXATION OF THE AREA DESIGNATED IIEL CAMINO HOSPITAL 85-5" 'IO THE CUPERI'INO SANITARY DISTRIcr, APPIDXIMATELY 54.04 ACRES GENERALLY IDCATED WEST OF I-280 BEIWEEN C1it'!!;Kl'INO AND LOS AIJroS WHEREAS, on August 18, 1986, the City Council of the city of CUpertino, acting pursuant to the provisions of Government Code Section 56826, as the conducting authority, ordered the armexation of the area designated "El Camino Hospital 85-5" to the City of CUpertino by Resolution No. 6942; and WHEREAS, the City council at that time continued the public hearing related to the armexation of said property to the CUpertino Sanitary District to this date; and WHEREAS, said property is inhabited and the written consent to annexation was obtained from the property r::Mners; and WHEREAS, the property owners of the said territory were notified of the hearing and no written protest against the armexation was filed with the city Clerk at any time prior to the City Council's hearing on the proposed annexation; and WHEREAS, a duly noticed public hearing was held before the City Council of the City of CUpertino on September 2, 1986 at 6:45 p.m. in the Council Chamber, city Hall, 10300 Torre Avenue, CUpertino, California; and WHEREAS, evidence was presented to the City Council; New, 'mEREFORE, BE: rr RESOLVED by the City Council of the City of CUpertino as follr::MS: 1. That it is the conducting authority pursuant to section 56826 of the Government Code for the armexation of property designated "El Camino Hospital 85-5" , more particularly described in Exhibit "A" to the CUpertino Sanitary District. -1- RESOIIJTION NO. 6943 2. That the follr::Ming findings are made by the City COuncil of the City of CUpertino: a. That said territory is inhabited and comprises 54.04 acres. b. That that armexation is consistent with the orderly armexation of territory with the City's urban service area and is consistent with the City and District's policy annexing \<IDen providing City services. c. The City COuncil has completed an initial study and has found that the armexation of said territory has no significant impact on the envirornnent, and previously approved the granting of a Negative Declaration. d. The City Council on January 6, 1986 enacted an ordinance prezoning the subject territory to City of CUpertino P, B2 and A zones . e. That the territory is within the City urban service area as adopted by the IDeal Agency Fonnation Cammission. f. That the armexation is made subject to no tems and conditions except that prior to the recordation and filing of a notice of completion, the owners of the subject property shall pay to the CUpertino Sanitary District its standard armexation acreage fee. g. That the County surveyor has determined the boundaries of the proposed armexation to be definite and certain, and in compliance with the Cammission's road armexation policies. The City shall re:i1nburse the County for actual costs incu=ed by the County surveyor in making this dete=ination. h. That the proposed annexation does not create islands or areas in which it would be difficult to provide municipal services. i. That the proposed armexation does not split lines of assessment or ownership. -2- RESOIIJTION NO. 6943 3. All findings made by Resolution No. 6942 of the city Council of the City of CUpertino are incorporated herein. 4. That said armexation to the CUpertino Sanitary District is herby ordered without election pursuant to section 56837 et seq. of the Government Code. 5. That the Clerk of the city Council of the City of CUpertino is directed to give notice of said armexation as prescribed by law.
