APPROVAL COPll'[ITTEE HELD ON OCTOBER 24, 1974 IN THE COUNCIL CHAMBERS,
CITY HALL, CUPERTINO, CALIFORNIA

The meeting was called to order at 7:11 p.m. by Chairwoman Sallan
with the Salute to the Flag.

INFORMAL REVIEW OF PLANNED DEVELOPMENT USE PERMIT APPLICATION:
28-U-74 Anthony Musolino: Construction of six single-family
units located adjacent to and westerly of Miller
Avenue at the southwest intersection of Miller Avenue
and Calabazas Creek approximately 120 feet northerly
of Greenwood Court.
The Assistant Planner reported this review had been postponed as
modifications were being made to the plans.
Ms. Kramer said Mr. Merritt Sher of Coco's was present. It had been
understood the entire development would be built at one time; how-
ever only Coco's will be installed at this time, and the exhibited
proposal was being offered for H -Control approval.
Member Koenitzer expressed concern that development should be
finished without waiting for 3 to 5 years which would defeat
.purpose of planned development. Ms. Kramer said there is a plan
for the entire development, and they will make sure the City gets
amenities as quickly as possible. She explained what would be
built at this time, referring to displayed exhibit.
The trees will be planted along back of property now without irriga-
tion system. The irrigation system will be installed at time of
construction of Phase II. She referred to letters in packet from
Engineering firm and Mr. Sher described what would be done.-

Weinstein that the reason for only building Coco's was the tight __________________ -=
financing market and it hasn't proven feasible to go ahead with
stores at this time. He noted they will be undergrounding utilities
and landscaping 175 ft. There might be requests for minor modifica- --
tions depending on requirements of eventual tenant but basically =

With regard to discussion on unbuilt portion, Member Koenitzer
suggested putting a fast growing rye in the area until building
is done,
Mr. Richard Tanaka, 18 N. San Pedro St., San Jose, said rough
grade was being proposed; this meant compaction to 90% so there
would not be any growth on it and the liquid asphalt topping would mitigate
dust factor. The liquid asphalt topping would look-
topping.
In answer to Member Weinstein, Mr. Tanaka said topping was oil
and water and would get hard in about a week.
______________ In answer to Member Rogers Mr. Tanaka said when building went in
the area would have to bn rot9tilled and loosened before landscaping,
but would not be harmed by the liquid asphalt. —_
With reference to a neighbor's concern about pine trees in back,
Mr. Slier said he would be meeting with one of them. The trees
• would be planted 12 ft. from Clay Street property line.

It was noted that approval for development had been given.
After discussion regarding the placement of ground covering under
the pine trees, the committee agreed this would not be necessary. _-

Member Weinstein said his idea of Planned Development had just
collapsed and gave his reasons for so feeling. Mr. Sher noted
this was better than cutting site down middle. The Assistant
Planner pointed out any modification would be subject to this
committee's review.

Staff report: The Assistant Planner located site and described the
surrounding area. She pointed out the main items of concern to this
committee are the location and intensity of the lights, the removal
of existing trees on the property, the ratio of parking, the size
of garages and the setback of the fences on Finch Avenue.
It was noted that parking areas near Units 24 and 18 were adjusted
to save three trees.
There is a common open area planned to contain a pool as shown on
Exhibit A 1st Revision. The applicant has not determined for sure
there would be a pool as the cost would have to be absorbed by
owners; this would have to come back to committee to get approval
before building pool.
Concern had been expressed as to the possibility of high school
students walking from Greenwood Drive through the open area to the
high school along the fire access. A break -away fence across the
fire access area and the parking lot which would have a gate to
allow the residents to walk through had been suggested.
The Assistant Planner pointed out light poles as located on plans.
Also the directory type signing,displaying exhibit.
In answer to Member Weinstein, Ms. Kramer pointed out site #16
referred to in Mr. Najima's letter.
Slides were shown of the site and the Mulberry and Silk trees which
could not be saved.
Mr. Martin L. Hall, 1627 Hollenbeck, Sunnyvale, said this was not a
typical Makay development. The homes are all complete individual
homes with no attachments.
With regard to the swimming pool, Mr. Hall said because of the high
cost of this item, the project could not be developed as planned if
included. He did not believe it was necessary since the high school
play area was just across the street.
SITE:
In answer to Member Koenitzer's question regarding access for the
garbage trucks, Mr. Roger Griffen, 10211 Bubb Road, Cupertino,
said the trash company vehicles would enter into project. The
roads will be paved to City standards. He located and described
the trash enclosures.

ARCHITECT:
Chairwoman Sallan noted the- sethack on Finch Avenge -is only 20ft. and
the two story is approximately 24 ft. to peak of roof. She asked
about flexibility to change one and two story units. Mr. Griffen
pointed out there are no two story units to perimeter of property.

