CC Resolution No. 7175 '- =" RESOIlJTION NO. 7175 A RESOIlJTION OF THE CITY CXXJNCIL OF THE CITY OF aJPERI'INO, CDUNTY OF SANTA CIARA, CALIFORNIA, DEI'ERMINING nJAT PUBLIC INTEREST AND NECESSITY REQUIRE THE Ao;pJ:SITION OF FEE TITÅ’ AND DIRECI'ING THE FILING OF EMrnENT !XWIIN PROCEEDINGS Am 359-13-37 RECITAIS : (a) The City Council of the City of CUpertino, on April 17, 1987 pursuant to the requirements of Code of civil Procedure, Section 1245.235, caused to be sent by first-class mail to each person whose property is to be acquired by eminent domain, (as hereinafter described) and whose name and address appears on the last equalized county assessment role, notice and a reasonable opportunity to appear and be hear on the matters referred to in Code of Civil Procedure, section 1240.030. (b) The city Council of the City of CUpertino, on April 17, 1987 pursuant to the requirements of Goverment Code section 7267.2, caused to be sent by first-class mail to each person whose property is to be acquired by eminent domain, (as hereinafter described) and whose name and address appears on the last equalized county assessment role, an offer to -1- RESOWrION NO. 7175 acquire the property for the full amount of the market appraisal value. A copy of said letters are attached hereto as Exhibit "C" and made a part hereof by reference. (c) On May 4, 1987 and prior to the adoption of this resolution, the City Council of the City of CUpertino held a hearing at which all persons, described in paragraph (a) above, were afforded an opportunity to appear and be heard on the matter referred to in Code of civil Procedure, section 1240.030; and (d) '!he follCMing persons appeared and were heard at said hearing: Name Bert Viskovich Address City of Cupertino 10430 S. De Anza Blvd. Cupertino, CA 95014 RESOLVED, by the city Council of the city of CUpertino, that it finds and deteDnines and hereby declares that the public interest and necessity -2- RESOIlJTION NO. 7175 require the acquisition, construction, and completion by the City of CUpertino, of a public :Ïl11provement, namely, a water line easement in, aver, upon, and across that certain real property cies=ibed in Exhibits "A" and "B," which are attached hereto and made a part thereof by reference; that the uses to which said fee title in, aver, upon and across all of said real property is to be applied if for such water line easement and such use is a public use authorized by law; that a fee title in, aver, upon and across all said real property is necessary to and for such public use; and that the taking of a fee title in, upon, aver and across all of said real property is necessary to and for such public use and that the proposed water line easement is planned and located in a manner that will be most campatible with the greatest public good and the least private injw:y; the City of CUpertino is authorized by Government Code section 37350.5 to acquire said property by eminent domain. IT IS FURI'HER RESOLVED that the city of CUpertino acquire by condemnation, fee title in, upon, aver and across said real property in accordance with the provisions of the law relating to eminent domain for the uses and purposes of such roadway, as herei.nabove set forth; and IT IS FURI'HER RESOLVED, that Olarles T.
