Hi City Council,
I am saddened to see so much nastiness in the public comment today among people who do
not know the whole story of all of what happened at the meeting on December 2. I agree with
Councilmember Wang that a vote should not have been agendized within a Study Session
item. I wish that Councilmember Wang had been able to stay on the meeting and abstain from
voting rather than his leaving unexpectedly, evidently due to not being able to locate an
operable outlet (he needs to get a bigger battery pack). Councilmember Wang should be
applauded for recognizing that there was a problem with the way the item was agendized. He
has a unique set of skills, is extremely intelligent, and deeply cares about residents.
As your first item of business as a new City Council, I would ask that you codify that no
votes are to be taken in a study session. I have resided in Cupertino, and I never saw a vote
taken during a study session (except in 2023, when I complained about it); I was only able to
go back 9 years to show that this is how our City has operated in the past. Because there has
been so much discussion on this issue, below and attached are the contents of an email that I
sent yesterday that I’d like to be posted for item #1 today.
Separately, this has been a great year with Mayor Chao’s leading from the heart (in addition to
her brilliant mind) and restituting canceled programs and instituting new ones.
Councilmember Wang has been the fresh new face on the council and in spite of a busy
schedule, has been extremely accessible to his constituents and has brought novel perspectives
to our council. Let’s give him some grace as our rookie on Team Cupertino. I am assuming
that Kitty will be Mayor and she brings a wealth of experience from her days on the Planning
Commission, City Council, independent study, and most of all, a curious mind. She is adept at
running meetings and it has been a joy to watch her grow into this role.

to be part of the public record for item #1 this evening.

Dear City Manager,
On the December 2, 2025 Agenda (last attachment), an ACTION was listed under a STUDY
SESSION ITEM #12. Agenda items with ACTIONS should be on the ACTION CALENDAR,
not STUDY SESSIONS.
Please ensure that ACTIONS are not taken at STUDY SESSIONS in the future.
A similar error was made in January 2023 and you can see below an email that I wrote to the
City about this along with a number of attachments illustrating that ACTIONS had NEVER
been taken at prior STUDY SESSIONS.
Furthermore, I googled, “city government can actions be taken at study sessions” and got the
following response (I’ll leave it to the experts to study the issue in greater depth):
No, generally, city governments cannot take formal action (like voting or passing
ordinances) at study sessions; these are for in-depth discussion, information gathering, and
providing staff direction, with official votes reserved for regular meetings, though some
"direction" can be given to staff to prepare items for a formal vote later. The key is that study
sessions are for deliberation, not decision-making, and must still follow open meeting laws
(like the Brown Act in California) by being public, noticed, and having agendas, ensuring
transparency even without votes.
I don’t know whether it is allowed to have an action on a study session (it doesn’t look like it),
but it just isn’t good practice. Please also consider that an action tied to a Study Session could
alter the nature of the discourse during the Study Session as it risks shifting discussion toward
the specified action. Moving forward, please let’s keep STUDY SESSIONS action-free.

Final Actions are not made at Study Sessions.
Items are studied at Study Sessions, discussed at subsequent Regular Sessions, and
subsequently decided.
This has been the case as far as I can remember in my 40 years as a Cupertino resident.
Attached you will find the facts to back up this assertion going back 9 years of Study Sessions
(this was the maximum I was able to extract from the database).
In 9 years, Final Actions have never taken place on the same day as Study Session Items.
To continue transparency and public participation, at the next City Council meeting and
moving forward, please
1. Do not take Final Action (vote on resolution) on Study Session items
2. Discuss the outcome of a Study Session and open public comment at a subsequent City
Council meeting and then take action

Dear Mayor and Council Members,
Thank you for your ongoing commitment and services to our city.
As you prepare to select the Vice Mayor at your annual December appointment, I respectfully encourage a clear,
criteria-driven approach and a brief public explanation of your rationale. The City’s process of choosing the Mayor
and Vice Mayor annually helps keep leadership accountable and responsive to evolving priorities, and I appreciate
the intent behind this structure.
In considering the appointment, I hope you will weigh factors such as consistent meeting preparedness, respectful
and fair facilitation, collaborative problem-solving, and a demonstrated ability to advance the City’s goals through
constructive engagement with colleagues, staff, and residents. In addition, strengthening public trust often depends
on leaders who communicate clearly, respect process, and follow through on commitments.
For context as you evaluate leadership experience and committee engagement across the dais, councilmember R
“Ray” Wang, who is serving his first term until December 2028, emerges as a great choice. In March 2025 the
Council established a two-member legislative review-style subcommittee for the 2025 session, comprised of Vice
Mayor Kitty Moore and Councilmember Wang, to meet with the City’s lobbyist on state legislation. This is one
example of the type of governance work that may be relevant to your overall assessment of leadership readiness
and policy engagement.
More broadly, I hope the Council will prioritize a Vice Mayor who can help ensure orderly, effective meetings and
support transparent, fiscally responsible, resident focused decision-making.
Here are highlights of some of his activities that I am impressed with and make him an ideal candidate for becoming
the next Vice Mayor of the city.

