RESOLUTION NO. 405
OF THE ARCHITECTURAL AND SITE APPROVAL. CONNITTEE
OF THE CITY OF CUPERTINO recommends approval of
the modification to Section 5.11 and Section 7.021
of Sign Ordinance 353 to the Planning Commission.
Section 5.111 - Non -Conforming Sins
All signs which are lawfully in existence on the effective date of this
Ordinance but which do not meet all the requirements thereof shall be considered
to be non -conforming signs. No non -conforming sign shall be structurally altered,
changed or decreased in size, relocated or have a change of copy unless made to
comply with all the provisions of this Ordinance.
Section 5.112 - Abatement Period
All non -conforming signs shall be permitted to remain, unless altered as
stated above, no more than two (2) years after the enactment of this Ordinance
or five (5) years after the erection of the sign whichever time limit falls on
the later date. The provisions of this Ordinance are not intended to affect
the abatement pericd of non -conforming signs already commenced under the provisions
in Section 5.11 of Ordinance 353 enacted June 30, 1967.
Section 7.0210 - CommercialOffice and Industrial Sizns
Each business establishment shall not, unless otherwise specified in
this Section 7, be allowed a sign surface area that exceeds three per cent
(3%) of the gross floor area said establishment occupies in a building or
buildings, with no credit for parking space inside or outside of buildings,
and with the following exceptions:
a. An establishment occupying more than one-story shall
not be allowed a total sign surface area that en-ceeds
three per cent (3%) of the gross floor area of any one
story, plus one and one-half per cent (1-1/2%) of the
gross floor area of another story, with no credit for
additional stories or for enclosed parking space.
b. Sign area for service stations shall be based on total
lot area. Total sign surface area shall not exceed one
and one-half per cent (1-1/2%) of the lot area.
c. Dealers in new and used cars shall not be permitted a
sign surface area that exceeds on -half per cent'(1/2%)
of the lot area, or sign area according to gross floor
area, whichever is greater.

Section 7.0211
The Architectural and Site Approval Committee shall have the power to
restrict the sign surface area for any application to less than three per cent
(3%) of the gross floor area when in the opinion of the Architectural, and Site
Approval Committee the maximum three per cent (3%) figure would not be in
keeping with the purposes of this, ordinance or when it would be inconsistent
with the sign guidelines which have been adopted by the Committee.
PASSED AND ADOPTED this 5th day of June, 1974, at a regular meeting of the
Architectural and Site Approval Committee of the City of Cupertino, State of
California, by the following roll call vote:
