OF THE ARCHITECTURAL AND SITE APPROVAL COMMITTEE
OF THE CITY OF CUPERTINO RECOMMENDING DENIAL OF
EXCEPTION TO SECTION 6.041 OF SIGN ORDINANCE NO.
353 PERMITTING INSTALLATION OF A GROUND SIGN ON
A LOT WITH LESS THAN 210 FT. OF LINEAR FRONTAGE
ON A PUBLIC RIGHT OF WAY.

STATEMENT OF FINDINGS:
Whereas, the Architectural and Site Approval Committee held a public hearing on
December 9, 1976 to consider the merits of Application HC -51,227.3, and
Whereas, Section 10.4 of the Sign Ordinance 353 of the City of Cupertino requires
the Architectural and Site Approval Committee to report to the City Council a
written finding of facts demonstrating whether the Sign Ordinance Exception
requested shall be in harmony with the general purpose of Ordinance 353, the
Architectural and Site Approval Committee finds as follows with respect to the
criteria contained in said Ordinance 353 at Section 10.4:
1) The exception to Section 6.042 of Ordinance 353 requested under
Application HC -51,227.3 is not in harmony with the general intent
of sign regulation in the City of Cupertino as that intent is
understood and interpreted by the Architectural and Site Approval Committee.
2) As provided in Section 10.4(a) of Ordinance 353, no special conditions
or extraordinary circumstances apply to the subject property or to
its intended use which would justify granting the requested Sign
Ordinance Exception.
3) As provided in Section 10.4(b) of Ordinance 353, literal enforcement
of Ordinance No. 353 will not result in unnecessary hardship to the
applicant inconsistent with the intent of Ordinance 353.
4) As provided in Section 10.4(c), Ordinance 353, the exception of
sign use corresponding with the use in the particular zone, and not
contrary nor detrimental to public interest and welfare, or injurious
to conforming signs in the City is not found by this Committee to be
an applicable criteria in evaluating the requested Sign Ordinance
Exception.
5) As provided in Section 10.4(d), Ordinance 353, the Architectural
and Site Approval Committee does not concur that, if the requested
exception is not granted, the subject property cannot yield a
reasonable return in service, use or income compared to other
conforming properties within the City.
6) As provided in Section 10.4(e), Ordinance 353, the requested
exception is not that which would require the least modification
of regulations prescribed in Ordinance 353.

7) The following subconclusions pertinent to Application HC -51,227.3
are reported:
a) The Committee finds that the applicant's intended use for
signing at the above -referenced address can be accomplished
within the constraints of Sign Ordinance No. 353, and that
an exception thereto is unnecessary.
b) The Committee recommends, with applicant's consent, approval of a
sign mounted on the fence adjacent to the driveway opening at the
north edge of the property identified as 10300 North Bubb Road.
The dimensions and mounting height of said sign shall conform to
the existing "Southland Corporation" sign already in place on
said fence. Copy content of this sign shall be limited to
company name, building number and street address only. Final
design of this sign shall be approved by staff at the building
permit level.
Now, therefore, be it resolved that after careful consideration of facts, exhibits,
testimony submitted by the applicant and tenants of the subject property, and other
evidence submitted in this matter, the Architectural and Site Approval Committee
hereby recommends that the City Council deny the requested Sign Ordinance Exception.
PASSED AND ADOPTED this 9th day of December, 1976, at the regular meeting
of the Architectural and Site Approval Committee of the City of Cupertino,
State of California, by the following roll call vote:
