MINUTES OF THE REGULAR MEETING OF THE ARCHITECTURAL AND SITE APPROVAL
COMMITTEE HELD ON NOVEMBER 6, 1975 IN THE COUNCIL CHAMBERS, CITY HALL,
CUPERTINO, CALIFORNIA

INFORMAL REVIEW OF PLANNED DEVELOPMENT USE PERMIT APPLICATION:
9-U-75 Home Federal Savings and Loan: Construction of a two-story
banking facility located at the southeast quadrant of Stevens
Creek Boulevard and Wolfe/Miller intersection.
After discussion and study of proposed plans, the following concerns
were noted:
...10 ft. setback on Miller Avenue
...Trees on east edge of development
...Question on signing in general for entire parcel
...Compatability of proposed architecture with other architecture
in the area
...Placement of drive -up facilities
...Member Sallan felt landscaping should be included along parking
stalls between this site and the adjacent site and provisions
for it be provided at this time.

Page 4, paragraph 6, the last line should read "...satisfaction so that
possible excessive intensity could....".
On page 6, third paragraph from the bottom should read as follows:
"Member Sallan said she felt the entire project, including Coco's, was
approved for one sign. Individual wall signs will give identity since
they are not that far from the street. In answer to Mr. Sher's
comments on McClellan Square, she said the committee is seeking a
direction that will have shopping center name represent a significant
portion of overall ground sign."
On page 11, last paragraph should read: "Chairman Koenitzer asked if
the small building in Rifredi's parking area was in Cupertino. He
reported the newspaper stands and a sign made it impossible to walk
on the sidewalk. in front of the small building."
Member Sallan moved, seconded by Member Irvine, to approve the Minutes
of October 23, 1975 as corrected.

HC -51,075.40 1. Application HC -51,075.40 - Vallco Park, Otd. requesting approval
Vallco Park of lighting for the J. C. Penney Company located easterly of
for Wolfe Road and northerly of Vallco Parkway in the Vallco
J. C.Penney Regional Shopping Center.
Staff report: Assistant Planner Kramer reviewed lighting plan approved•
for the entire Regional Shopping Center. J. C. Penney would like to
modify the lighting scheme on the east side of Wolfe Road to allow a
minimum footcandle reading of 1½ rather than the 2 footcandle average
that exists at Bullock's now. In order to do this, they would like to
use 45 ft. poles rather than the 34 ft. poles so that they would have
less poles on the site. They would use the same lighting fixture and
the same high pressure sodium bulb.

Ms. Kramer referred to two exhibits showing placement of poles and
number needed for 34 ft. poles and for 45 ft. poles.
Staff recommended that the 34 ft. high poles be used and the applicant.
be allowed to utilize the 112 footcandle illumination intensity in the
parking area since it would not affect neighboring properties.
Mr. Bill Tagg, representing Vallco Park, explained Penney's had a
policy of using 1% footcandle illumination in their parking areas.
Mr. Harry Wilson, J. C. Penney representative, said most of their
projects these days were in shopping centers. As a result of their
experiences, they had developed a standard lighting program which was
to use 12 footcandles to provide public safety. Their insurance and
operations staff are concerned with anything less than 12. He said
they have had considerable success with this criteria.
Mr. Wilson answered Chairman Koenitzer that this will be the first
time they have used the high pressure sodium bulb.
In answer to Member Dressler, Mr. Wilson said the use of fewer and
taller poles would be an energy conservation measure. He referred
to exhibit showing illumination patterns.
Mr. Tagg said during the daytime there would be fewer poles to be
seen and at night, people did not notice what the height of the pole
was. At 45 ft. there would be less glare.
Member Sallan spoke to the fact that this was a planned development
and as such, the lighting had been approved. Mr. Wilson explained
that Penney's was not legally "in" yet so was not involved with the
lighting as it pertained to Bullock's. He reiterated Penney's
standards for lighting.
Member Sallan said since this is a planned development and they have
been faced many times with modification requests, she did not feel
the height of the poles was necessary and since the intensity was
apparently satisfactory for the other side of the street, she would
need more data to warrant allowing Penney's to have a higher intensity.
Mr. Wilson said one claim against the store is enough to justify the
higher intensity.
Member Sallan expressed concern over having lighting of one intensity
on one side of the street and another intensity on the other side
with regard to the overall visual impression.

