CC Resolution No. 7033 RESOLUTION NO. 7033 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO ORDERING VACATION OF A PORTION OF PUBLIC UTILITY EASEMENT WITHIN THE CITY OF CUPERTINO, LOT 61, TRACT NO. 2014 WHEREAS, Hearing on Resolution of Intention NO. 7028 was held on December 9, 1986, at a regular meeting of the City Council at 1030C Torre Avenue, Cupertino, California; and WHEREAS, it appears that notice thereof was duly given as required by law; and WHEREAS, from the evidence presented, both oral and documentary, it appears to be to the best interest of the City to vacate the hereinafter described portion of public utility easement; that said portion of said public utility easement is unnecessary for present or prospective public purposes; NOW, THEREFORE, BE IT RESOLVED: 1. That all or any protests against the vacation of said portion of public utility easement be and hereby are overruled and denied; 2. That that certain portion of public utility easement described and shown in Exhibits "A" and liB" attached hereto and made part hereof, be and hereby is vacated. BE IT FURTHER RESOLVED: That the city Clerk be and hereby is instructed and directed to cause a certified copy of this resolution, attested to and sealed with the official seal of the City, to be recorded.with the County Recotder cjf the Coun~y cjf Santa Clara, California, forthwith. Description: Being a portion of a public utility easement over the most northerly ten feet (10'), measured at right angles, of that certain Lot 61 of Tract 2014 filed for record in Book 93, Page 29, Santa Clara County Recorder. Said portion being more particularly described as follows: A strip of land five feet (5') in width, measured at right angles, said strip being the southerly five feet (5') of the northerly ten feet (10') of said Lot 61. Excepting the westerly two feet (2') of said strip.
