A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ACCEPTING A GRANT OF EASEMENT FOR OVERLAND STORM DRAIN
PURPOSES FROM BERKELEY B. SIMONDS AND MARJORIE V. SIMONDS
LOCATED WEST OF TULA LANE; CONSISTING OF APPROXIMATELY
.01 ACRE
WHEREAS, Berkeley B. Simonds and Marjorie V. Simonds, Grantor,
have executed a Grant of Easement which is in good and sufficient form,
conveying to the City of Cupertino, Grantee, an easement for overland
storm drain purposes over the property situate in the City of Cupertino,
County of Santa Clara, State of California, more particularly described
in Exhibit "A" and Exhibit "B", attached hereto and made a part hereof:
All that certain real property situate in the City of Cupertino,
County of Santa Clara, State of California, consisting of approxi-
mately .01 acre, located west of Tu1a Lane.
NOW, THEREFORE, BE IT RESOLVED that the City of Cupertino accept
said Grant so tendered; and
IT IS FURTHER RESOLVED that the City Clerk be and she is hereby
authorized to record said Grant of Easement and this Resolution.

Overland Drainage Easement
An easement (5.00 feet wide) for the installation, maintenance,
and repair of an overland drainage system, under and upon that certain
parcel of land situate in the City of Cupertino, County of Santa
Clara, State of California, being described as follows:
The Northerly 5.00 feet of that certain Parcel of land granted
from Lorne W. Simons and Norma Jo Simons to Berkeley B. Simonds and
MarjorieV. Simonds by Deed dated June 28, 1979,APN 359-13-081 and
recorded June 29, 1979 in Book E600 of Official Records, page 119,
Santa Clara County Records.