Mr. Tagg said there would not be a blinding difference in the lighting.
Penney's would be using much better fixture and he did not feel the
request was unreasonable. He answered Member Sallan that he was not
in on negotiations so could not say why Penney's had not been included
in previous discussions.
Member Irvine said he was in agreement with the 112 footcandles. As an
architect, he always used 12 to 2 ft. in his planning.
Member Grubb said he went along with the staff's recommendation of
34 ft. poles and 12 footcandles. He felt this was a logical solution.
Mr. Tagg gave measurements of illumination taken at Bullock's parking
area with the 2 footcandle.
Chairman Koenitzer pointed out that Bullock's lighting was bright
because of the sodium lamps. The meter does not read the same as
visual effectiveness. He did not feel the criteria for Bullock's
lot would not be as effective for both sides of the street and did
not see any reason for higher intensity or higher poles.
Member Sallan pointed out the differences in grades and suggested
pole heights might be determined according to grade elevation so
that the tops of the poles would be level.
It was agreed by the applicant that they would rather have the higher
intensity than height or number of poles.
Member Dressler spoke to possibility of varying pole heights to accomo-
date variation of grade. Mr. Wilson said the economics of doing this
would be impossible as each pole would have to be of a different length.
Also spacing of each pole would be different.
The hearing was opened for public comment. There were none.
Member Irvine said he had not seen the site and suggested continuing
this application or going to actual site to discuss it. He wondered
if anyone actually knew what was meant by 12 footcandle.
Member Sallan noted that what was there now was doing a satisfactory
job and was less than 12 so what would be the point of changing.
Chairman Koenitzer agreed, adding that Bullock's was also concerned
with the safety of their patrons and employees and felt this was
adequate.

Member Sallan moved to close Public Hearings. Seconded by Member
Dressler.
Member Dressler noted that Penney's would like 112 footcandle and he
.is not opposed to that. He was opposed to the taller poles. He was
especially concerned about the poles on the 17 ft. elevation.
Member Sallan agreed about the height of the poles and felt the idea
of lower poles on the higher grade should be considered. She had
concerns about the footcandles. She was inclined to say no to both
requests and explore the possibility of lower poles on the higher
elevations.
Member Irvine said he had not seen the site so could not comment
further.
Member Grubb said he personally preferred higher and fewer poles so
would stay with staff recommendation. He considered getting too
many poles would interfere with getting aesthetic value. Lower poles
would mean more poles.
Chairman Koenitzer said he did not see any reason for higher poles or
higher intensity.
Chairman Koenitzer asked if the applicant would object to a continuance.
Mr. Wilson said since there wouldnot be any further input he did not
think a continuance would be advantageous, and would delay further
getting their project open.
At Mr. Wilson's request, Member Dressler moved, seconded by Member
Sallan, to reopen Public Hearings.
Motion carried, 5-0
Mr. Wilson said it had been suggested to study for lower poles with
12 footcandles. He said the parking lot arrangement would have to
change and car stalls then might be affected.
After further discussion, Member Sallan moved to close Public Hearings.
Seconded by Member Dressler.

Member Sallan moved on Application IIC-51,075.40, Vallco Park, Ltd.
that the request for modification to J. C. Penney's facility with
regard to increasing from 34 ft. to 45 ft. poles and from iz to 1½
footcandles average minimum intensity be denied. What is approved
would be the continuation of lighting program for J. C. Penney's
facility as exists on the Bullock's and Sears facility that has
already been approved by this committee. Seconded by Chairman
Koenitzer.
AYES: Member Sallan and Chairman Koenitzer
NOES: Members Dressler, Grubb and Irvine
Motion failed, 2-3
Member Irvine moved to approve Application HC -51,075.40, Vallco Park,
Ltd. with the 34 ft. poles and 12 footcandles. Seconded by Member
Grubb.
Member Sallan reiterated she did not have sufficient evidence to feel
comfortable with 1z footcandles. She also felt criteria should apply
to every development in City without modifications to satisfy individual
developers. There was further discussion on reducing the height of the
eight poles on the higher elevation.

Motion carried, 3-2
Chairman Koenitzer noted the application had been approved and would be
heard by the City Council at the November 17, 1975 meeting.
NEW BUSINESS:
Portal Plaz Assistant Planner :ramer reported on City Council action regarding
landscaping landscaping at Portal Plaza shopping center. The committee expressed
their concern that their Minute Order had not received more considera-
tion. It was felt a letter should have been required of Standard Oil
Company.

Chairman Koenitzer reported underground utilities had been approved for.
another district to include Bollinger Road to McClellan Road. There
would be no poles on Saratoga -Sunnyvale Road.
There was another request that the "temporary" backboard in the Council
Chambers be removed and replaced with something more aesthetically
pleasing.

Ms. Kramer reported the Sign Ordinance would be considered on
November 13, 1975 and a draft forthcoming to the entire committee.
ADJOURNMENT
At 9:30 p.m. Member Dressler moved to adjourn the meeting to the
next- regular meeting on November 20, 1975 at 7:00 p.m. Seconded
by Member Sallan.