Economic Development: In 2025, he worked through the Economic Development Committee to address vacant
storefronts and improve the business climate, serving as the primary Council representative and on a two-member
ad hoc subcommittee refining its focus and priorities. He supported the 2025–27 City Work Program, which places
economic growth and a healthy local business environment among Cupertino’s core priorities.
Fiscal Responsibility: He has been consistently involved in fiscal housekeeping decisions, regularly moving or
seconding consent items involving staffing changes, budget adjustments, and fee/lien actions. He supported
bringing Treasurer’s and Investment Reports directly to the Council agenda, increasing transparency and
strengthening oversight of City finances. He backed a work-program structure that ties long-term fiscal sustainability
to service levels and quality of life for residents.
Regional Transit and Mobility: He represents Cupertino on the State Route 85 Corridor Policy Advisory Board and
the Stevens Creek Corridor Transit Steering Committee, participating in regional mobility and transit discussions that
directly affect local traffic and connectivity and has been representing the city's interests well. He also serves as an
alternate to ABAG and the VTA Policy Advisory Committee, helping link Cupertino’s interests with broader Bay Area
planning and transit policy.

Councilmember Ray Wang has demonstrated integrity, fairness, and a deep commitment to Cupertino residents
in discharging his duties and has earned our trust through his dedication and honesty.
I urge the council to not pay heed to the attempts from certain sections to undermine his role and elect him as
the next Vice Mayor of the city. I trust you will make the best decision for our community.

There has been a lot of attention to the Mary Avenue Villa project and city meetings related to it. Accusations,
finger pointing, etc both regarding how the project was handled and how meetings evolved.
My preference for the mayor/vice mayor is Kitty Moore as mayor and Councilmember Ray Wang as vice mayor.
Councilmember Wang has delivered on his promise of representing the residents. He is a strong resident focused
advocate who would be a strong support to the mayor.
IF this combination is not accepted, I would like to see Mayor Chao continue as mayor and Vice Mayor Moore
continue as vice mayor. This would continue the status quo at a time when things are changing around us.
I am not comfortable with Councilmember Fruen being in either position due to his divided loyalities between
Cupertino and the City of San Jose’s District 1. His “day job” working for the City of San Jose as Chief of Staff
for District 1 puts him in potential conflict with what is best for Cupertino. I want someone focused on what is best
for Cupertino. You cannot serve two masters.
In summary, please elect Kitty Moore as mayor and Ray Wang as vice mayor. IF that is not possible, please elect
Mayor Chao as mayor and Kitty Moore as vice mayor.

It is that time of year again and I wanted to voice my support for the selection of Council

Dear Mayor Chao, Vice-Mayor Moore, Council Members,
I am writing because, as a resident, I believe it is important to acknowledge leaders who
consistently stand up for the people they serve. Councilmember Ray Wang has shown a rare
level of commitment to the residents of Cupertino. Time after time, in meeting after meeting,
he listens to what residents say, weighs their concerns seriously, and votes in line with what
the community is asking for. That kind of steady alignment with Cupertino residents is not
something we see every day, sadly and it deserves to be recognized. We need to see more of it
from more of you not less
I have watched him take positions that were not always the easiest politically, but were clearly
the choices Cupertino residents wanted. Not special interest groups. Not organizations or clubs
but ordinary residents of Cupertino. He does not pick convenience over responsibility. He
chooses the Cupertino resident community time after time on every single vote he casts and
position he takes. That is exactly the kind of leadership that builds trust in local government.
With this in mind, I am very concerned about any efforts by people preaching a moral higher
ground to push him aside or reduce his role. When the council sidelines the member who
listens most closely to the public, it sends the wrong message about priorities. These same
people preaching today were nowhere to be found when prior council majority went after then
council members Liang Chao and Kitty Moore including stripping them of committee
assignments and did not even spare a past Mayor who served his 8 years
I strongly encourage you to elect Councilmember Ray Wang as Vice-Mayor. He has earned
that position through his consistency, his respect for Cupertino residents’ voices, and his
willingness to act on what people actually want, not what is politically comfortable or aligned
with special interest groups, organizations and clubs.
Residents would love to see the rest of the Council follow his example of always standing by
residents, meeting with residents, voting for residents positions and respecting the rights of
home owners, land owners and neighborhoods who pay enormous property taxes to live here
and fund the operations of the city. Cupertino residents deserve council members and Mayors,
Vice-Mayors who stand with them, not above them. Councilmember Ray Wang has set a
standard, and it would benefit the whole city if every Councilmember approached decisions
with that same commitment to the public’s will.
I hope you will take this opportunity to show the community that their voices matter by
supporting him for Vice-Mayor. Stand with Cupertino residents not with special interest
groups, clubs, organizations and those that preach morals when they showed none in attacking
Ray Wang previously to take him off planning commission.

