A RFSOImION OF '!HE CITY CXJUNCIL OF '!HE CITY OF ŒJt'~·.LI'IO
INITIATING PROCEEDllIGS FOR ANNEXATION OF 1. 72± ACRE LOCATED
ON THE NORIH SIDE OF ~ DRIVE BEIWEEN ~ DRIVE
AND STELLING ROAD (APN 362-10-3) DESIGNATED
,,~ DRIVE 87-01"
WHEREAS, the city Council of the city of CUpertino has received a
request for annexation of territo:ry designated "Rainbow Drive 87-01" from
property owners, Reinhold V. Besler and Pauline P. Besler; and
WHEREAS, the property, 1. 72± acre on the north side of Rainbow Drive
between Weyrnoth Drive and Stelling Road (APN 362-10-3) is contiguous to
the city of CUpertino and is within its UJ:ban service area; and
WHEREAS, annexation would provide for use of City services; and
WHEREAS, this territo:ry is uninhabited and was prezoned on September
21, 1981; and
WHEREAS, the City of CUpertino, as Lead Agency for environmental
review cœpleted an initial study and granted a Negative Declaration for
annexation; and
WHEREAS, the proposed
single-family residential,
and
development is a seven-lot subdivision,
with construction set to start in April, 1987;
WHEREAS, the County Surveyor of Santa Clara County has found the map
and description (Exhibits "A" and "B") to be in accordance with Government
Code Section 56826, the boundaries to be definite and certain, and the
proposal to be in cœpliance with lAFCO's road annexation policies; and
WHEREAS, the fee set by the County of Santa Clara to cx:Ner staff costs
for above certification has been paid; and
WHEREAS, as provided in Government Code Section 56826 the City Council
of the City of CUpertino shall be conducting authority for a
reorganization including an annexation to the City; and
WHEREAS, Government Code section 56837 provides that if a petition for
annexation is signed by all owners of land within the affected te=ito:ry
the city Council may approve or disapprove the annexation with public
hearing;
RESOIIJTION NO. 7106
NOO, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Cupertino hereby initiates annexation proceedings and will consider
annexation of the territory designated "Rainbow Drive 87-01" at their
regular meeting of April 20, 1987.

All that certain real property situate in the County of Santa Clara, State of
California, more particularly described as follows:
Beginning at a point on the center line of Rainbow Drive, from
which a granite monument standing at a point where the center
line of said Rainbow Drive intersects the center line of Stelling
Road bears N 89° 24'E, 969.87 feet; said point also being at the
intersection of those certain annexations to the City of Cupertino
entitled, "Seven Springs 80-[7" and the "San Jose-Cupertino
Reorganization" of July 1, 1979;
Thence N 0° 26'W, 500 feet along said "San Jose-Cupertino
Reorganization";
Thence parallel with said center line of Rainbow Drive N 89° 24'E,
150 feet along said reorganization;
Thence S0026'E, 500 feet along said reorganization to a point
in the center line of Rainbow Drive which intersects with said
annexation "Seven Springs 80-[7";
Thence along said center line S89°24'W, 150 feet along said
"Seven Springs 80-[7" to the point of beginning.
Containing: 1.72 acres, more or less.
