A RESOIIJTION OF THE CITY' CXXJNCIL OF THE CITY' OF C!JJ:'u<l'IN0
INITIATING PROCEEDINGS AND SElTING THE TIME AND PIACE FOR
PUBLIC HEARING FOR OONSIDERATION OF ANNEXATION OF 1.105
ACRES ON UPlAND WAY SOO'IH OF RAINB:M DRIVE;
DESIGNATED "UPlAND WAY 86-02 (REVISED"
WHEREAS, the City Council of the City of CUpertino proposes to annex
the area designated ''Upland Way 86-02 (Revised;" and
WHEREAS, the property is contiguous to the city of CUpertino and is
within its urban service area; and
WHEREAS, armexation would provide for orderly and efficient delivery
of services to the adjacent property; and
WHEREAS, this 1.105 acres on upland Way south of :Ra:inbc:M Drive is a
public road, is uninhabited, and was prezoned on September 21, 1981; and
WHEREAS, the City of CUpertino, as Iead Agency for envirornnental
review completed an initial study and granted a Negative Declaration for
the annexation; and
WHEREAS, the development proposed for this territory is street
improvements during 1986; and
WHEREAS, the County surveyor of Santa Clara County has found the
revised map and description (Exhibits lOA" and "B") to be in accordance
with Government Code section 56826, the boundaries to be definite and
certain, and the proposal to be in compliance with IAFCO's road annexation
policies; and
WHEREAS, the fee set by the County of santa Clara to cover staff costs
for above certification has been paid; and
WHEREAS, as provided in Government Code section 56826 the City Council
of the City of CUpertino shall be conducting authority for a
reorganization including an annexation to the City; and
WHEREAS, any r::Mner within the territory proposed to be annexed may
file a written protest against the armexation with the city Clerk at any
time prior to the hearing on the proposed annexation;

NOO, 'mEREFORE, BE: rr RESOLVED, that the city Council of the City of
CUpertino hereby sets 6:45 p.m., November 17, 1986, city Hall COuncil
Chamber, 10300 Torre Avenue, CUpertino, California as time and place to
conduct a public hearing to consider armexation of territory designated
IIUpland Way 86-02 (Revised)."

All that real property situate in the County of Santa Clara, State of
california, being described as follows:
Being a portion of Upland Way, as shown upon that certain Map entitled 'Tract
No. 492 Marquette Heights Subdivision' recorded March 22, 1948 in Book 18 of
Maps, pages 4 and 5, also being a portion of Rainbow Drive and Bubb Road, as
shown upon that certain Map of Tract 3281, recorded in Book 155 of Maps, pages
28 and 29, Santa Clara County Records: and being morE particularly described as
follows:
BEGINNING at the southeasterly corner of Upland Way, hereinabove described,
said point of beginning also being in the Westerly line of the existing City

left from a tangent which bears North 200 24' East, having a radius of
170.00 feet, through a central angle of 200 40', an arc length of 61. 3 2
feet; thence continuing along said city limit line the south 890 06' East
10.06 feet to a corner of said annexation in the westerly line of Bubb Road
(40.00 feet wide); thence along the most Easterly city limit line established
in said Bubb No. 2 annexation, North 000 09' 28' East 60.00 feet to a
Northeasterly corner of said annexaction in the most southerly line of that
certain annexation to the city of cupertino entitled 'Regnart 63-4', described
and adpoted under cupertino ordinance No.291; thence along said most Southerly
line of said Regnart 63-4 annexation, south 890 ·06' East 20.00 feet to the
Southeast cOrner of said Regnart 63-4 annexation in the centerline of Bubb
Road in a Westerly city limit line of that certain 1.04 square mile annexation
to the· city of cupertino entitled, 'San Jose/Cupertino Municipal
Reorganization', descrihed and adopted under cupertino Ordinance No. 924;
thence along said westerly City limit line of said annexation described under
ordinance No, 924 being the centerline of Bubb Road shown o~ the Map for Tract
NO, 3281, recorded in Book 155 of Maps at pages 28 and 29, santa Clara County
Records, South 000 09·' 28' West 60,00 feet to the Northwest corner of said
Seven springs 80-17 annexation; thence along West line of said Seven springs
80-11 annexation, South 818.46 feet to the said point of beginning of this
description and containing 1.105 acres of land, more or less.
