(“Toll Brothers”) as land use counsel regarding the entitlement process for its project to develop 55 townhomes and 10 accessory dwelling units (“ADUs”) and associated infrastructure (the “Project”) on the property located on the 2.72-acre Idlewild Shopping Center site at 10065-10075 East Estates Drive (APNs 369-06-002, -003, -004) (the “Property”) in the City of Cupertino (the “City”). Toll Brothers is the developer of the Project and Idlewild Center, TIC is the Property owner. On December 4, 2025, I submitted a letter, on behalf of Toll Brothers, responding to comments raised at the November 12th Planning Commission public hearing regarding the Project approvals. The purpose of this letter is to provide further updated clarifications to the response I submitted on December 4th. As I noted in my letter, at the Planning Commission meeting, the Planning Commission and members of the public raised concerns regarding the status of environmental contamination associated with the former dry cleaner that operated on the Property. As a further clarification to my December 4th letter, the dry cleaner operated between the 1960s and 2010. Additionally, commenters noted that information available from the Santa Clara County Department of Environmental Health (SCDEH) and GeoTracker indicated that the SCDEH is overseeing the cleanup of the Property and a soil vapor extraction system (SVE) operated on the Gian Martire December 15, 2025 Page 2 BUCHALTER 106992073v1 Property to remediate elevated levels of tetrachloroethylene (PCE). My December 4th letter indicated that the SVE was turned off earlier this year to monitor the groundwater to determine if PCE remains in the groundwater. ENGEO has provided further clarifying information confirming that the SVE was turned off earlier this year to monitor soil gas conditions for rebound and determined whether SVE has achieved cleanup goals or whether additional SVE operation may be necessary” (there has been no groundwater monitoring at the site). This information does not change the conclusion in my letter and provides further information demonstrating that the prior contamination has been subject to remediation. We appreciate your consideration of the information contained in my December 4th letter as supplement by this letter.
