OF THE ARCHITECTURAL AND SITE APPROVAL COMMITTEE OF THE CITY OF
CUPERTINO APPROVING AN EXCEPTION TO THE SECOND STORY SIDEYARD SETBACK
REQUIREMENT IN ORDINANCE 1438 FOR A NEW SINGLE FAMILY RESIDENCE TO BE
CONSTRUCTED.

The Architectural and Site Approval Committee finds as follows with regard to
the subject application:
1) The triangular shaped lot presents a hardship because the applicant has
only one side yard, making it necessary to apply the required 30 foot
setback that is typically distributed between two side yards to only one
side of the house.
2) The proposed twenty foot side yard is not inconsistent with setbacks of
other single family residences in the neighborhood.
3) The flag lot is well screened from the surrounding neighborhood, and
the new residence will not be highly visible.
PASSED AND ADOPTED this 12th day of December, 1988 at a regular meeting of
the Architectural and Site Approval Committee of the City of Cupertino, State
of California, by the following vote:
