A RESOIIJTION OF THE CITY' CXJONCIL OF THE CITY' OF OJEISKJ.'.LÑO
INITIATING PROCEEDINGS AND SEITING TIME AND PlACE FOR
roBLIC HEARING FOR CONSIDERATION OF ANNEXATION OF 1. OO±
ACRES IDCATED ON THE WEST SIDE OF saJIH STELLING ROAD
BEIWEEN RAINB:M DRIVE AND WATERFORD DRIVE;
AREA DESIGNATED "saJIH STELLING 86-03"
WHEREAS, the City Council of the City of CUpertino has received a
request for armexation of territory designated "South Stelling 86-03" from
property owners, Michael and Gloria Cheshaek; and
WHEREAS, the property, 1. 00 acre on the west side of S. Stelling Road
between Rainbow Drive and Waterford Drive, is contiguous to the city of
CUpertino and is within its urban service area; and
WHEREAS, armexation would provide for use of City services; and
WHEREAS, this territory is uninhabited and was prezoned on September
21, 1981; and
WHEREAS, the City of CUpertino, as lead Agency for environmental
review completed an initial study and granted a Negative Declaration for
armexation; and
WHEREAS, the proposed development is a tract of four (4) single-family
dwellings with construction set to start in March, 1987; and
WHEREAS, the County surveyor of Santa Clara county has found the map
and description (Exhibits lOA" and "B") to be in accordance with Government
Code section 56826, the boundaries to be definite and certain, and the
proposal to be in compliance with IAFO:>'s road annexation policies; and
WHEREAS, the fee set by the County of santa Clara to cover staff costs
for above certification has been paid; and
WHEREAS, as provided in Government Code section 56826 the City Council
of the city of CUpertino shall be conducting authority for a
reorganization including an armexation to the City; and

WHEREAS, any r::Mner within the territory proposed to be annexed may
file a written protest against the armexation with the city Clerk at any
time prior to the hearing on the proposed armexation;
NCM, 'mEREFORE, BE: rr RESOLVED, that the City Council of the City of
CUpertino hereby sets 6:45 p.m., November 17, 1986, City Hall Council
Chamber, 10300 Torre Avenue, CUpertino, California as time and place to
conduct a public hearing to consider armexation of territory designated
IISouth Stelling 86-03."

All that certain real property situate in the County of Santa Clara,
State of California, more particularly described as follows:
All of that certain parcel of Lands of Oscar Urban as shown on the
Record of Survey filed for record in Book 216 of Maps, at Page 26,
Santa Clara County Records;
Beginning at the northeast corner of said Lands of Urban, said corner
being contiguous to the boundary of the San José-Cupertino Reorganization
effective July 1, 1979;
Thence South, 124,21 feet along said reorganization boundary to'the south-
east corner of said Lands of Urban;

Thence S 89 49' 00" W,329,31 feet along said reorganization to the south-
west corner of said Lands of Urban;
Thence N 190 03' 00" W, 131. 26 feet along that certain annexation to the'
City of Cupertino entitled "Seven Springs 80-17" to the northwest corner