Chairwoman Sallan asked Ms. Mogensen to go through landscaping
approach on Finch Avenue.
Ms. Mogensen said she was willing to change pines to Liquidambar as
requested by Mr. Najima. Chairwoman Sallar noted the Liquidambar
would be bare in the fall. Ms. Mogensen said there was a variety

noenitzer said along here he would like an evergreen tree of some
kind, Member Weinstein suggested a :Magnolia Grandiflora.
Chairwoman Sallan pointed out most -of the fence would -he seen. She
_ was uncomfortable with this. Ms. Mogensen said this was a very

It was ascertained 15 gallon trees would be planted on Finch
Avenue.
With regard to substitutes for the Mulberry and Silk trees, Ms.
Mogensen said any of the trees on site could be used.
LIGHTING:
In answer to Member Dressler, Mr. Griffen described the post and
wall mounted lamps, referring to exhibits.
SIGNING:
Mr. Griffen located where directory sign for main aspect of project
would be located. The smaller signs giving addresses to each unit
would be located at entrances to each mall. He answered Member
Rogers that the directory sign would not be installed until after
a determination had been made regarding recreation facilities.
Chairwoman Sallan reiterated her concern about landscaping in front
of fence.
Mr. Masao Najima, 10355 Finch Avenue, Cupertino, said he had
operated a nursery business here for twenty years. He wanted to
discuss pros and cons of trees for Finch. He described character-
istics of both Magnolia and Liquidambar trees. The large Magnolia
is very messy. The ground is full of Oak root fungus to which
Liquidambar tree is immune.
The meeting was opened to comments from the public. There were
none.
Member Dressler asked if there was a way to stipulate tree size
other than gallon. Mr. Najima said the 5 gallon size were those
3 to 5 years old and lgallon were 5 to 8 years old. He preferred
the 5 gallon to 15 gallon. The younger trees will take off
better and will be better shaped generally. There is a difference
in ground size of one year and cost for larger size is 3 times as
much.
Chairwoman Sallan then recapped application discussion.

heard by the City Council at its November 4,1974 meeting.
At 9:00 p.m. a recess was called, with the meeting reconvening a
9:10 p.m. Member Dressler left during the recess.

Staff report: The Assistant Planner noted the applicant had not
been present at last meeting so application had been continued.
She displayed plan showing proposed signing. The sign cans will
be the same size, just replacing Russell's with Monson's. The
signs will be white background with red letters.
Slides were shown of site and the two signs being changed.
Ms. Kramer answered Member Rogers that pole signs are internally
lighted as are other signs in center.
Member Weinstein commented having white background would make sign
appear brighter. The committee agreed that proposed sign would be
of higher intensity than what is there now. Member Koenitzer also
liked lettering on Russell's better than proposed block letters.
Mr. Lyle Smith of Golden West Sign Company said there are existing
signs in the center with white background and red letters. They
are not proposing to change size, just copy and reversing colors.
Member Weinstein said the problem is the brightness. He asked if
the red and white could be dimmed by using darker red and off-
white background.
Chairwoman Sallan suggested they take a continuation on application
to redesign sign, taking into account the preference of the committeE
Mr. Smith asked if Member Koenitzer wanted script rather than block
letters. Member Koenitzer explained it is a big sign and block
letters didn't seem to have any character or aesthetic appeal.
Mr. Smith said the reason for using block letters was readability.
Mr. Smith said they would like to avoid delay of a continuation.
He asked for clarification on color control. Chairwoman Sallan
said the committee has responsibility for aesthetics and color
comes in this area.
After discussion with client, Mr. Smith said they would like a vote.
The meeting was opened to comments from the public.
Mr. Frank Mulkern, 2800 Homestead Road, Cupertino, said this was an
example of what the Chamber of Commerce is fed up with - the objec-
tion to color and type of lettering. He did not believe this is
their responsibility or that they have control of color unless it
is outlandish. He personally felt his answer would be to have vote
and appeal to City Council. The comments made are entirely subjec-
tive. It irritated him and he wanted the minutes to so reflect.
Mr. Dennis Monson, 10881 Blaney Avenue, Cupertino, said Ralph's
and Safeway are red and white signs; why can't a small independent
business have one.

with reduction of intensity through use of different white and red
shades.
Chairwoman Sallan read No. 3, page 10, item D of sign ordinance
which deals with area of jurisdiction. This is the sign proposed
to committee and they have to make judgment.
Mr. Monson said the customers can't understand why a simple name
change can't be made. He could have had 100 customers here. He
pointed out the bulbs have been out on sign for two years.

Member Koenitzer then moved to recommend approval of the Monson
application with the condition that the color of sign be #2146
ivory background with #2380 rust letters and that the letters be
something besides plain block letters. Seconded by Member Rogers.

