PROPERlY LOCATED AT '!HE NORI'HWEST CDRNER OF RaJIE 280 AND WJLFE ROAD
WHEREAS, the city Council, on November 3, 1986, adopted Resolution No.
7012, order~ vacation of a certain storm drain easement on property
located at the northwest corner of Ra.1te 280 ani Wolfe Read, resolution to
be recorded upon installation of bypass facilities, which prcx::ess has not
yet been finalized; ani
WHEREAS, with the approval of the agencies involved, a public service
easement, which includes the afo1.o!i\u=i1tioned storm drain easement, more
particularly described in description ani map attached hereto ani made a
part hereof as Exhibits "A" ani "B", is deemed unneoessaJ:y for present ani
prospective use; ani
WHEREAS, the city Council elects to p1:oce..l pn:suant to Section 50430
et seq. of the GovenmIent Code of the stats of California; ani
WHEREAS, it is in the p.¡blic interest that the City Council initiates
the vacation of said easement;
MOO, ~~, BE IT RESOLVED, that the City Council hereby rescinds
Resolution No. 7012, ani hereby declares its intention to vacate a portion
of the aforesaid public service easement.
BE IT FURI'HER RESOLVED:
1. '!hat the 18th day of May, 1987, at 6:45 p.m., in the interim
Council Chamber, 10500 N. DeAnza Boulevard, CUpertino, California is the
time ani place fixed for hearin;J on the above proposed vacation;
2. '!hat the aforesaid date is not less than 15 days fran passage of
this resolution pn:suant to law;
3. '!hat the City Clerk shall cause a certified copy of this
resolution to be p.¡blished in the manner prescribed by law, ani shall
cause certified copies to be posted alon; ' the line of said property
proposed to be vacated at least 10 days before the date of hear~ ani no
more than 300 feet apart with a minimum of 3 be~ posted.

to be Abandoned
THOSE certain easements situate in the City of Cupertino, County of Santa
Clara, State of California described as follows:
Portions of those certain pub1 ic service easements described in deeds
recorded October 14, 1960 in Book 4950 of Official Records at page 447,
Santa C1 ara County Records and March 14, 1960 in Book 4727 of Offi ci a 1
Records at page 336, Santa C1 ara County Records for the i nsta 11 at i on
replacement, maintenance and use of potable water, storm water and
sanitary sewage pipelines said easements being 10 feet and 8 feet in width
respectively, more particularly described as follows:
BEGINNING at the Northwesterly corner of Parcel 2, as said parcel is shown
on that certain Parcel Map recorded December 30, 1986 in Book 569 of Maps
at pages 41 and 42, Santa Clara County Records, thence along the Westerly
line of said Parcel 2 South 00'17'32" East 136.95 feet to a point in the
Northerly line of that certain 8 foot wide public service easement as
described above, thence along said Northerly 1 ine North 89°44'39.5" East
20.94 feet to the TRUE POINT OF BEGINNING; thence continuing along said
Northerly line North 89°44'39.5" East 443.67 feet; thence leaving said
Northerly line South 16°09'13" West 18.76 feet to a point in the Southerly
1 i ne of the herei nabove descri bed 10 foot wi de pub 1 i c servi ce easement;
thence along said southerly line South 89°44'39.5" West 407.61 feet;
thence leaving said southerly line North 59°55'18" West 35.64 feet to the
True Point of Beginning and terminus of this description.
