RESOLUTION NO. 1379
OF THE ARC[ILTECIURAL AND SITE APPROVAL ccMMI I'EE
OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF
SITE, ARCHIITECIUPE AND LANDSCAPING FOR A 40,000 SQ. FT.
INDUSTRIAL BUILDING EXPANSION
APPLICANT: 51,782.1 AND 14 -EA -88

The Architectural and Site Approval Committee finds as follows with regard
to this application:
1. The Architectural and Site Approval Committee finds that the proposed
expansion is consistent with the requirements of the Ml (Light
industrial) zoning district, and with applicable provisions of the
General Plan.
CONDITIONS:
1-8) Standard Architectural and Site Approval Committee conditions,
except Condition 7 thereof, which is superseded by the conditions
enumerated herein.

1. STREET IMPROVEMENTS & DEDICATION
Street widening, improvements, and dedications shall be provided in
accordance with City Standards and specifications and as required by
the City Engineer.
Curbs and gutters, sidewalks and related structures shall be installed
in accordance with grades and standards as specified by the City
Engineer.
LIGHTING
Street lighting shall be installed and shall be as approved by the
City Engineer. On -street lighting shall be as required by the
Architectural and Site Approval Committee and ordinances and
regulations of the City. All on and off -site lighting shall be
designed to in no way interfere with adjacent areas and shall be no
higher than the maximum height permitted by the zone in which the
property is located.

Fire hydrants shall be located as required by the City.

5. TRAFFIC SIGNS
Traffic control --signs shall be placed at locations specified by the
City.
Street trees shall be planted within the Public Right of Way and shall
be of a type approved by the City in accordance with applicable
standards and ordinances.
7. GRADING
Grading shall be as approved and required by the City Engineer in
accordance with Ordinance No. 214(a).
Drainage shall be provided to the satisfaction of the City Engineer.

The developer shall be responsible for complying with the requirements
of the Underground Utility Ordinance No. 331 and other related
ordinances and regulations of the City of Cupertino, and shall make
the necessary arrangements with the utility companies involved for the
installation of said facilities. The developer shall submit a
detailed plan showing utility underground provisions. (This plan must
have prior approval of the utility companies and the City Engineer.)
The project developer shall enter into a development agreement with
the City of Cupertino providing for payment of fees, including but not
limited to checking and inspection fees, storm drain fees, park
dedication fees and fees for undergrouriding of utilities. Said
agreement shall be executed prior to issuance of construction permits.
11.
Electrical transformers, telephone vaults and similar above ground
equipment enclosures shall be screened with fencing and landscaping
or located underground such that said equipment is not visible from
public street areas.
SECTION IV: CONDITIONS A4INISTED BY THE PLANNING DEPARTMENT
That the approval is based on Exhibits A, A-i, B, B-1, B-2, B-3, and L
of Application ASAC 51,782.1 except as may be amended by additional
conditions enumerated herein.

13. USE T IMI'T'ATIONS
The subject Use Permit authorizes expansion of an existing
industrial/office/research and development ccuplex by approximately
40,000 sq. ft. with underground parking, as generally described in the
Exhibits enumerated in Condition 12 above. Research and development
activities shall be limited in accordance with the City of Cupertino
General Plan Policy.
To ensure consistency with the City's General Plan development
intensity limitations, the developer shall record a final subdivision
map consolidating all existing parcels into a single lot; alternately,
the developer may record appropriate floor area ratio credit transfers
between parcels, as provided in the City's F.A.R. Transfer Manual.
14. PARKING
Parking shall be provided at a ratio of one space for every 285 sq.
ft. of gross floor area for office and one space for every 450 sq. ft.
of gross floor research and development activity, area for
manufacturing activity. The developer shall retain the option to
provide up to five (5) secured bicycle locker devices in lieu of an
equivalent number of parking spaces.
All employee and customer parking spaces shall comply with City
Standard dimensional specifications.
Prior to issuance of building permits, the developer shall obtain
certification from the Director of Public Works as to adequacy of the
parking plan on Exhibit A of this application, as required under
Section 120.1 of Ordinance 220(k).
Concurrently with review of building permits, the developer shall
demonstrate co pliance with fire safety equipment requirements as
specified by the City.
The developer shall present a solution for screening of roof mounted
mechanical equipment to the Architectural and Site Approval Committee
prior to issuance of building permits.
The developer shall install a masonry sound barrier on the westerly
property boundary of the site. The height, materials and placement
thereof shall be subject to staff approval at the building permit
stage.

18. TRAFFIC IMPACT MITIGATION
Prior to issuance of building permits, the developer shall execute an
agreement which shall provide for construction of an improved
secondary access from Imperial Avenue to the subject site upon
determination by the City Council that said access will alleviate
future unacceptable congestion at the Bubb Road/Results Way or Bubb
Road/McClellan Road intersection.
19. LANDSCAPING
The Prunus and Quercus tree varieties indicated on Exhibit L at the
south and east perimeters of the building shall be installed as 2/3
minimum 24" box specimens, and 1/3 15 gallon container size applied to
the total number of trees, subject to staff approval.
20. MODIFICATION OF APPROVED DEVELOPMENT PLAN
In the event that the applicant or subsequent property owner shall
desire to make any minor changes, alterations or amendment of the
approved development plan, a written request or revised development
plan shall be submitted to the Director of Planning and Development.
If the Director makes a finding that the changes are minor and do not
result in a material affect upon the appearance or function of the
project, said changes may be certified on the revised plan. If
approval of said changes is withheld, the applicant may appeal to the

The applicant shall provide a plan for preservation of the existing
specimen trees on the subject property which may be affected by the
proposed construction activity. Said plan shall include graphic
depiction of protection devices to be installed along the dripline
perimeter of each tree for the duration of construction activities.