3. Application HC -51,337.1 of Adobe Inn requesting approval of
landscaping for a restaurant facility located on the south
side of Stevens Creek Boulevard west of Blaney Avenue
adjacent to the Customhouse Restaurant.
Staff report: The Assistant Planner gave background of application.
The areas of particular concern to the committee were the eastern
and western boundary of the property and the area along the Stevens
Creek Boulevard frontage.
Some planting has been installed on site. She referred to property
in back that will be developed at later date. She also pointed out _
parking is at minimal number now.
Chairwoman Sallan questioned easterly boundary, noting there was no
additional landscaping.
Mr. Frank Conley, Adobe Inn, said in order to compensate for cars
they wanted to put planters similar to planter around sign. He
said they had redone the planter on northwest corner and since then
customers have knocked off two top tiers with bumpers. They will
have the same problem on other corner. He described changes being
proposed.
Chairwoman Sallan said the problem is that from the City's viewpoint,
they need landscaping on Stevens Creek Boulevard.
Mr. Conley said their type of business needs cars in front to attrac
other customers, but if he had room to put in landscaping he would.
There isn't room in front or eastern side for landscaping.
In answer to Chairwoman Sallan regarding tree wells on easterly
side, Mr. Conley said the property behind would be improved and
parking area added. He explained what they want to do in the future
but can't do now financially. He said professional people had told
him any landscaping in front or on eastern side would have to be
replaced in a week. He pointed out the big lot doesn't belong to

them; it belongs to Customhouse. The big field on the other side doesn't ---

Member Weinstein said he empathized with business problems, but -Stevens
Creek Boulevard demands some type of landscaping. There must be some
type of landscaping that would provide greenery but will not screen
business.

Mr. Conley said they have spent $15,000.00 trying to beautify the City.
Member Rogers asked if it would be feasible to suggest that applicant
work with staff on two corner areas. Chairwoman Sallan said they should
specify what is wanted.

4. Application HC -51,342.2 of Advance Coiffures (Mrs. Liebmann)
requesting approval of a sign plan for a commercial develop-
ment located at 19610 Stevens Creek Boulevard.
The applicant was not present. Moved by Member Koenitzer, seconded
by Member Rogers, to move to end of agenda.

5. Application HC -51,006.1 of Louis Romano requesting approval
of site, architecture, landscaping and grading for a duplex
located on the east side of Stevens Canyon Road between
McClellan Road and St. Andrews Road.
Staff report: The Assistant Planner noted that most problems in
staff report have been discussed and worked out. In regard to archi-
texture, a mixture of tile and shake roofs has been proposed.

Mr. Louis Romano, 4895 Kingsridge Road, San Jose, answered Member
Rogers comment that people in smaller unit of A don't have much
yard by pointing out they have front and side area since it is a
corner unit.
Member Koenitzer noted fence does not go all the way to driveway.
He felt this area could be added to the small units' backyard.
SITE:
Slides were shown of site and general area located.
ARCHITECTURE:
Member Weinstein commented the right elevations will be most visible
and are most bland. He suggested turning the plans around. Ms.
Kramer said the driveways had to be oriented to McClellan Road and
St. Andrews Road. Mr. Romano explained how elevation would be
buffered with landscaping.
Member Koenitzer ascertained the applicant would be willing to use
all shake roofs.

Member Rogers clarified that oleanders on Stevens Canyon Road would be

REVIEW OF CHANGE OF COPY OF SIGN FACE:
6. Kenneth C. DuClair (Red Boar) requesting change of copy of
an existing sign located at 10095 Saich Way.
Staff report: The Assistant Planner located site and displayed
proposed sign.
Slides were shown of the building and other signs in center.
Mr. Kenneth DuClair, 10095 Saich Way, Cupertino, said the Red Boar
was a cocktail bar. The background for sign is white with red
letters trimmed in black.
Member Weinstein ascertained the sign is 2' x 15'. Member Rogers
ascertained the sign will be illuminated.
Member Koenitzer said part of letters seem to be out of proportion
to size of sign. He would like to see smaller letters.
The meeting was opened to comments from the public. There were none.
Member Rogers moved, seconded by Member Koenitzer, to close Public
Hearing.
Motion carried, 4-0
Member Rogers moved to approve change of copy of sign face for Red
Boar as. Kenneth DuClair has presented. Seconded by Member Koenitzer.
Motion carried, 4-0
4. Application HC -51,342.2 - Advance Coiffures
The applicant still was not present. Ms. Kramer noted the sign is
in Brentwood Shopping Center. It has been agreed to work out a
new sign plan for shopping center including ground sign and are
trying to coordinate existing with new plan.
