8. All attempts shall be made to save the existing pepper tree located in
northeast portion of the development area.
9. That the applicant shall prepare a statement satisfactory to the City
Attorney and the City staff in which he shall recognize that the drive-
way is approved on a temporary basis and shall be removed at such time
as any portion of the subject parcel or the parcel to the north along
De Anza Boulevard develops. At that time, the applicant shall agree
to eliminate this driveway, replace the area with landscaping and
coordinate with the new development.
