HomeMy WebLinkAboutASAC Reso 1366ASAC 4-EXC-88 RESOLu TION NO. 1366 OF THE ARCHITECTURAL AND SITE APPROVAL CONMITIEE OF THE CITY OF CUPERTINO APPROVING VARIOUS EXCEPTIONS TO ORDINANCE 1438 FOR SETBACK REQUIRENE TS FOR TWO SINGLE FAMILY DWELLINGS APPLICANT/DEVELOPER: Bob Kiel PROPER= OWNER: Venture II APPLICANTS'S ADDRESS: 10240 Dubon Avenue Cupertino, California 95014 PROJECT LOCATION: Northeast quadrant, Manita Ct. and Rainbow Drive The Architectural and Site Approval Committee finds as follows with regard to the subject application: 1. The applicant has demonstrated practical difficulties in the case of Parcel A insofar as the sideyards setbacks are determined by the move on house's pre-existing dimensions. 2. The proposed reduction in front yard second story setback for Parcel A is justified as a hardship imposed by narrow lot widths resulting from the infill condition of the subdivision. 3. The proposed reduction in rear yard second story setback for Parcel B is justified as a hardship imposed by narrow lot widths resulting from the infill condition of the subdivision. The minimum degree of deviation from prescribed regulations is represented by the adjustment required in Condition 10 below. CONDITIONS: 1-8) Standard Architectural and Site Approval Committee Conditions to the extent that they do not conflict with the special conditions listed herein. In the event of conflict, the specific conditions listed herein shall prevail. 9) The approval is based upon Exhibits A, B 1st. Rev., B-2, B-3, B-4, B-5 1st. Rev., Info. 1 and Info. 2 of ASAC Application 4-EXC-88, except as may be amended by Conditions enumerated herein. 10) The rear yard second story setback for Parcel "B" shall not be less than 25 ft. 11) The Exceptions granted under this resolution are contingent upon recordation of a final parcel map filed under City Application 2 -'IM -88. Failure to record said subdivision shall invalidate these approvals. Further, these approvals may be invalidated if substantial change in lot area or parcel dimensions from those appearing on Exhibit Info. 1 are imposed during the subdivision approval process.