Dear Mayor Chao, Vice Mayor Moore, and City Council-members,
I believe that Council-member Wang's behavior at the end of the meeting on December 2nd, where he intentionally
prevented the Council from moving forward with important business, is disqualifying for any leadership position
(e.g. Mayor or Vice Mayor) on the Council.
Council-member Wang's action was an intentionally hostile act toward the full Council and, by extension, all
residents of Cupertino. You and Cupertino deserve better. You should not be in a position of having an entire
meeting aborted due to the whims of one councilmember. Quorums were created for a reason.
Therefore, in addition to denying Council-member Wang any position of leadership on the Council, the Council
should implement rules that ensure that the City's business moves forward. To that end, Council-member Wang's
privilege to attend meetings remotely must be revoked. This is just common sense and good governance.
Council-member Wang's behavior reflects poorly on the Council and our great city. Please implement rules to
ensure Council-member Wang can not be in a position to pull this kind of stunt again. Fool us once, shame on him.
Fool us twice, shame on us.
And please, do not elevate him to a position of leadership on the Council.

Dear Honorable Mayor Chaio, Vice-Mayor Moore and City Councilmembers:
At the Dec 2, 2025 City Council Meeting, Ray Wang, city councilmember, behaved in an incredibly
disgraceful and disrespectful manner to the entire city council when he argued with the city attorney,
attorney and councilmember, JR Fruen and Mayor Liang Chiao, when he repeatedly vehemently refused
to accept the legal council of the two lawyers present, ignored the Mayor’s control of the meeting,
threatened to hang up from his Zoom call attendance even though it would prematurely end the council
meeting before the council finished all the items on the agenda, and finally hung up on the meeting
terminating the meeting unilaterally.
He now offers a late and flimsy excuse that he had “computer battery” issues. The video of the meeting
especially the last 10 minutes of the YouTube of Cupertino City Council Meeting Dec 2, 2025 (Part 2)from
2:53:26 to 3:04:22 shows the truth and how his late flimsy apology is a lie.

The entire heated verbalization from Ray Wang was that the title of the meeting was a “study session”
and he repeatedly adamantly stated that the second item of appointing a negotiator for Mary Ave Villas
could not be done. He threatened to terminate the meeting by leaving. He would not accept the legal
advice of the 2 attorneys present and ignored the Mayor. He then hung up thereby unilaterally forcing the
council meeting to close. He NEVER said he was having computer battery issues during the entire
council meeting including the last 10 minutes.
We cannot reward such behavior by electing him Vice-Mayor nor Mayor. As Vice-Mayor and eventually
Mayor he would be in charge of running and managing our city council meetings. Through his behavior
on Dec 2, 2025 and his long history outlined below, he lacks the willingness and the ability to build
consensus on the dais and city. He is not professional, and frequently falls into extremely inappropriate
behavior. We cannot have such a “loose cannon” running our city council meetings.
He must be censured and have his Zoom attendance privileges revoked. He has abused his attendance
via Zoom by having the vast majority of his council attended by him via Zoom and now has caused 3
meetings to end early. Two other meetings he ended early claiming he needed to board his plane. He
should have scheduled his plane flights to not force the city meetings to adjourn early. He has totally
abused his attendance by Zoom and now is using his Zoom attendance to veto item(s) he disagrees with
by terminating the meeting. He has demonstrated extremely poor behavior and extreme self entitlement
including violating California Penal Code vSection 403 PC: Disturbing A Public Meeting violation and lack
of collaboration and compliance in the business and procedures of the city and city council.
Do not make him Vice-Mayor or Mayor which would highlight and reward his bad behavior. He would
terminate/interrupt fruitful council discussions and entangle the city and city council in his misdeeds
followed by flimsy excuses. Let his shortcomings be his. Do not reward him for them nor entangle the
city and the council in his shortcomings.
His history of misconduct includes blaming his computer for his behavior. In 2003, he denied sending
pornographic images to Rosanne Foust, a former Redwood City planning commissioner and
councilmember, and claimed his “computer was hacked”. He has a long history of misconduct
documented by San Jose Spotlight in July 2019 and his NextDoor postings June 2019 implying he would
contact the employer of Richard Mehlinger, a pro-housing advocate and future Sunnyvale
councilmember. According to SJ Spotlight he encouraged others to “track down their employer and send
their HR, Legal and CEO a letter outlining their YIMBY stance…to getting them reprimanded…” He also
served community service in 2004 in which he pleaded no contest to charges of “making annoying
telephone calls to a place of work”.
The council has other members who can be elected Mayor and Vice-Mayor. The city needs to have a
Mayor and Vice-Mayor who have demonstrated the ability to follow the law, navigate the complicated
issues Cupertino will face including having enough housing units to avoid the Builder”s Remedy to occur
again and having the ability to be ethical without repeatedly blaming their computer for their misdeeds.
Cupertino deserves much better.
