OF THE CITY OF CUPERTINO DENYING VARIOUS EXCEPTIONS
TO ORDINANCE 1438 FOR SETBACKS AND FLOOR AREA RATIO
REQUIREMENTS FOR TWO SINGLE-FAMILY DWELLINGS

The Architectural and site Approval Committee finds as follows with regard
to the subject application:
1) The lot shape and dedication requirements affecting the corner
(northerly) parcel justify granting of an exception. However, the
degree of deviation represented by the excess second story F.A.R. and
setbacks is beyond that necessary to accomplish the purposes for which
the exceptions are sought.
2) The lot "shape" and area of the interior (southerly) parcel are such
that no undue hardship on practical difficulties in complying with the
Urgency Ordinance are demonstrated.
PASSED AND ADOPTED this 14th day of March, 1988 at a regular meeting of
the Architectural and Site Approval Committee of the City of Cupertino,
State of California, by the following roll call vote:
